15difference in education in multiple ways without becoming directly 16involved in the governance and operation of the Duval County Public 17School system, there is hereby established an Education Commissioner 18within the Executive Office of the Mayor.
The Education Commissioner

19shall be appointed by and shall serve at the pleasure of the Mayor, 20with such appointment being made on the basis of demonstrated ability 21in education, integrity, leadership, and related qualifications. 22Education 23functions: 24
(a) Work with The School Board of Duval County, Florida, the Commissioner is authorized to engage in the The

25Superintendent of Schools, for the benefit of the Duval County Public 26School system to help advance to state of public schools in Duval 27County; 28
(b) Advocate for education in Duval County with such advocacy

29spanning Pre-Kindergarten through adult education; 30 1


(c) Engage the community in all facets of education;

Partner

with

community

groups,

nonprofit

organizations,

2interested citizens and businesses to implement initiatives that will 3advance education in Duval County; and 4
(e) Take all other actions consistent with the mission of

5engaging the Mayors office in the critical task of advancing the 6state of public schools in Duval County. 7
Section 4. Creating Chapter 22 (Military Affairs, Veterans And

8Disabled Services Department), Ordinance Code. 9


A new Chapter 22 (Military Affairs, and Veterans and Disabled

10Services Department), Ordinance Code, is hereby created to read as 11follows: 12 13 14


Sec. 22.101. CHAPTER 22 MILITARY AFFAIRS, VETERANS AND DISABLED SERVICES DEPARTMENT Military Affairs, Veterans and Disabled Services

15Department Established. 16
The Military Affairs, Veterans and Disabled Services Department

17is created and shall be responsible for: 18


(a) Military affairs and veterans services. Performing

19services related to military affairs and veterans for the City of 20Jacksonville.
While each function has distinct responsibilities,

21combining the oversight under one Department is designed to help 22Jacksonville achieve its goal to become the finest host city for the 23military in the nation. 24
This Department will work closely with the leadership of the

25Department of Defense facilities in Northeast Florida to enhance the 26partnership which exists between the citizens of Jacksonville and 27those persons serving in the armed forces. This Department will also 28encourage and support the expansion and growth of military missions 29conducted from local military bases; sponsor events which recognize 30and dignify the patriotic service of those in uniform; serve as a 1

1liaison to civic groups working to support military members; serve as 2the City representative on Chamber of Commerce task forces involved in 3military
matters; work closely with federal and state elected

4officials on issues involving the military community; and seek federal 5and state grants which improve the infrastructure surrounding the 6military bases. 7
The Department will also have the responsibility to provide

8uncompromised service to veterans and their dependents. Veterans in 9Jacksonville will receive timely and competent assistance in filing 10appropriate
claims, receiving social services, and applying for

11vocational training and employment opportunities. The Department will 12work closely with veterans organizations created to support the needs 13of those who have served in the armed forces, promote the general 14welfare of these veterans, and apprise the community of their needs 15and
talents. The Department will conduct public ceremonies which

16highlight the dedicated service, courage and commitment of veterans, 17and


seek federal and state grants which fund additional social

18services for veterans in Jacksonville. 19


(b) Disabled services. This function shall also be responsible

20for increasing community awareness concerning the accomplishments and 21needs of person(s) with a disability or disabilities, monitoring all 22federal and state legislation that relates to disability rights and 23issues and advising the Mayor and his or her staff about necessary 24City compliance. The Department will suggest and implement ordinances 25that
favorably impact one's equal access and opportunity while

26changing any City policies that may adversely impact the same. 27 28
Sec. 22.102. Office of the Director. The Director of the Military Affairs, Veterans and Disabled

29Services Department is the head of the Department, and shall be also 30known 1
as the Military Affairs, Veterans, and Disabled Services

1Commissioner. The Director shall be appointed by the Mayor, subject 2to confirmation by the Council, and shall serve at the pleasure of the 3Mayor. The Director shall have a bachelors degree or higher from an 4accredited college or university and have at least five years of 5administrative 6responsibility. 7

