This category includes for example, summarised information, educational support documentation and translated materials. This group of products, be they part of BMP Portfolio or other third party products, will re-use Core Crown copyright material and may use related trade marks. All derived products within the BMP portfolio reuse both copyright and trade marks. Complementary material: This material is focused on expanding the concepts within the core material to address specific areas which the core material does not cover. This category overlaps with derived materials, though includes products of a broader nature than derivatives such as case studies. Products that are broader than the derivatives mentioned above, typically, re-use only limited amounts of Core Crown copyright material. 6. What is the Wider Complementary Portfolio? As we are interested in encouraging innovation within the community, we have developed the concept of the wider complementary portfolio (WCP). The WCP sits around the BMP portfolio to include products not produced through the contractual arrangements with the Official Publisher or Official Accreditor. The wider portfolio has three recognised levels of product, some of which go through a review to confirm their alignment with the BMP material. These levels are: i those which are quality reviewed and have licensed use of the trade marks and associated re-use of Crown copyright material. These may also be able to carry an endorsement mark from APMG on behalf of the Cabinet Office. Products which are licensed are listed on the brand websites in accordance with the conditions of the individual licensing schemes. 7. Who can use the Best Management Practice (BMP) portfolio? BMP products are made available through global networks of resellers and training organisations and so available to all. They are used and embedded by many UK public sector organisations. They are also adopted by a wide range of organisations around the world, from both the commercial and voluntary sectors. 8. What restrictions apply to publishing activities of the Official Publisher? The Official Publisher (TSO) is required to publish agreed products within the Best Management Practice (BMP) portfolio in accordance with the services laid out within the contract. TSO is able to publish materials outside of the BMP portfolio. In that case they must apply to the Cabinet Office licensing schemes and will follow the same licensing processes as all other third party publishers. When TSO produce products outside of the BMP portfolio they cannot use the associated house style and must clearly differentiate those products from the BMP portfolio and their Official Publisher role in terms of design and marketing messages. 9. Are any of the Best Management Practice (BMP) products available in translation? Yes - The BMP Translations Library includes a large range of BMP portfolio publications in translation. Titles from the ITIL, PRINCE2 and M_o_R portfolios are available in a variety of European and International languages. BMP portfolio publications are available in a number of formats to ensure that all our user needs and demands are met. Formats include: Print, CD-ROM, eBooks, online subscription, and downloadable PDFs. Multi-user licences are also available to maximise access throughout your organisation. 11. Who can use the logos? The logos can only be used by the Cabinet Office and its contractors (TSO as Official Publisher and APMG as Official Accreditor) and by licensed parties for specific activities. These parties include; Examination Institutes (EI's),
Accredited Training Organisations (ATO's), Licensed Software Assessors (LSA's), and those organizations with Licensed Products or endorsed software tools. The logos provided to these parties are specific to their licensed activity or product. No other organization is able to use the Swirl logo or marks incorporating it without permission. EI's and ATO's are granted a licence to reproduce Crown copyright material and use the trade marks for specific activities. Individuals and organizations are also able to use Crown copyright but must apply for a licence in order to do so. Licences can be obtained from APM Group or the Cabinet Office depending on the requirements of the applicant. The endorsement marks denote a quality product or service that has met the Cabinet Office endorsement criteria. We have introduced this scheme to encourage the development of innovative, high quality products by third parties. This provides customers and users with a wide choice of easily identified, quality products. For suppliers of products and services that support the BMP Portfolio, a simple route to achieving this quality mark has been created. 13. How do I obtain a licence to use BMP's trade marks? APM Group has been granted delegated authority on behalf of the Cabinet Office, Best Management Practice (BMP) to issue sub-licences for the re-use of BMP trade marks (including PRINCE2, MSP, M_o_R, ITIL, P3O, P3M3). APM Group can also offer joint trade mark and Crown copyright licences providing a one stop shop for those wishing to use both trade marks and Crown copyright material. Applicants who wish to reproduce Crown copyright content from any of BMP's publications without requiring a sub-licence for the re-use of a trade mark should apply to the Cabinet Office for a Value-Added Licence. Please note: There are different routes for obtaining a sub-licence, depending on your requirements. Reducing the number of poor quality, unauthorised products remains a priority for the Cabinet Office and its partners. The Best Management Practice (BMP) portfolio products are protected by Crown copyright and Trade Mark regulations, and as such require licences for their re-use. The licence application process provides an opportunity to monitor and control the quality of these products. 16. Do we monitor infringements? Yes. The Cabinet Office, as part of the UK Government, has an obligation to manage, administer and protect its assets. This includes intellectual property whether trade marks or copyright. Best Management Practice, with its partners, TSO and APM Group invest time and resources into creating its products and our intellectual property rights (IPR) protection team will pursue any infringements to the IPR to protect the Cabinet Office's reputation, integrity and products. We proactively monitor websites, attend conferences and trade fairs and listen to the accredited organisations to maintain awareness of offerings in the marketplace. Where appropriate we take action to remove infringing materials. Information concerning potential infringements is welcome and details should be forwarded to ogcinfringements@tso.co.uk so that they can be investigated.
