Murty Classical Library of India Design Contest Official Rules

Introduction
This document describes the official rules (hereinafter Official Rules) of the Murty Classical Library of India (hereinafter MCLI) Design Contest (hereinafter the Contest) sponsored by Harvard University Press (hereinafter HUP or Sponsor). The objective of this Contest is to create the design of the logo, logotype, and jacket for print and digital books of the MCLI, the mission of which is described below. Information on how to enter the Contest and about the prizes is part of the Official Rules.

MCLI Mission
MCLI aims to make available the great literary works of India from the past two millennia in scholarly yet accessible translations. MCLI will provide up-to-date English translations of works composed prior to c. 1800 CE from the full spectrum of Indian languages: from Bangla, Kannada, and Persian to Sanskrit, Tamil, and Urdu. In addition, the text in the appropriate Indic script will be provided on the facing page. A scholarly introduction, explanatory commentary, and textual notes will accompany each work, with the aim of making MCLI volumes the most authoritative available. The series, whose volumes will remain in print in perpetuity, is intended to showcase on a major scale the literary treasures of the Indian past, across languages, communities, and social orders, and the unparalleled contribution they have made to world civilization.

Definitions
Entry means the logo, logotype and jacket design created by the Entrant for this Contest. Entrant means the individual who enters the Contest.

Eligibility
1. The Contest is open to individuals who are legal residents of the United States of America, the United Kingdom, and India and to design firms that operate and are licensed to do business in the United States, the United Kingdom, and India. 2. Employees, officers, directors, and advertising and promotion agencies of Harvard University and Harvard University Press; members and affiliates of the MCLI Executive Board and Editorial Board; and Contest judges, as well as immediate family members of the aforementioned and members of their households (whether or not related), are not permitted to enter the Contest. 3. 4. 5. For purposes of the Contest, immediate family members means parents, spouses, children, siblings, and grandparents, regardless of where they reside. Individual Entrants must be at least eighteen (18) years old (or the age of majority in their state of residence if greater than 18) at the time of entry. The Contest is VOID WHERE PROHIBITED BY LAW.

Entry Rules
1. Visit www.murtylibrary.com, (the Website) from 00:00:01 Eastern Daylight Time (EDT) on September 1, 2011 to 23:59:59 Eastern Standard Time (EST) on December 1, 2011 (Entry Period), complete the entry form and follow the instructions to upload your Entry. Once you complete the entry form and upload your designs to the Website (see Submission Guidelines below for further information), you will be entered into the Contest. 2. 3. THERE IS NO FEE TO ENTER THE CONTEST. Entrants will need to submit one (1) .pdf file containing a logo, logotype, jacket design (with spines). See the Submission Guidelines below for further information.

There is a limit of one (1) Entry per Entrant. If more than one Entry is received from an Entrant, the first one submitted will be accepted and others will be rejected.

All Entries that do not conform to the Submission Guidelines and/or are received by Sponsor after the Entry Period will be disqualified from the Contest. Sponsors clock will be the official timekeeper for the Contest.

Sponsor is not responsible for lost, late, illegible, incomplete, delayed, or misdirected Entries, and all such Entries are void. In the event of a dispute regarding the identity of the person or firm submitting an Entry, the Entry will be deemed submitted by the person or firm in whose name the email account is registered.

All Entries submitted shall become the exclusive property of Sponsor and will not be returned. Proof of entry will not be deemed proof of receipt by Sponsor. this Contest. No direct inquiries shall be considered, nor will there be any replies to inquiries made.

Submission Guidelines
The purpose of the Contest is to create the design of the logo, logotype, and jacket for MCLI print and digital books. The final version of the logo will need to be suitable for high quality printing as well as for screen usage. The jacket should include a title, subtitle, author name, and editor/translator name as illustrated in the list of samples below. Designs should accommodate a wide variety of possible needs (as indicated in the sample titles listed below), including without limitation multiple authors, multiple volumes, and multiple works. Designs should take into account both print and screen usage, as well as color and black-and-white usage. The elements of the design may be re-used for the MCLI website. All Entries should be submitted as one (1) .pdf file, not to exceed ten (10)

megabytes in file size. Explanation of concepts will be considered but is not required. All Entries must contain logo and logotype as standalone items, proposed jacket design with spines, color and ink specifications, and an outline of print and screen specifications. Sample Jacket Design Information: Jacket designs should be for volumes with the dimensions 5.25 inches wide by 8 inches high. Prizes
The winning designer will receive: 1. 2. Design credit with the design winners name appearing on all book jackets. A 10,000 USD prize.