CHAPTER 23 CENTRAL OPERATIONS INTRA-GOVERNMENTAL SERVICES DEPARTMENT. PART 1. GENERAL. Sec. 23.101. Establishment; functions; Director. There is created an executive department to be known as the Operations Intra-Governmental Services Department. The

11Director of Central Operations Intra-Governmental Services is the head 12of the Department and shall have a bachelors degree or higher from an 13accredited college or university and at least five years of experience 14in
an administrative or executive position with a business,

15corporation, or governmental body or have a law degree or other 16commensurate training and experience. The Director shall be appointed 17by the Mayor, subject to confirmation by the Council, and shall serve 18at the pleasure of the Mayor. The Department is created and shall be 19responsible for the provision of resources and services essential for 20the
overall management of Consolidated Government operations

21associated with: (i) general administrative and clerical support; (ii) 22soliciting, evaluating, procuring, and other functions related to the 23acquisition of supplies, contractual services, professional services, 24capital improvements, and other commodities necessary for the proper 25functioning
of government; (iii) provision of all information

26technologies functions and services; (iv) motor vehicle and related 27equipment 28relations,
management; and (iv) providing public information, personnel public hiring,

managing

related

functions;

(v)

29management, benefits, and related human resource functions; and (vi)

1and (v) such other functions and services as may be assigned by the 2Mayor or his designee. 3
Sec. 23.102 Deputy Director Established; Qualifications and

4Duties of Deputy Director. 5


There is hereby created a position known as the Deputy Director

6of the Central Operations Department. The Deputy Director of the 7Central Operations Department shall have a bachelors degree or higher 8from an accredited college or university and at least five years of 9experience in an administrative or executive position.
The Deputy

10Director shall be appointed by the Mayor, subject to confirmation by 11the Council, and shall serve at the pleasure of the Mayor, performing 12those duties and responsibilities as may be assigned by the Mayor, the 13Director of the Central Operations Department, or their respective 14designees, in connection with the operation and control of all central 15or
internal services necessary for the proper functioning of

(c) the technology component of all personnel access systems

29efficiency in and effectiveness of the flow of information and data 30required for the management and operation of all agencies of the City; 1

Powers; functions and duties of Director.

12recreations centers, and waterfront facilities (including the marina 13at Metropolitan Park), but excluding the Convention Center, Veterans 14Memorial

15Metropolitan Park, the area formerly known as Kids Kampus, Times 16Union Performing Arts Center, Equestrian Center, senior centers, and 17any other facility or venue specifically assigned to the Economic 18Development
Board. The Director, or designee, and may execute

19agreements with sponsors, promoters, exhibitors, performers and other 20persons for the use of the facility, including agreements with renters 21of the facility to staff and maintain restroom facilities at the 22facility through contractual services, volunteers or through a nominal 23gratuity system approved by the Director. 24
(b) The Director, or designee, shall participate in and make

25recommendations to the Mayor and the Council concerning the planning, 26financing and scheduling of city sponsored events at the facilities. 27
(c) The Director, or designee, shall solicit and generate bids

28for the direct marketing for city sponsored events to be held at the 29facilities.

Sec. 28.1046. Parks Advisory Board. (a) There is created a Parks, Recreation, Entertainment, and Advisory Board, which shall function in an advisory

17capacity to the Department in order to stimulate and promote vision, 18leadership, and public/private cooperation required to become one of 19the best park systems in the nation. The Mayor shall appoint four of 20the members and the Council President shall appoint three of the 21members. The members shall serve without compensation, pension or 22retirement
benefits; however, they may be compensated for travel

23expenses as provided in Chapter 106, Part 7, Ordinance Code. The 24Advisory Board shall meet at least once each calendar quarter. The 25Advisory Board shall advise and make recommendations to the Director 26regarding the following: 27 28 29 30 1
(1) Recommendations in the Parks Task Force Report dated

March 22, 2005; (2) Stimulating, advocating, and promoting adequate park

and preserve funding;

Development of public/private partnerships to benefit

parks, preserves, entertainment, and recreation; (4) Development of legislative and executive action to the

Director that will effectuate the purposes of this chapter; and (5) Such other functions as assigned to the Advisory Board

by the Director from time to time. In addition to the foregoing, the Advisory Board shall mediate

