URGENT MOTION FOR THE IMMEDIATE DISQUALIFICATION OF THE FOLLOWING SAMASA PARTY CANDIDATES:

This is an urgent motion to disqualify the above-cited SAMASA official candidates for the Student Council Elections 2012 due to non-compliance of the requirement for SC-COA Clearance which is a vital requirement of the SCCOMELEC.
1. Sec. 21 of the Revised 2012 Edition of the Election Rules and

Regulations of the PUP Student Council as approved on 8 th day of February 2012 clearly states that Requirements A certificate of candidacy shall be awarded to a candidate who has submitted the following:

b) A photocopy of certification/clearance from the Student Commission on Audit stating that the candidate has no financial liabilities. (See Annex A)
2. Anent to this, the Student Commission on Audit (SCOA) Chairperson

Lorie Anne S. Avila issued a revised requirements for SCOA Clearance on 13th February 2012 which states that: For Incumbent Student Council Officers: Duly accomplished form Copy of financial statement or financial report (must be received by the Office of the Student Services) Photocopy of registration cards Resignation letter acknowledge by the head of office or by the body

For Student Organization Officers: -

Duly accomplished form Copy of financial statement or financial report received by the Internal Audit Office Internal Audit Clearance Photocopy of registration cards Resignation letter acknowledge by the head of office or by the body (See Annex B)

3. These candidates did not submit the said requirements as per

communication of the Office of the Student Services to the Internal Audit Office dated 13 February 2012 (See Annex C) and official list of the Internal Audit Office of those candidates who asked and had been issued Internal Audit Clearance (See Annex D). Their names are not included.
4. The issuance of SCOA Clearance made by Ms. Avila to these

candidates is a grave abuse of discretion in her capacity as Chairperson of the said commission and tantamount to a clear connivance with the COMELEC for them to be qualified as official candidates of SAMASA Party or misrepresentation of these candidates before the COMELEC. 5. Why did the Office of the Student Services issue a clearance to the incumbent student council officers particularly of Central Student Council considering the OSS sent a communication letter to the IAO of the unliquidated council as of February 13, 2012 (Annex C).
6. KILOS! PUP has been diligently complying with all the requirements

of SCOA and COMELEC to attain common vision for a CLEAN, FAIR and HONEST Elections. With these valid and clear grounds, the KILOS Party moves for the IMMEDIATE DISQUALIFICATION of Mr. Raven Deposado, et al as official candidates for the 2012 Student Council Elections.
