TRANSFER PROCEDURE 1.

The allottee / transferrer desiring to transfer the allotment of his apartment or his share and interest in the Authority shall have to personally appear in the Head Office of PHA before the Director General (PHA Affairs) or any officer authorized on behalf and shall present the documents detailed below:a. A letter/application addressed to the Director General (PHA Affairs) requesting for transfer of allotment of his apartment or his share and interest in the Authority. Three signatures be affixed on the application in front of the authorized officer. (Annexure-A) b. Affidavit on a Rs. 20/- non-judicial stamp paper (Annexure-B) duly attested by the Oath Commissioner/Notary Public/First Class Magistrate affixed with a latest passport size photo graph of the transferrer attested by the same. c. Original allotment i.e. Formal & Provisional Allotment letters / transfer letter for relinquishment and cancellation so that new letter be issued in the name of transferee. The transferrer shall also surrender the original possession certificate, if issued for further handing over to the transferee. d. Photostat copy of National Identity Cards of transferrer, transferee and witnesses duly attested by the Oath Commissioner/First Class Magistrate/Notary Public. e. No Demand Certificate issued by the Authority. f. Undertaking regarding Loan/mortgage of apartment dully attested by Notary Public/First Class Magistrate/ Oath Commissioner (Annexure-C). g. Photostat copy of sale agreement executed between the transferrer and the transferee duly attested by the Oath Commissioner/First Class Magistrate/Notary Public. h. In case of transfer of apartment in the name of more then one owner, a consent letter from all the co-sharers is required to be attached, indicating/mentioning the name and address of the Co-sharer on which the correspondence is to be made (Annexure-D). i. Undertaking by the transferee on Rs. 20. non-judicial stamp paper duly attested by the Oath Commissioner/First Class Magistrate/Notary Public for the timely remittance of the remaining payments (if any) affixed with a latest passport size photo graph of the transferee attested by the same. (Annexure E). j. Transferee will pay Transfer Charges as per (Annexure- F). Note:- Cutting/over-writing in the contents and partially handwritten/ typed documents will not be accepted. 2. Procedure to Obtain No Demand Certificate (NDC) In order to obtain the NDC for the due payments the allottee / owner of the Apartment has to apply personally / through his representative. NDC shall be prepared by the Allottee Services Cell after having endorsed by F&A Section and handed over to the owner at the time of execution of transfer documents. 3. The transfer documents except the documents attested abroad by the Embassy/High Commission shall be submitted in the office of the Authority within 30 days of the execution / signing of the documents. No extension of time for submission of documents will be given. 4. Procedure to Find out Dues and Deposit Dues

a. To ascertain and know about the amount to be paid, such allottee / owner shall make an application in writing personally or through his agent. b. Allottee Services Cell will get the printout from the Computer giving all the dues including the Transfer Charges, if so, required to be paid. This print will be in triplicate. Dues will be deposited preferably in the Authoritys bank and original deposit slip will be produced to PHA or a demand draft of equal amount in favour of PHA drawn on HBL Corporate Branch, Islamabad. 5. Cancellation of Documents a. Documents for transfer of allotment once executed by transferrer and transferee can be cancelled within 30 days of the execution with the mutual written consent of both the parties alongwith revocation of sale agreement on Rs. 20/- stamp paper dully attested by Oath Commissioner/Notary Public. Before the Director General (PHA Affairs) or any authorized officer by providing on affidavit. In case of cancellation of such documents Transfer Charges already deposited will not be refunded or adjusted for another transfer. b. Half of the Transfer Charges will be forfeited in case transferrer requests for the relinquishment of transfer documents within the 3 months validity time period once submitted with the Authority and the case is not yet formally executed before the Director General (PHA Affairs) or any authorized officer as mentioned above. The transferrer is also bound to serve a notice of the same to the transferee with a copy to PHA alongwith revocation of sale agreement on Rs. 20/- stamp paper dully attested by Oath Commissioner/Notary Public. 6. Members Living Abroad. The members living abroad and desiring to transfer the allotment of their apartment may appear before the Officer authorized to attest such documents in the Embassy/ High Commission. The officer attesting the documents will indicate serial number of the documents at which the same are entered in the register maintained in this context. The original copy of the documents shall be sealed in an envelop by the officer attesting these documents and sealed envelop shall be handed over to the person / member executing these documents. A photostat copy of these documents will be forwarded by the Embassy / High Commission directly to the Authority. On presentation of the sealed envelope containing original documents, the Officer appointed by the Authority shall satisfy himself that the seal of the envelope was intact and no tampering of the documents was attempted or caused during the transmission. He shall open the sealed envelope and shall record on the minute sheet of the file that he opened the sealed envelop and the seal was intact. The documents presented in the sealed envelop will be compared with the photostat copy of these documents received directly from the Embassy / High Commission. After satisfaction about the genuineness of the documents executed above, the transfer of allotment will be recommended for approval of the competent authority. 7. Members Suffering from Physical Disability The member desiring to transfer his interest / apartment, if suffering from a disease / physical disability and not allowed by the Doctor to move out, shall make an application to the Director General (PHA Affairs) requesting for the transfer of his interest / apartment alongwith a medical certificate issued by the Doctor (Registered Practitioner). On receipt of such application, Managing Director PHA

may order the execution and completion of documents described above in the manner he deems fit. The expenses for traveling of representative from PHA Office to the residence of member and back shall be borne by the transferrer or transferee or both. 8. The Members under Legal Restraint Any owner / allottee of the apartment desiring to transfer his interest / apartment, if placed under a legal restraint or confined in jail for a long period, may apply to the Director General (PHA Affairs) for transfer of his interest / apartment. On receipt of such an application, the Director General (PHA Affairs) may, if satisfied with the contention, allow the submission and transmission of documents through the Superintendent Jail or the Officer in whose custody the tranferrer happened to be. The concerned officer shall issue a certificate for transmission of transfer documents to this office under his signatures and office seal. The transfer affidavit shall also be attested by the said officer. Serving Civil Servants in Grade 21 or Above and Equivalent Armed Forces Officers Serving Civil Servants in Grade-21 or above and equivalent officers from Armed Forces may also request for exemption from personal appearance to execute transfer documents. A written request in this connection may be extended and the Authority would depute some officers to complete the formalities at the expense of requesting officer/allottee. Receipt of Transfer Letter After approval by PHA, the transfer letter shall be given to the owner himself after obtaining his signature with full particulars upon the office copy of the transfer letter or shall be issued on his given address by mail. Urgent Transfer Cases. Urgent cases will be accepted as per fee mentioned at Annexure-F and will be finalized within ten working days. Kindly note that the Authority will take thirty days to clear the transfer of allotment in ordinary cases. Transfer of ownership to nominee / within Family . Transfer Charges as mentioned at Annexure- F will be charged for all cases of change of ownership to the nominee mentioned in the original application form or to any person within the family. The family includes spouse, legitimate children, step children, parents, real brother and sister. Litigation If PHA has been involved in litigation due to cancellation of transfer deal between the transferrer & transferee by one or the other reason, the transferrer is bound to bear litigation charges incurred by the Authority. 14. Validity/Revalidation/Misplacement i. Transfer procedure form will be valid for a period of 3 months from the date of issuance. ii. In case of misplacement/ non-submission /failure to manage the execution within validity time, revalidation charges equal to difference of normal and urgent transfer charges will be levied as penalty for validation for further three months.