8conflicts among organizations using the Department's facilities, its 9members, and the Department. 10
(b) The membership of the Board is established at seven members

11who shall be residents of the City of Jacksonville. There shall be six 12members chosen from the City's six Planning Districts. For purposes of 13this Section, Planning Districts 1 and 2 together with the Beaches, 14Planning Districts 3 and 4, and Planning Districts 5 and 6 shall each 15respectively comprise a "Joint Planning District," and two members 16shall be chosen from each of the Joint Planning Districts. One member 17shall be chosen at-large. Four of these members (including the at18large appointment) shall be appointed by the Mayor and confirmed by 19Council, and each such member must be from a different Joint Planning 20District, except the Mayor may choose the at-large member from any 21Joint Planning District. Three of these members shall be appointed by 22the Council, and each such member must be from a different Joint 23Planning District. The Mayor shall appoint a chairman who shall serve 24a one-year term, provided, however, that the chairman may be re25appointed as such for an additional consecutive one-year term. Each 26member of the Board shall serve a term of three years or until a 27successor is appointed; provided, however the initial terms shall be 28staggered. Of the members first appointed, three members shall serve 29terms of three years each, three members shall serve terms of two of 30the members first appointed, three members appointed by the Mayor 1

or shall have ten years professional and administrative

29experience in a managerial capacity, at least five of which shall be 30in an urban planning or a related field or shall have ten years 1

Furthermore, the Department shall provide coordination,

4expertise and assistance in the furtherance of economic development 5within the City, and the Director shall directly report to the JEDC 6Executive Director (a/k/a the Economic Development Commissioner for 7the Economic Development Board). 8

21relations, training and development, compensation and benefits for the 22Consolidated
Government and all independent agencies, except when

23otherwise provided by law.

The functions of the Department shall

the personnel rules and regulations by undertaking and The

27performing the management duties required to carry them out.

Sec. 33.102. Director of Employee Services.

The Director of Employee Services is the head of the Employee

2Services Department. The Director shall be appointed by the Mayor, 3subject


to confirmation by the Council, and shall serve at the

4pleasure of the Mayor. The Director shall have a bachelors degree or 5higher from an accredited college or university and at least five 6years
of full-time experience in human resources management. The

7Director shall manage the various functions of the Department outlined 8herein, and perform such other duties and responsibilities as may be 9assigned by the Mayor.
The Director, or his or her designee, shall

10also execute and deliver Agreements for Volunteer Workers according 11to the criteria set forth in s. 33.103, Ordinance Code, below. 12
Sec. 33.103. Agreements for Volunteer Workers Authorized. The

13Employee Services Department is authorized to enter into, and the 14Director of the Employee Services Department, or his or her designee, 15is authorized to execute and deliver, on behalf of the City, a 16volunteer services agreement between the City and a public or private 17agency (Agency) desiring to provide volunteer workers to the City, 18provided that the volunteer services agreement has been reviewed and 19approved by the Office of General Counsel, and provided further that 20the terms and conditions of such volunteer services agreement provide, 21at a minimum, that: 22
(a) the term of the agreement shall be of no more than one (1)

23years duration; 24
(b) the volunteer worker supplied by the Agency is not

25presently employed by the City; 26


(c) to the extent compensation to the volunteer worker is

27contemplated from sources other than the City, such compensation will 28be paid by the Agency, and the City will have no obligation to provide 29compensation of any kind to the volunteer worker, with the exception 30of workers compensation insurance coverage; 1

(d)

the volunteer worker shall be under the supervision and of the City, which shall direct the day-to-day work

2control

3assignments of the volunteer worker and the means by which such work 4assignments shall be accomplished; 5
(e) the volunteer worker may not perform work for the City for

