suspend admission for a period of 10 working days item (u) in the form of: 20 pcs sweaters, the trademark "Tommy Hilfiger", for which there is a suspicion that violates intellectual property rights covered by Decision No 440000-WI-4072-646/11/3012/EW.

JUSTIFICATION On 2011.12.16 officer of the Customs Office in Rybnik, Postal Customs Department in Zabrze, while performing official duties carried out a review of customs goods presented together with the customs declaration 332040/00/023619/2011. As a result of the revision of the Customs said the goods in the form of: 20 pieces - sweaters, the trademark "Tommy Hilfiger". Material goods are in a postal consignment item. Fr. magician. 31467/EE385208302CN, dedicated to the Mr: Radek Labus, ul. Grunwaldzka 10, 57-420 Radkw. Goods are marked with trademarks for Tommy Hilfiger Licensign LLC, 60.1 W. 26th St.. 6th Floor, New York, in relation to which the suspected violation occurred intellectual property rights protected under the decision 440000-WI-4072-646/11/3012/EW. In accordance with Article. Paragraph 9. 1 Council Regulation (EC) No. 1383/2003 of 22 July 2003. concerning customs action against goods suspected of infringing certain intellectual property rights and the measures to be applied to goods which are found to have infringed such rights, where the customs office to which the decision granting the application was transferred by the holder rights under Articles. 8 determines, where appropriate after consultation with the applicant that the goods contained in one of the situations referred to in Article 1 paragraph. 1, are suspected of infringing intellectual property rights covered by the decision, it shall suspend release of the goods or retain the goods and inform the right holder of its action. At the request of the holder of the customs authority disclose information on recipient, sender, the applicant for or holder of the goods and the origin of goods suspected of infringing intellectual property rights. For purposes of analysis and to facilitate the subsequent procedures can also download and send samples to the holder of the goods seized. In accordance with Article. 13 of that Regulation if, within 10 working days of receipt by the holder of the right of suspension of release or of detention, the customs authority is not notified of the initiation of proceedings to determine whether there has been a violation of intellectual property rights under national law or without the consent of the holder of to apply the simplified procedure provided for in Article. Paragraph 11. 1, the goods are released or their detention shall be terminated subject to completion of all customs formalities.

In justified cases, the above 10-day period may be extended by up to 10 working days. Given the above - I decided as in the sentence.

NOTICE At this provision is the right to lodge a complaint to the Director of the Customs Chamber in Katowice, through the Head of the Customs Office in Rybnik, within 7 days of its receipt. Making a claim does not suspend execution of the order. Complaint against a decision of the customs authority shall include the charges against the order, determine the nature and scope of the claims at issue in the complaint and identify evidence to justify this claim (Article 239 in conjunction with. 222 Tax Ordinance).
