AGREEMENT OF SUPPORT

KNOW ALL MEN BY THESE PRESENTS : This Memorandum of Agreement made and entered this _____ day of May 2011 at Quezon City, Metro Manila, Philippines, by and between: FIRST PARTY : Sofia Corazon Castillo, Filipino, married, of legal age, with residence at Blk 22 Lot 13 Acacia Drive, Palmera Woodland, Cupang, Antipolo City, Philippines; - and SECOND PARTY : Tirso G. Castillo, Filipino, married, of legal age, with office address at L2 B21 PUD Site, Escopa 3, Project 4, Quezon City, Metro Manila. WITNESSETH : WHEREAS, both parties married each other on 18
December 1998 in Quezon City.

WHEREAS, the First Party has two (2) legitimate sons with the Second Party. The names of their children are Tristan Troy and Tyrone Theo, born on 25 November 1999 and 02 November 2005, respectively; WHEREAS, the Second Party has rights and obligations under the law with regard to his paternity with said children, especially financial support; NOW THEREFORE, for and in consideration of the foregoing premises, the herein parties have agreed to come into an agreement subject to the following terms and conditions, to wit:

The Second Party give financial and educational support to said children from pre-school up to post-graduate degree, if the latter decides to take up further education after college. In order to provide for the needs of the children, the Second Party shall give at least P25,000 monthly child support to the First Party, who has sole custody of the child, with annual escalation of 10%. If the said amount is insufficient for the needs of the child, the First Party can demand for additional support from the Second Party, subject to justification of the former.

Aside from the foregoing, the Second Party shall also give the amount of P60,000 for the partial tuition fees of both children for the School Year 2011-2012, and the amount of P200,000 for the monthly support in arrears for six (6) months. The P60,000 shall be financed by a mortgage loan secured by the conjugal property located in _________________ while the P200,000 shall be paid in __ monthly instalments commencing on ___________________. 3. Any court action relative to this agreement shall be brought exclusively before the proper court in Quezon City, at the option of the party filing the court action.
