NOTICE OF PUBLIC MEETING


Proposed Draft Plan of Subdivision & Zoning By-law Amendment - Rosemount Estates 2260304 Ontario Inc.
PROPOSED ZONING AMENDMENT The zoning amendment proposes to change the zoning of the property known as Concession 1, Part of Lots 31, 32 and 33 described as Parts 1, 9, 10 and 14 on Plan 59R-8019 in the City of Port Colborne, located on the south side of Killaly Street West from RD (Residential Development), P (Public and Park) and OS (Private Open Space) to a site specific R2 (Second Density Residential), RT (Residential Townhouse), R4 (Fourth Density Residential) and to the NC (Neighbourhood Commercial), P (Public and Park) and OS (Private Open Space) zones. The proposed zoning change will permit the use of single detached dwellings, street townhouse dwellings, apartment dwellings, neighbourhood commercial and open space uses on a proposed Draft Plan of Subdivision. The zoning change will also allow reduced lot frontage and lot area for single detached dwellings and street townhouse dwellings. The proposed zoning change will be subject to a holding symbol which will restrict the proposed uses from occurring until the developer enters into a Subdivision Agreement with the City. DRAFT PLAN OF SUBDIVISION The Draft Plan of Subdivision proposes 219 single detached residential lots on 10.2 hectares, 173 townhouses on 4.75 hectares, 570 medium density residential lots on 6.6 hectares, 7.34 hectares for roadways, 1.82 hectares for neighbourhood commercial use, 1.39 hectares for parkland and 21.22 hectares for open space/recreation.

Please note that unless you do one of the above now, you may not be able to appeal the decision later. LEGAL NOTICE Sections 34 and 51 of the Planning Act If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of Port Colborne before a decision on the proposed Zoning By-law Amendment and Draft Plan of Subdivision are passed by Council, the person or public body is not entitled to appeal the decision of the City of Port Colborne Council to the Ontario Municipal Board. If a person or public body does not make oral submissions at a public meeting, or make written submission to the City of Port Colborne before a decision on the proposed Zoning By-law Amendment and Draft Plan of Subdivision is passed by Council, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there is reasonable grounds to do so. If you wish to be notified of the decision of City Council in respect to the proposed by-law you must make a written request to the City Clerk.