The monetary prize will be delivered within ninety (90) days of HUPs receipt of the signed Affidavit and the Assignment of Rights from the winning designer, pending verification of winners eligibility. The prize is not transferable, and the winner will be responsible for paying all taxes on the prize. There is no prize substitution, except at Sponsors sole discretion.

Judging and Selection of Winner


1. 2. There will be two rounds of judging. On or about December 9, 2011, a qualified panel of judges (the Preliminary Panel) will select no more than 25 finalists from among all eligible Entries received during the Entry Period. 3. 4. The Preliminary Panel will judge each eligible Entry on its success in visually representing the mission of the series (the Preliminary Judging Criterion). The Entrants whose Entries received the highest score by the Preliminary Panel will be selected as the finalists. In the event of a tie, the tied Entries will be added to the list of finalists to be judged by the Final Panel. 5. 6. On or about December 16, 2011, a qualified panel of judges (the Final Panel) will select one (1) prize winner from among the finalists. The Final Panel will judge each finalists Entry on the following criteria: the Entrys success in visually representing the mission of the series; the practicability of implementing the design in print and screen formats; the originality and creativity displayed in the design; the appropriateness of the design for the marketplace; the ability of the design to remain relevant now and in the future to MCLIs mission without being explicitly linked to any specific historic period, region, religion, or linguistic tradition of South Asia (the Final Judging Criteria). 7. The finalist whose Entry receives the highest cumulative score by the Final

Panel will be selected as the Potential Prize Winner. In the event of a tie, the tied Entries will be re-judged by the Design department of Harvard University Press, who will serve as the tiebreaker and evaluate such tied Entries according to the Final Judging Criteria. 8. 9. The judges decision shall be final. The judges reserve the right not to select a Potential Prize Winner if, in their sole discretion, no eligible Entries are received.

Winner Notification/Prize Claim


1. On or about December 19, 2011, the Potential Prize Winner (a) will be notified by email via the account used by the Entrant at the time of entry and by mail at the address provided by the Entrant at the time of entry, and (b) will be sent an Affidavit of Eligibility/Liability/Publicity Release (the Affidavit) and an Assignment of Rights. 2. In order to receive his or her prize, the Potential Prize Winner must sign and return to Sponsor, by mail, a signed Affidavit and signed Assignment of Rights within fifteen (15) days of receipt. The Potential Prize Winner understands that he or she must assign all of his or her rights in the Entry to the Sponsor as a condition of receiving his or her prize. 3. If the Potential Prize Winner fails to return the Affidavit or the Assignment of Rights within the required time period, or if it is determined by Sponsor, in its sole discretion, that a Potential Prize Winner is not eligible in accordance with these Official Rules, the Potential Prize Winner shall forfeit his or her right to the Prize, and the Entrant whose Entry received the next highest cumulative score will be selected as the Potential Prize Winner. 4. 5. In the event that the prize winner is disqualified for any reason, Sponsor shall have no liability or obligation to such prize winner. Accepting the prize constitutes permission for Sponsor to make public and otherwise use winners name and country of residence for publicity purposes worldwide without compensation, notice, or approval, and Entrant disclaims any ownership rights to the content of such publicity material. Further personal data may be requested but is not required.

Intellectual Property
1. All Entries must be original, not based on any pre-existing design, and may not have been previously entered in any contest or promotion or have been awarded a prize. 2. 3. All Entries will become the sole property of HUP and may be displayed publicly on HUP and MCLI websites. Entrants hereby assign all intellectual property rights in their submission arising anywhere in the world for the full term of such rights to the President & Fellows of Harvard College and waive all moral or related rights. 4. By entering the Contest, all entrants grant HUP the right to use their name and likeness for promotional, advertising and publicity purposes, where permitted by law. The name and contact details will be processed by HUP in the USA and in other countries in the world, including those outside the European Union, for the purpose of administrating the competition, notifying winners and associated publicity in connection with the winner. Further information can be found in the Privacy section. 5. HUP may modify the winning Entry without seeking the Entrants approval.

