SHORT TERM Rental Agreement (Online)

*Payments must be made payable to Telluride Luxury Rentals and Real Estate, Inc. on or before due date. Please review Cancellation policy in item 13 This Short Term Rental Agreement, dated as of the date set forth above, is made by and between the Landlord, See Online Booking Confirmation, and the Tenant, See Online Booking Confirmation, (collectively the Parties). The Parties hereto agree as follows: 1. TENANT shall pay LANDLORD all rental charges, the First Payment and the Final Payment, and the Security/Damage Deposit on the dates and in the amounts listed above. Tenants payments shall be made payable via credit card entered during online reservation process or to: Telluride Luxury Rentals and Real Estate, Inc. 2. LANDLORD agrees to rent the Rental Premises to TENANT for the days listed above. LANDLORD shall prepare the Rental Premises for occupancy and shall maintain the Rental Premises in good order and repair for the full term of the stay under this Short Term Rental Agreement. 3. TENANT shall vacate the premises peaceably and quietly by the Date and Check-Out Time listed above. TENANT is responsible for any and all damage to the Rental Premises, including damage to any furniture or personal property contained therein and excessive filth, that is caused by TENANT and/or his/ her guests or invitees. Damage shall not include normal wear and tear. TENANT will be assessed all cleaning and repair costs that are in excess of normal wear and tear. Such costs shall first be deducted from TENANTS Security/Damage Deposit (if applicable). 4. No animals, birds, or pets of any description shall be kept on the Rental Premises without being described below and approved by the LANDLORD. For this Rental, TENANT desires to have the following animal(s) on the Rental Premises: (List all animals you desire to harbor separately by: species; breed; weight; and age) NO PETS ALLOWED.

5. TENANT is entitled to the quiet enjoyment of the Rental Premises. During TENANTS occupancy of the Rental Premises, TENANT and his/her guests or invitees SHALL NOT: (1) violate any law, ordinance, rule, or regulation -- including laws prohibiting the use, possession or sale of illegal drugs; (2) commit waste (severe property damage); or (3) create a nuisance by annoying, disturbing, or interfering with the quiet enjoyment or peace and quiet of those occupying any other nearby residences. 6. TENANT agrees to allow LANDLORD or LANDLORDS representative to enter the Rental Premises for inspection and repairs in the event of an emergency that threatens to damage the Rental Premises. 7. The Rental Premises is a NON-SMOKING unit. TENANT shall be assessed a $500.00 cleaning charge if it appears that TENANT failed to prevent smoking in the Rental Premises during the term of the rental. 8. LANDLORD is not responsible for any of TENANTS personal property or effects. Any and all personal property or effects kept in or on the Rental Premises are there at the sole risk of TENANT. 9. Should the Rental Premises be destroyed by fire or any other causality to the extent that it becomes unfit for habitation, this Short Term Rental Agreement shall become null and void and all deposits and unused rents hereunder shall be refunded to TENANT. In addition, TENANT shall have no claim or recourse against LANDLORD or any of LANDLORDS respective agents or affiliates, for any claim, damage, or loss unless such claim, damage, or loss was caused by LANDLORDS gross negligence or intentional acts. LANDLORD and LANDLORDS respective agents and affiliates are not responsible for any claim, damage, or loss caused by, for example, but not limited to: flooding; severe weather; civil unrest; criminal acts of third parties; acts of God; or construction of any type in, on, or around the Rental Premises. 10. TENANT agrees to defend, indemnify and hold LANDLORD and each of LANDLORDS agents, employees, independent contractors, and affiliates harmless from any and all claims, losses and damages whatsoever arising from, caused by, related to the use of the Rental Premises, including but not limited to any claim, loss or damage for personal injury or damage or loss of property which is caused, occasioned or made by TENANT or any guest, family member, or invitee of the TENANT. 11. LANDLORD and TENANT affirm that TLR is not a party to this Short Term Rental Agreement. Any and all claims arising from an alleged breach of this Short Term Rental Agreement must be asserted against only the LANDLORD or TENANT, as appropriate. 12. All long distance telephone calls and charges that are incurred during the term of the rental shall be assessed to the TENANT and deducted first from TENANTS Security Deposit (if applicable). 13. If TENANT cancels his/her stay under this Agreement more than Sixty (60) days prior to the first day of the scheduled stay, then TENANT shall receive his/her entire Security Deposit along with Ninety Percent (90%) of the gross rental charges already paid. In such event, TLR shall receive Ten Percent (10%) of the gross rental charges. If TENANT cancels his/her stay under this Agreement Sixty (60) days or less before the first day of the scheduled stay, then TENANT shall only receive his/her entire Security Deposit. In such event, should TLR/LANDLORD rent the Rental Premises for the duration of the same time-period, then TENANT shall receive Eighty Percent (80%) of the remaining gross rental charges and TLR shall receive the Twenty Percent (20%) of the remaining gross rental charges. LANDLORD shall return all amounts owed to TENANT within Thirty (30) days. 14. TENANT is responsible for all keys issued to TENANT. A fee of $75.00 per each unreturned key shall be assessed to TENANT and deducted first from TENANTS Security Deposit (if applicable).

15. For all rental properties that include enclosed parking, a garage door opener will be provided. A fee of $175.00 shall be assessed to the TENANT and deducted first from TENANTS Security Deposit (if applicable) for each unreturned garage door opener. ADDITIONAL PROVISIONS: A $45.00 Security Deposit Protection plan has been offered and is included in all reservations. This Security Deposit Protection/Liability plan covers unintentional damages to the rental unit interior that occur during your stay, provided they are disclosed to management prior to check-out. The policy will pay a maximum benefit of $3000.00. Any damages that exceed $3000.00will be charged to the credit card on file. If, during your stay at one of our Rental Properties, an Insured Person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $3000.00. Certain terms and conditions apply. Full details of the Security Deposit Protection coverage are contained in the Certificate of Insurance or Insurance Policy. The Security Deposit Protection can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request CSA Travel Protection and Insurance Services to pay directly Telluride Luxury Rentals & Real Estate, Inc any amount payable under the terms and conditions of the Security Deposit Protection. Please contact Telluride Luxury Rentals & Real Estate Inc. directly if you do not wish to participate in this plan or assignment.