6more than eight (8) hours a day or 40 hours a week; 7


(f) the volunteer worker shall be subject to the Citys

8Volunteer Background Screening procedure; 9


(g) the City may terminate the agreement and dismiss the

10volunteer worker at any time with or without cause; 11


(h) the Agency will agree to hold harmless, indemnify its all and

12defend

the

City,

including, and

without

limitation, from and any

officers, claims, including

13representatives, 14demands,

agents

employees, damages

and

actions,

losses,

liabilities,

15reasonable attorneys fees, arising directly or indirectly out of any 16negligent acts or omissions of the volunteer worker performed in 17connection
with the agreement, and to have in effect insurance

18coverage which adequately underwrites this promise of indemnity and 19which names the City as an additional insured; 20
(i) the Citys remedies against the Agency or volunteer worker

21for damages, and the form of action, are not limited, except as 22otherwise provided by law; 23
(j) the City is not required to indemnify or limit the

24liability of the Agency or volunteer worker, except as otherwise 25required by law; 26


(k) the agreement will be governed by and construed in

27accordance with the laws of the State of Florida and venue for 28litigation
of the agreement shall be in courts of competent

29jurisdiction in Jacksonville, Duval County, Florida;

(l)

the Agency shall not discriminate against any person on the

2basis of race, creed, color, sex, religion, national origin, age, 3marital
status or disability in its selection and provision of

4volunteer workers; and 5


(m) the Agency shall at all times comply with laws, ordinances,

6requirements, orders, directions, rules or regulations of any federal, 7state or local governmental authority. 8
(n) All agreements with outside Agencies as described in

9subsection (a) shall be approved by the Director of the Employee 10Services Department; however, nothing contained herein shall prohibit 11a director of a department of the City from otherwise accepting 12volunteer services from individuals upon the approval of the Office of 13Volunteer Services (or any successor function within the Department). 14 15
Sec. PART 2. 33.201. TALENT MANAGMENT DIVISION Management Division; establishment;

There is created a Talent Management Division. The functions of

18the Division shall include, but not be limited to, the following: 19
(a) Establish and maintain a roster of all employees of all

20offices, departments, and boards of the Consolidated Government, which 21shall reflect such data and information as may be deemed necessary by 22the Mayor regarding personnel organization and management and as may 23be required by the personnel rules and regulations. 24
(b) Prepare and maintain an up-to-date record of the authority,

25duties and responsibilities of each position, including those in the 26classified civil service as well as exempt and unclassified positions. 27
(c) Develop, development manage, and deliver, and and evaluate develop or programs contract for for

28employee

training,

29retraining facilities and programs for employees affected by changes 30in their employment resulting from merger or elimination of units of 1

1the Consolidated Government. 2


(d) Develop and implement strategic human resources consulting

3services and support to departments and agencies of the government, to 4include recruitment and selection tools, job evaluation and pricing, 5and work force planning. 6
(e) Develop and prepare job specifications for the various

7classes of positions in the classified civil service and for positions 8not under civil service. 9
(f) Conduct examinations as required by the civil service and

10personnel rules and regulations to determine qualifications for jobs 11covered by the civil service, and freely advertise job placement 12opportunities and requirements in connection with the administration 13of examinations. 14
(g) Establish a listing of eligible persons as a result of

15examinations, and certify to the appropriate appointing authority the 16names


of the persons qualified by examination for employment or

17promotion. 18 19
Sec. 33.202. Division Chief. The Chief of Talent Management is the division chief of the

20Talent Management Division. The Chief shall be appointed by the Mayor, 21subject
to confirmation by the Council, and shall serve at the

22pleasure of the Mayor. The Chief shall have a bachelors degree from 23an accredited institution, proven administrative ability, and at least 24five
years of experience in the field of employee recruiting,

25training, and employee services management. 26 27


PART 3. COMPENSATION AND BENEFITS DIVISION Sec. 33.301. Compensation and Benefits Division; establishment;

There is created a Compensation and Benefits Division. The

30functions of the Division shall include, but not be limited to, the 1

(a) Develop and manage programs of job analyses, salary and employee benefit analyses and general research in

analyses,

4relation to personnel management; adopt, alter, amend or modify a job 5classification plan; and adopt a job pay plan which shall, among other 6things, include a plan for vacation time, sick leave time, overtime 7compensation, service raises and military leave for non-represented 8employees
and employment, and administer collective bargaining

