    EVIDENCE SUPPORTING TENANTS' CLAIMS of Harassment by Tishman Speyer/Rose Associates: Tishman Speyer and Rose Associates Debt Collector Law Firm Borah Goldstein Attorney's Paul Gruber's letter conceding misconduct (although misstates as 'non-verbal' the physically violent slamming of hands and throwing of pen on table) toward female attorney/tenant during oral argument in Appellate Term (NYC) Courtroom before Chief Judge Lowe concerning Stuyvesant Town. When female attorney/tenant was speaking to the Appellate Term at oral argument disclosing the fact the Tishman Speyer, Rose Associates, and CWCapital have willfully concealed from the Housing Court and the Appellate Term that a transfer of Stuyvesant Town pursuant to the Mortgage Agreement had occurred and that Borah Goldstein attorney Paul Gruber even stated on the record that “new entities are running old entities,” Debt Collector law firm Borah Goldstein’s Paul Gruber slammed his hand down on the table and threw a pen in the Appellate Term Courtroom. Chief Judge Lowe reprimanded Tishman Speyer/Rose Associates (and now CWCapital Asset Management)’s attorney Paul Gruber by stating: “I’m about to throw you out of this Courtroom!” The Appellate Term judges got to witness first hand the harassment, abuse, physical intimidation, and illegal practices of Tishman Speyer/Rose Associates, through their Debt Collector Law Firm Borah Goldstein, that tenants at Stuyvesant Town have been subjected to for years during the Tishman Speyer/Rose Associates criminal racketeering scheme. Just 3 weeks prior, Female Attorney/Tenant was also subjected to Tishman Speyer/Rose Associate’s Debt Collector Law Firm Paul Gruber’s obscenity laced tirade in the hallway of the NYC Civil Court when she asked Borah Goldstein why Tishman Speyer hadn’t complied with a subpoena to appear. Borah Goldstein attorney Paul Gruber screamed at her to “F*ck off!” as she was walking away. Attached is Tishman Speyer/Rose Associate’s Debt Collector Law Firm Paul Gruber’s letter of admission (although ‘non-verbal’ clearly misstates the physically violent slamming of his hands and throwing the pen across the table conduct) and ‘apology’ to the Appellate Term for the admitted misconduct. Nowhere in the self-serving ‘apology’ is there any apology to Female Attorney/Tenant, a fellow member of the Bar and the victim of the physical intimidation.

    Honorable Justices: During an argument of an appeal on December 12, 2011, I reacted to what I believed to be a needlessly personalized line of argument by an adversary with non-verbal conduct. This response was inappropriate and below the standard that any attorney should meet. I have practiced before the Appellate Term for twenty five years. I have always held the court, its justices and its non-judicial personnel in the highest esteem. The conduct on December 12 was disrespectful and below any proper standard. I apologize for the disrespectful Thank you for your consideration. conduct.
