, of 2158 West 1040 South, Lehi, Utah (Lessor), leases to ____________, of ______________________________________ (address of lessee), _____________ (city), Utah (Lessee), the following property: _________________________________________ (Property). SECTION ONE TERM OF LEASE The term of this lease shall be _____________ hours, commencing on _________________(start time), and terminating on _____________________(end time), unless otherwise terminated as provided in this agreement. Lessee agrees to return the leased Property in good order promptly at the expiration of the rental period. SECTION TWO PAYMENT FOR PROPERTY In consideration for the leasing of the Property, Lessee agrees to pay to Lessor as rent for the Property the total sum of _____________ Dollars (total amount owed) ($_________), payment of which is payable on or before _________________(event date). Lessee agrees to pay Lessor the sum of One Hundred Dollars ($100) as a deposit for the leasing of the Property, which deposit is nonrefundable. Deposit payment shall be deducted from total amount owed for event. Such deposit shall be made at least 14 days in advance from the beginning of this lease to Lessor. If payment for rent or for the deposit is made by check, and the check bounces, Lessee agrees to pay as a penalty to Lessor the sum of $30. SECTION THREE USE AND PRESERVATION OF THE PROPERTY Lessee shall use the Property in a careful and proper manner, shall comply with all applicable laws and regulations, shall comply will all Lessor instructions related to the Property, and shall maintain the Property in good repair and condition. Lessee assumes all risks of loss and damage to the Property from any cause whatsoever and agrees that the Property will be returned to Lessor in the same appearance and condition as when received, ordinary wear and tear excepted. Lessee agrees to keep the Property in Lessees custody and not to sublease or rent the Property. SECTION FOUR TERMINATION OF LEASE BY DEFAULT If Lessee fails to perform any of the conditions or covenants of this lease, or removes or attempts to remove the Property without obtaining the written consent of Lessor, Lessor may terminate this lease and Lessees right to possession of the Property, and immediately take possession of the Property without demand on or notice to Lessee. SECTION FIVE LESSORS RIGHT OF INSPECTION Lessor shall have the right to enter the premises where the Property is located for the purpose of inspecting the Property.


If any party shall seek to enforce or protect its rights under this agreement in any action, suit, arbitration, or other proceeding, including all bankruptcy cases and proceedings, the prevailing party shall be entitled to receive from the other party payment of its costs and expenses, including reasonable attorneys fees incurred (whether such costs or fees are incurred before or after the commencement of the proceeding), including any and all appeals or petitions therefrom.
SECTION SEVEN INDEMNITY AND LIMITATION OF WARRANTIES Lessee shall indemnify and hold Lessor harmless for any losses, claims, damages, awards, penalties, or injuries, including reasonable attorneys fees, which arise from any claim by any third party using the Property. This indemnity shall survive the termination of this agreement. Lessor has not made and does not make any representation, warranty, or covenant, express or implied, with respect to the condition of the Property or the quality of the photographs. Lessor shall not be liable to Lessee for any loss, delay, or damage of any kind caused directly or indirectly by the Property, by any inadequacy or defect, or by any accident in connection with the Property. SECTION EIGHT LESSEES OPTION TO TERMINATE Lessee, if not in default in any obligation under this lease, may terminate this lease with respect to its agreement to lease the Property at any time prior to one (1) week of the beginning of the term of the lease as set forth in Section One above. SECTION NINE REFUNDS No refund for rent paid by Lessee will be provided to Lessee in the event Lessee seeks to terminate the lease within one week of the beginning of the term of the lease. No refunds will be provided by Lessor to Lessee due to weather or other acts of God. Photo Booth pictures are a novelty item and do not replace a professional photographer's services. Picture It Photo Booths is not liable for quality of pictures resulting from how guests choose to pose in photo booth. Deposit is non-refundable. SECTION TEN RELEASE WITH RESPECT TO PICTURES FOR ADVERTISING Lessee agrees to allow Lessor to use any pictures taken and developed in connection with the use of the Property for advertising or other purposes related to the Lessors business.