Acceptance
Participation constitutes the Entrants full and unconditional agreement to and acceptance of these Official Rules. By participating in the Contest, the Entrant is representing and warranting that he/she has read, understood, and agrees to be bound by these Official Rules. These Official Rules constitute the entire agreement between the Entrant and HUP in relation to the Contest. They govern the Entrants participation and supersede any prior or other agreements between the Entrant and HUP and relating to the Contest.

Privacy
The information Entrants submit will be available to Sponsor for Sponsors use in its sole discretion, and such uses are governed by Sponsors Privacy Policy, which can be found at http://www.hup.harvard.edu/rights/privacy.html.

Winners List
The winners name and winning Entry will be posted on the Website in early 2012.

Other Rules and Regulations


Representations and Warranties
By participating in the Contest, the Entrant warrants and represents in connection with the Entry submitted as part of his/her participation in the Contest: (a) he/she is the sole and exclusive owner of (and free of any adverse claim by any person, firm, or corporation) all intellectual property rights in and to the Entry; (b) the Entry is original and the use of the Entry as described in these Official Rules will not infringe the proprietary rights, including without limitation the intellectual property rights, of any third party; (c) the use of the Entry, as described in these Official Rules, will be in compliance with any third-party licenses pertaining to the Entry; (d) the Entry is not obscene or libelous, and does not violate any rights of any third party, including but not limited to rights of privacy or publicity; (e) the Entry does not contain any virus, spyware, malware, trap door, worm, or any other device, mechanism or code that is injurious or damaging to software or hardware used in conjunction with the Entry; (f) the Entry and its use as described in these Official Rules will not violate any federal, provincial, state or local laws or ordinances; (g) no employer or educational or other establishment has any rights in the Entry; (h) the Entry is consistent with these Official Rules; and (i) the Entrant has the right to grant the license to HUP as required in these Official Rules.

Severability
When any provision of these Official Rules is found to be invalid by a court of competent jurisdiction, the parties nevertheless agree that the Court should endeavor to give effect to the intentions of the parties as reflected in the provision, and that the other provisions of these Official Rules remain in full force and effect.

Indemnity; Disclaimer of Warranties; Limitation of Liability


By participating in the Contest, the Entrant agrees to be bound by these Official Rules, including all eligibility requirements and all decisions of HUP. By participating in the Contest, the Entrant agrees to indemnify, defend, and hold harmless President & Fellows of Harvard College and HUP and their officers, agents, faculty, members of governing boards, affiliates, contractors, agents, contributors, subsidiaries, licensors and distributors (the Harvard Entities) from any and all liability, claims, or actions of any kind, including, without limitation, property damage, personal injury, and/or death, arising out of his/her (i) breach of any representation, warranty or covenant contained in these Official Rules; (ii) participation in the Contest; (iii) receipt, acceptance and/or use or misuse of any prize in connection with the Contest; or (iv) any third party claim relating to any rights in any design submitted. BY PARTICIPATING IN THE CONTEST, THE ENTRANT AGREES THAT THE HARVARD ENTITIES MAKE NO WARRANTY, REPRESENTATION, OR GUARANTEE OF ANY KIND, EXPRESSED OR IMPLIED, IN FACT OR IN LAW, RELATING TO THE CONTEST AND/OR THE PRIZES. By participating in the Contest, the Entrant agrees that neither President & Fellows of Harvard College nor HUP is responsible, and that neither will in any event be held liable, for any: (a) lost, late, illegible, misdirected, damaged, incomplete, corrupted or garbled Entries; (b) telephone, computer, or network malfunction or error; (c) technical failures of any kind, including, but not limited to, the malfunctioning of any computer, communication disruption or other disruptions related to Internet traffic, virus, bug, worm, or non-authorized intervention; (d) any printing or typographical errors in any Contest-related materials; (e) any injury or damage to persons or property, which may be caused, directly or indirectly, in whole or in part, from Entrants participation in the Contest; or (f) damage caused by a computer virus or otherwise resulting to any computer from the submission of Entries. If such malfunction, error, disruption, or damage occurs or impairs the administration, security, fairness, or integrity of the Contest, HUP may, in its sole discretion, suspend, modify or terminate the

