October 22, 2010 Fredericton Police Force Complaint.

Fredericton Police Force members involved in this Complaint. 1. Constable D. Beck 2. Constable A. Yerxa 3. Constable C. Haines On October 23, 2009, members of Fredericton Police Force: Constable D. Beck, Constable A. Yerxa and Constable C. Haines, where in attendance at 31 Marshall Street, Fredericton, New Brunswick, at about 11:30 AM. Did participate in a wrongful act Furthermore, that the here within above mentioned Police Officers did participate to varying degrees to unlawfully break and enter the home of residential tenant Andr Murray at 31 Marshall Street. Immediately after Breaking into the 31 Marshall Street address, Andr Murray challenged the conduct of Constable D. Beck, Constable A. Yerxa and Constable C. Haines. Andr Murray announced that he Andr Murray did not consent to Fredericton Police Force members Constable D. Beck, Constable A. Yerxa and Constable C. Haines entering the property. Andr Murray was presented with a Court Order by the attending a Deputy Sheriff, for ordering among other things, that Andr Murray forthwith vacate 29 Marshall Street, Fredericton, New Brunswick. After careful review of the here within above subject Court Orders to vacate 29 Marshall Street, Andr Murray informed all present outside the entrance of civic address 31 Marshall Street, Fredericton, New Brunswick property,(both Police Officers and Deputy Sheriffs) that the doorway they had just forcibly opened was in fact civic address 31 Marshall Street Fredericton, New Brunswick, as is evidenced by the civic address number 31 located immediately beside the door way entrance, not 29 Marshall Street as specified in the Orders furthermore, the number of which is clearly indicated on another door relative to that duplex unit located at the other end of the Marshall Street duplex, in the city of Fredericton. Andr Murray adamantly demonstrated and pointed to the civic address number 31 attached to the building above and to the left of the doorway, in front of which everyone was standing, which clearly indicated the numbers 31 and further Andr Murray

pointed to the civic address number 29 located to the right of the entrance door, of the other duplex civic address 29 Marshall Street property . Andr Murray produced documents, which indicated both 29 and 31 Marshall Street Fredericton, New Brunswick properties as a residential tenancy leases held by Andr Murray and presented the documents for review of all present. Andr Murray did demand identification from all present. Constable D. Beck, Constable A. Yerxa and Constable C. Haines refused to identify themselves, claiming they did not have to identify themselves. Andr Murray again reiterated to Constable D. Beck, Constable A. Yerxa and Constable C. Haines, that he Andr Murray did not give permission or consent to the Fredericton Police Force entering his 31 Marshall Street residence. Andr Murray explained to all present that subject Court Order had no lawful effect on 31 Marshall Street, furthermore, Andr Murray believed he did not have to leave 31 Marshall Street as the Orders do not pertain to 31 Marshall Street and reasonably suggested that both the Deputy Sheriffs and Fredericton Police Officers should take appropriate corrective action by contacting their superiors for further direction on how to correct this mistake. Andr Murray explained that the Residential Tenancy Act of New Brunswick protects residential tenant Andr Murrays rights, as a tenant in good standing and Andr Murray refused to leave. Constable C. Haines and Constable A. Yerxa both stated it doest matter what you Andr Murray say, if you dont leave immediately you will be arrested. Furthermore, Constable C. Haines assaulted Andr Murray, threatened Andr Murray by saying that you dont want to get hurt do you, because people usually get hurt when being arrested, in a obviously threatening manner. The Deputy Sheriffs stated that it doesnt matter what you (Andre Murray) say you are out of here today entered the 31 Marshall Street property. The Fredericton Police Force members Constable D. Beck, Constable A. Yerxa and Constable C. Haines under protest by Andre Murray continued to trespass unto and into the 31 Marshall Street residence, invading the Home of Andr Murray. Constable D. Beck, Constable A. Yerxa and Constable C. Haines did subsequently commence an illegal room to room search procedure of the 31 Marshall street residence. Constable D. Beck, Constable A. Yerxa and Constable C. Haines did subsequently commence an illegal room to room search procedure of the 29 Marshall street residence.

While Andr Murray was being forced under protest and duress from the 31 Marshall Street residence by a Deputy Sheriff, Andr Murray observed Constable A. Yerxa digging through a previously closed drawer, searching the contents, conducting a illegal search and procedure. Andr Murray was ousted from the 31 Marshall Street Residential property, illegally and unlawfully evicted, by actions of the Fredericton Police Department including threats of violence would occur if Andr Murray did not comply with the illegal and unlawful demands. Andr Murray was further threatened the attending Police Officers with charges of Trespass if Andr Murray was seen again at the 31 Marshall Street property, despite there being no Court Order regarding the residential 31 Marshall Street, property.

Constable D. Beck, Constable A. Yerxa and Constable C. Haines did not act to maintain the peace and failed to act in the best interest of Andr Murray as enumerated in the The Canadian Charter of Rights and Freedoms, which guarantees the rights and freedoms set out in it, subject only to such reasonable limits prescribed by law. Constable C. Haines finally did reveal the last names of the Fredericton Police officers in attendance as Haines, Beck and Yerxa, while he was leaving the area, but refused to write the names down for Andr Murrays benefit.