9agreements covering represented employees. The job pay plan adopted by 10the Employee Services Department shall be uniform within any job 11classification. 12
(b) Developing and delivering programs and services to support including insurance healthcare, benefit life, deferred compensation, of and

13employees, 14cafeteria

plans,

the

processing

personnel

15transactions, records maintenance, career counseling, and the Employee 16Assistance Program. 17 18Chief

(d) Perform strategic and functional leadership of labor

30relations and employee relations activities, including but not limited 1

(e) Administer employee relations functions to assist in

3resolving conflicts among personnel; 4


(f) Participate in grievance matters at the departmental level

5and above by providing advice and assistance to department directors 6in resolving of such grievances; and 7
(g) Perform investigations into allegations made about employee

8or management misbehavior and provide advice on appropriate discipline 9or other remedial actions. 10 11 12the

(a) Housing services, including but not limited to: (1) Affordable Housing Coordinator. The Affordable Housing

Coordinator shall have a bachelors degree and at least five years experience in housing development. The Affordable Housing Coordinator shall: i. Serve as a central resource of information

regarding all processes required to bring an affordable or workforce housing development to completion; and ii. Proactively assist developers of affordable and

workforce housing developments with the different processes required to bring an affordable or workforce housing

development to completion; and iii. Communicate with other City Departments to ensure that affordable and workforce housing developments are not delayed within processes managed by other City Departments;

and iv. Where appropriate, act as a liaison between

developers of affordable and workforce housing developments and all permitting agencies to expedite the permitting

processes; and v. Provide other necessary support to ensure that

It is the intent of Council that the funding and utilization

8of these program funds should be consistent with past practices and 9subject to applicable law. 10

Sec. 35.702. Chief of the Housing and Community Development

(a) There is hereby established a Commission to be known as the

28 Jacksonville Housing and Community Development Commission, which 29 shall be comprised of 11 members, all of whom shall be residents of 30 Duval County. It is hereby determined that all persons serving on the 1

date of this chapter have continued in their offices

3 notwithstanding this ordinance code transfer.

Six members shall be

4 appointed by the Mayor and confirmed by Council, and five members 5 shall be appointed by the Council. Pursuant to the requirements of 6 section 420.9076, Florida Statutes (as amended from time to time) the 7 Commission shall be deemed the advisory committee as required by 8 state law.
The Commission membership shall consist of the following

9 persons (each of whom is actively engaged in her/her respective 10 activity): (1) residential home building industry in connection with 11 affordable 12 connection
housing; with (2) banking or mortgage (3) banking of industry in in

affordable

housing;

areas

labor

home

13 building in connection with affordable housing; (4) advocacy for low14 income persons in connection with affordable housing; (5) for-profit 15 provider
of affordable housing; (6) not-for-profit provider of

16 affordable housing; and (7) real estate professional in connection 17 with


affordable housing. With respect to the foregoing specific

18 requirement in any of the above seven activities of an affordable 19 housing connection, if a finding is made regarding the presence of a 20 conflict of interest or other reasonable factor that would result in 21 an appointment not otherwise being made, then a member may nonetheless 22 be appointed in that activity without the specific requirement of the 23 affordable housing connection. The Commission shall also consist of 24 the following additional persons: (1) a representative also actively 25 serving on the local planning agency pursuant to section 163.3174, 26 Florida Statute, and if the local planning agency is comprised of the 27 governing board of the municipality, then the appointment of a person 28 knowledgeable in the local planning process; (2) a representative of 29 employers in Duval County; and (3) a representative of essential 30 services personnel (as defined in the Local Housing Assistance Plan as 1

1 adopted from time to time).

The Mayor shall appoint the Chairman from the

14 eleven member board, for a term of two years of the Commission, and 15 the Commission members shall elect the remaining officers. 16
(b) A quorum for the Commission shall consist of a simple

17majority of appointed members. 18


(c) The Chairman may create such committees as he deems

19necessary. 20
(d) The Commission, acting as the advisory committee, shall

21conduct any required public hearings, undertake the review, take any 22and all required actions for compliance, and make recommendations to 23the Council for adoption (and authorize the transmittal) as required 24by section 420.9076, Florida Statutes. 25
(e) The Commission shall conduct any required public hearings, the review, take any and all required actions for

26undertake

27compliance, and recommend to the Council for adoption (and authorize 28the transmittal) a Consolidated Plan as required by 24 CFR Part 91. 29
Sec. 35.704. Jacksonville Housing Finance Authority.

