Warden vs. Walkup, Oral Argument in Pima County Superior Court

On Monday January 23, 2012 at 10 am, community activist Roy Warden will present oral argument in Pima Superior Court, before the Honorable Steven Villarreal, on whether or not the First Amendment trumps former Mayor Bob Walkups Civility Accord. The so-called Civility Accord, is a sham, Warden said. Tucson Officials have employed it to block public scrutiny into local government affairs, and the advancement of officials on the basis of Cronyism, not on their fitness to hold public office. On September 13, 2011 Warden was stopped while addressing the Mayor and Council, arrested, and removed from the Council Chambers when he attempted to read a 2006 federal jury verdict, which found, amongst other things, Tucson City Manager Richard Miranda, while employed in the capacity of Assistant Tucson Police Chief, had lied under oath, falsified official records, intentionally inflicted emotional harm, and otherwise engaged in outrageous conduct intended to harm Dr. Kevin Gilmartin 1, in retaliation for Dr. Gilmartins testimony on behalf of several Tucson Police Officers in a federal lawsuit against the City of Tucson. The 2006 federal Gilmartin Jury found that Richard Miranda had engaged in acts of Conspiracy, First Amendment Retaliation, acted with an evil hand guided by an evil mind, and awarded Plaintiffs Gilmartin and Harris a total of 2.9 million dollars, including 2 million dollars in punitive damages.
Dr. Gilmartin, formerly employed by the Tucson Police Department as a police officer and psychologist, is the author of Continuum of Compromise.

Warden claims that Tucson City Attorney Mike Rankin unlawfully used seven hundred thousand dollars of public funds to pay a portion of Mirandas punitive damages, a use of public money to pay a private obligation expressly prohibited by law. And so Warden went before the Mayor and Council to ask, in sum and substance: You expect us to treat you with civility. But, when a federal jury found Richard Miranda had done these terrible things to members of the public, Gilmartin and Harris, just where do you folks get off in promoting Miranda to higher office and increasing his pay? As a matter of custom and practice, appointed Tucson City Officialsthe hired guns of the elected officials so to speakengage in acts of First Amendment Retaliation, and other public offenses, as so found by the Gilmartin Jury in 2006, Warden says. They unlawfully arrested me to stop my speech and prevent the public from fully comprehending the outrageous and uncivil nature of their conduct. Warden contends that Tucson City Officials rule by law, but do not respect the rule of law, and that elected officialsthe Mayor and Councilhave promoted them and otherwise rewarded them for it. Warden also contends that Tucson City Officials have become masters of propaganda and spin. They have the power, and the guns, and a complacent media to protect their interests in the court of public opinion. Just look how the media has slandered me for speaking out and how they have failed to adequately report what Miranda did to Gilmartin and Harris. But We the People have a Constitution and the First Amendment to protect us when we speak out against government abuse. Now, on January 23, 2012 the spin and the propaganda will end. Come to Pima County Superior Court and see how well Tucson City Officials do in front of a judge in a court of law.
