Introduction

In October 2011, the 39th Judicial District which consists of Franklin and Fulton Counties was notified by
the Administrative Office of Pennsylvania Courts (AOPC) of its requirement under 42 Pa. C.S. A. 1503 to
participate in the reestablishment of magisterial districts.

As a result of this announcement, judicial districts across the Commonwealth were tasked with assessing whether it is feasible to eliminate any magisterial districts through both an analysis of data and
consideration of additional relevant circumstances. Statistical data and guidelines for this process were

provided by AOPC for the last six years ( 2005 -2010) for case filings for criminal, traffic, non- traffic, private complaints, civil, landlord- tenant, and miscellaneous docket filings. In addition to case filing
statistics, a new measure was developed to differentiate among case types and judicial workload.
This reestablishment process occurs every ten years and is directly related to the Federal decennial

census. The guidelines indicate that the 39`h Judicial District shall submit recommendations to the AOPC
regarding the reestablishment of its District Courts no later than March 30, 2012.

The following report, along with required worksheets provided by the AOPC, will meet the requirements
of the AOPC.

Guidelines

Magisterial District Reestablishment guidelines and packets were provided in October 2011 by AOPC. In

addition, a Regional Reestablishment Workshop was held in November 2011 which was facilitated by
Amy Kehner, Judicial Programs Administrator with AOPC. For the current reestablishment project, the
AOPC provided standards which counties are to review and make recommendations. These standards

are outlined in the document provided by the AOPC, Magisterial District Reestablishment Guidelines. In

addition to these written guidelines, Franklin County was advised by the AOPC to use 0 class data because Franklin County moved from 5`h class status to 4th class status effective January 2012. Lastly,
Franklin County, after conferring with AOPC, elected to remove data from Centre County because their
average caseload is significantly higher than all other 4th class counties.
The goal of the Supreme Court is a 10% reduction in the Commonwealth' s district courts. The AOPC preferred method is to eliminate magisterial districts through attrition. Whenever practical, reductions

should occur by eliminating a district which is vacant or in which the incumbent is retiring or not
planning to seek reelection. When elimination through attrition is not feasible, average caseload should

be used to evaluate whether to eliminate one or more magisterial districts. By using the data provided by AOPC, the average caseloads for each judicial district should be compared to the average caseloads
for judicial districts within same class of county.

Recommendation:

Because the 39`h Judicial District spans two counties, magisterial districts within each county were
separately considered. With this said, there is no recommendation to eliminate any existing district
courts within the 39th Judicial District. However, Realignment should occur for District Courts 39 -3 -03,

39 -3 -04, and 39 -3 -06; and Reestablishment should occur for District Courts 39 -2 -01, 39 -3 -02, 39 -3 -05,
39 -3 -07, 39 - 4 01, 39 -4 -02, and 39 - -03. There are several reasons for this recommendation. 4

During the 2002 Magisterial District Reestablishment Process, Franklin County was a 5th Class County and requested approval from AOPC to add an additional Magisterial District
39- 3 -07). That request was granted and 39 -3 -07 was added. Ten years later, Franklin

County moved from 51h class status to 4th class status, but has elected to not add another

magisterial district. Instead, believes maintaining seven magisterial districts are warranted
given a jump in class status.

Franklin County is growing rapidly. According to U. S. Census estimates, Franklin County' s population grew by 15. 7% from 2002 ( 129, 313) to 2010 (149, 618). Only two counties
experienced growth more rapidly than Franklin County. Pike County (23. 9 %) and Monroe County ( 22. 5 %). Because of this growth, Franklin County moved to a 4th class county in
2012.

Franklin County has seven Magisterial District Courts; however, the average number of

districts for a 4th class county is 8. 3.


AOPC guidelines state that all portions of the magisterial district must be contiguous. The

two districts with both the highest caseloads and workloads are 39 -2 -01 and 39 -3 -02. The two districts with both the lowest caseloads and workloads are 39 -3 -03 and 39 -3 -06. However, these districts are not contiguous to those with the highest loads, so a simple shift
of caseload and workload from 39 -2 -01 and 39 -3 -02 to 39 -3 -03 and 39 - -06 is not possible 3 because this would result in a non -contiguous split.

Growth in Magisterial District 39 -3 -05 is anticipated due to Norfolk Southern Intermodal

Project taking place in Antrim Township. In addition to anticipated growth within 39 -3 -05, it

is anticipated that this Intermodal expansion project will bring a population increase to not
only Antrim Township, but neighboring or contiguous municipalities. Magisterial District 393- 06 neighbors Antrim Township. Business district growth is also anticipated as a result of
this Intermodal project.