Contest by posting a notice at The Website. In such event, HUP reserves the right to judge from those eligible Entries received up to the time of impairment. Persons found tampering with or abusing any aspect of the Contest, or whom HUP believes to be causing or attempting or intending to cause any malfunction, error, disruption, or damage will be disqualified. HUP reserves the right to disqualify any unauthorized Entries, including, without limitation, multiple Entries from the same person, or any Entries made through robotic, automatic, mechanical, programmed or similar multiple-entry, or entry duplication, method and to disqualify any person or entity using such a method. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CIVIL AND CRIMINAL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. NOTWITHSTANDING ANYTHING HEREIN TO THE CONTRARY, AND ONLY TO THE MAXIMUM EXTENT PERMISSIBLE BY THE APPLICABLE LAW, BY PARTICIPATING IN THE CONTEST, THE ENTRANT AGREES THAT IN NO EVENT WILL PRESIDENT & FELLOWS OF HARVARD COLLEGE OR SPONSOR BE LIABLE TO ENTRANTS OR TO ANY OTHER PARTY FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, REGARDLESS OF THE BASIS OR NATURE OF THE CLAIM, RELATING IN ANY MANNER TO THESE OFFICIAL RULES, THE CONTEST OR THE ENTRANTS PARTICIPATION THEREIN, EVEN IF PRESIDENT & FELLOWS OF HARVARD COLLEGE OR SPONSOR WERE EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ALSO NOTWITHSTANDING ANYTHING HEREIN TO THE CONTRARY, BY PARTICIPATING IN THE CONTEST, THE ENTRANT FURTHER AGREES THAT IN NO EVENT WILL THE LIABILITY OF PRESIDENT & FELLOWS OF HARVARD COLLEGE OR SPONSOR RELATING IN ANY MANNER TO THESE OFFICIAL RULES, THE CONTEST OR THE ENTRANTS PARTICIPATION THEREIN EXCEED $1,000 USD. SOME JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO THE ENTRANT. IN THE EVENT THAT THE PRECEDING RELEASE IS DETERMINED BY A COURT OF COMPETENT

JURISDICTION TO BE INVALID OR VOID FOR ANY REASON, THE ENTRANT AGREES THAT, BY ENTERING THE CONTEST, (I) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OR ACTION ARISING OUT OF OR IN CONNECTION WITH THE CONTEST, OR ANY PRIZES AWARDED, SHALL BE RESOLVED INDIVIDUALLY WITHOUT RESORT TO ANY FORM OF CLASS ACTION; AND (II) ANY CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THE CONTEST, BUT IN NO EVENT ATTORNEYS FEES. For the avoidance of doubt, to the extent that US law applies, nothing in these Official Rules shall limit or exclude either partys liability for fraud, or for death or personal injury caused by its negligence, or any other liability to the extent such liability cannot be excluded or limited as a matter of law.

Interpretation; Governing Law; Jurisdiction


Interpretation. In the case of any dispute about the interpretation of the Rules, HUPs decision as to the interpretation shall be final, and Entrant shall be bound by HUPs decision. Governing Law. The interpretation and enforcement of these Official Rules will be governed by the laws of the Commonwealth of Massachusetts, USA, except to the extent required to be governed by the local law in the place of residence of an Entrant. The Contest is subject to all applicable, as the case may be, national, federal, provincial, state, and local laws. The Entrant and HUP agree to the extent permitted by law to submit all disputes arising out of or relating to these Official Rules or the Contest to, and hereby waive any objection to the exclusive jurisdiction and venue of, the state and federal courts located in Suffolk County, Massachusetts. Any provision of these Official Rules which is found to be invalid by a court of competent jurisdiction shall be deemed to be struck out from these Official Rules.