The Council finds, pursuant to F.S. 159.604, that there is a

2need for a housing finance authority, as there is a need to alleviate 3a shortage of housing and capital investment for the people of Duval 4County. Accordingly, there is hereby created within the Housing and 5Community Development Division a separate board to be known as the 6Jacksonville Housing Finance Authority ("JHFA"). The JHFA shall ensure 7compliance with F.S. 159.601, et seq. The JHFA shall be comprised of 8five board members, three of whom shall be members appointed by the 9Mayor and confirmed by Council, and two of whom shall be appointed by 10Council. It is hereby determined that all persons serving on the 11Jacksonville Housing Financing Authority prior to the effective date 12of this chapter have continued in their offices notwithstanding this 13ordinance code transfer. Each member shall serve a term of four years; 14provided, however that to provide for staggered terms, of the members 15first appointed, two (2) members shall serve terms of four (4) years 16each, two (2) members shall serve terms of three (3) years each, and 17one (1) member shall serve a term of two (2) years. Thereafter, all 18members appointed to the Commission shall serve terms of four (4) 19years. Commencing with the effective date of this chapter, no member 20may serve for more than two consecutive terms, and members shall serve 21for the term of their respective offices until they are reappointed 22and confirmed, or until their qualified successors have been appointed 23and confirmed, or such member resigns, whichever occurs first.
It is

24the intent that the existence of the JHFA as a legal entity continues 25without lapse, termination or interruption as the JHFA existed prior 26to the enactment of this chapter. A quorum for the JHFA shall consist 27of three members present. The Mayor shall appoint the Chairman of the 28JHFA from the five member board, for a term of two years, and the JHFA 29members shall elect the remaining officers. The Mayor is authorized to 30take all necessary actions in structuring this five-member board to 1

1ensure compliance with state law. At least three of the five members 2shall represent one of the following organizations: labor, finance or 3commerce. 4 5
Sec. 35.705. Scope of Authority. Among its powers, the Housing and Community Development Division

6shall operate with all the powers and authority of a housing finance 7authority under F.S. Ch. 159, Pt. VI; provided that to the extent 8necessary as a matter of law, the Housing and Community Development 9Division shall operate in conjunction with the Jacksonville Housing 10Finance Authority, which shall have those rights and duties necessary 11under F.S. Ch. 159, Pt. IV, to preserve outstanding debt, issue new 12debt and to shield the City from financial liability and is authorized 13to function throughout all of the territorial limits of the City. 14 15
Sec. 35.706. Execution of instruments. Except as may otherwise be specifically set forth in section

with the interest thereon, to assist in defraying the

25operational, publication and production costs and expenses of Housing 26and Neighborhoods Department, Public Information function Division27sponsored
publications and productions as such publications and

The purpose of the appropriation in Section 46 above is provide the transfer of funds and budgets resulting from the

19reorganization set forth in this ordinance. 20 21


Section 48. If any part, Severability. section, subsection or other portion of this

22ordinance or any application thereof to any person or circumstances is 23declared to be void, unconstitutional or invalid for any reason, such 24part,
section, subsection or other portion, or the proscribed

25application thereof, shall be severable and the remaining provisions 26of


this ordinance and all applications thereof not having been

27declared void, unconstitutional or invalid shall remain in full force 28and effect.
The Council declares that no invalid or proscribed

29provision of application was an inducement to the enactment of this 30ordinance and that it would have enacted this ordinance regardless of 1

1the invalid or proscribed provision or application. 2 3


Section 49. Retroactive Effective Date.

Upon approval as set forth in section 50 below, this ordinance

4shall be deemed to be retroactive to October 1, 2011. 5 6


Section 50. Effective Date.

This ordinance shall become effective upon signature by the Mayor