It is anticipated that Magisterial District 39 -3 -06 will see an increase in filings as a result of

change associated with a newly elected Magisterial District Judge taking office in January
2012. The previous Magisterial District Judge was in office since 1981. In the first two months of 2012, personnel from 39 -3 -06 have shared with Court Administration that

criminal, traffic, and non -traffic filings are slowly on the rise and payments /foot traffic in the
office is increasing. It is anticipated that a change in culture and practices will continue to

be contributing factors that will lead to increased caseloads and workloads for 39 -3 -06. In addition to change in leadership, a large landfill business ( Mountain View Reclamation and

Waste Management) straddles both Antrim and Peters Township, and that as a result of

patrols by law enforcement, result in increased traffic filings to both 39 -3 -05 and 39 -3 -06

depending on the enter /exit route taken (either into Antrim Township or Peters Township).
It is proposed that by designation, all traffic related filings pertaining to this business be filed

with 39 -3 -06. Traffic filings associated with this business typically range from 15 to 30 per
year, but can vary depending on detail by law enforcement.
7. Both Franklin and Fulton Counties utilize a Central Court program. With regards to Franklin

County' s Central Court, this procedure has been established since January 2001. It is proposed that there be more of a rotation by Magisterial Judges in 39 -3 -03 and 39 -3 -06 through Central Court in an effort to create more of workload equity within Franklin County.
Currently, judges are assigned to the weekly Central Court sessions on a rotation basis. All seven Magisterial District Judges in Franklin County will still rotate through Central Court;
however, Magisterial District Judges in 39 -3 -03 and 39 -3 -06 will rotate through more often,

thus increasing their workload due to increased participation in the countywide Central

Court process. It is anticipated that this newly scheduled rotation will afford Magisterial
District Judges in 39 -2 -01 and 39 -3 -02 more scheduling opportunities within their offices, thus making overall workload more equitable within Franklin County.
8. All Magisterial District Judges in Franklin and Fulton Counties take rotations with regards to

being on call. In Franklin County, the practice has been that the on -call judge will docket the case to their office when handled on call even when case is outside of their municipality.
This practice will change and on -call judges will docket cases to the respective municipality.
This will provide a more accurate reflection of caseloads and workloads for all districts;

particularly, 39 -3 -03 and 39 -3 -06.

Central Court in Franklin County takes place every Tuesday and holds both

Magisterial District Judges in

Franklin

There are two judges assigned and a third is assigned as an alternate should

one of the two primaries not be available due to unforeseen circumstances.

In Fulton County, Central Court takes place every Monday afternoon and Magisterial District Judges in Fulton County are assigned to the weekly
Central Court session on a rotation basis. One judge per week is assigned.

This district covers large areas and is bisected by the Pennsylvania Turnpike.
This district is rural and large in square miles.

With regards to the Borough of Shippensburg ( West End), all filings by the
Shippensburg School District will remain with 39 -3 -04.
The Borough of Orrstown has seen growth in population from year 2000. It is

estimated that the increase in caseload from redistricting the Borough of


Orrstown will be minimal ( 14 filings in 2010). However, with regards to the

Borough of Shippensburg (West End), with exception of Shippensburg School


District filings from High School and Middle School, it is estimated that there
will be an increase in caseload /workload in Criminal, Traffic, non -traffic, and

private complaints as a result of this redistricting proposal ( 467 filings in 2010). By adding these municipalities, it is estimated that there will be a 13% increase
in caseload to 39 -3 -03. The difference between this districts average total

caseload and the 39`h Judicial District's average total caseload will change from
9% to 4 %.

The redistricting plan recommends that all filings associated with the

This is a busy district with a large business corridor, large shopping mall, and heavily traveled Interstate. With regards to the Borough of Shippensburg (West End), all filings by the
Shippensburg School District from High School and Middle School, will remain
with 39 -3 -04.

There will be a decrease in caseload in this district as a result of redistricting the Borough of Orrstown and Borough of Shippensburg (West End) with exception of Shippensburg School District filings from 39 -3 -04 to 39 -3 -03. It is estimated
that the decrease will be 13 %; however, the difference between this district' s

average total caseload and the 39`n Judicial District' s average total caseload will
stay at 5% which is still within the AOPC' s +/10% goal with regards to caseload.

This district covers large areas, is rural, and large in square miles, It is

anticipated that the redistricting proposal to add Metal Township, with


exception of Pennsylvania Turnpike filings, will increase caseload and workload

to this district. Metal Township has seen growth from year 2000 to year 2010. By adding Metal Township, in addition to civil and landlord tenant filings, it is
estimated that district 39 -3 -06 will see an increase of 300 additional cases for criminal, non traffic, traffic, and private complaint filings.

The redistricting plan recommends that all filings associated with the Pennsylvania Turnpike which passes through Metal Township should be filed
with district 39 -3 -03.

By adding Metal Township, it is estimated that there will be a 7% increase for


39 -3 -06. This addition will place the difference between this district' s average
total caseload and the 391h Judicial District' s average total caseload at -39%
instead of -46 %. The plan discusses additional recommendations to increase

the average total caseload for 39 -3 -06.
