RANDOM ACTS OF KINDNESS DAY APRIL 6TH


Random acts of kindness are means by which we make deliberate attempts to brighten another persons day by doing something thoughtful, nice and caring for them. Kindness is a way of showing others that they count and that even in the face of hostility and selfishness, youre making a stand for kindness; and WHEREAS, Mark Twain once said, kindness is the language the deaf can hear and the blind can see; WHEREAS, The Greek fable writer Aesop said, No act of kindness, however small, is ever wasted; WHEREAS, This will be a day for the entire community to be challenged to do something kind for a friend or stranger for no reason hopefully, we can keep this spirit going every day; and WHEREAS, Some examples of random acts of kindness are: personally thanking a police officer, EMT, fireman, veteran or city employee for their service; sending a handwritten note to someone that has made a difference in your life; sending an e-card saying the same; pay the tab for the person behind you; taping quarters to a drink machine; taking flowers to the hospital or nursing home; and WHEREAS, The words of commentator Cleveland Amory are even more true today, what the world needs now is a new kind of army, the army of the kind. NOW, THEREFORE, I, Richard W. Meehan, Mayor of the Town of Ocean City, Maryland, do proclaim April 6th, 2012 as RANDOM ACTS OF KINDNESS DAY in Ocean City and ask that our citizens perform random acts of kindness today and throughout the year. Things to Note: This event would be a 140-mile bike ride from Ocean City, MD to Baltimore City to benefit Moveable Feast. The event will begin on Saturday at 7:30 am from 3rd Street and the Boardwalk. Cyclists will ride out onto 3rd Street to Philadelphia Avenue, to Route 50, and make a left onto Route 611. Cyclists will obey all traffic and cycling laws. Request a PA System and DJ to set up at the Plim Plaza Hotel. All loading and unloading would take place at the Atlantic United Methodist Church. Request additional parking of three (3) 24-foot trucks and one (1) 14-foot truck. Request this parking be at a municipal lot or the WOC park n ride. Request police escorts from the starting point to Route 611. Expected number of riders is 200, with 100 volunteers.

Comments from Department Representatives: PUBLIC WORKS Early morning cruisers are lining up for Boardwalk Parade beginning at 27th Street. Staging of four trucks at Park n Ride could be an issue because car storage trailers are staged in this area. Otherwise there are no issues. TRANSPORTATION Same weekend as Car Cruisin weekend. Historically, Council has allowed overnight parking of oversized vehicles and trailers at the WOC park n ride for the duration of that event. Therefore, issuance of parking permits for this event may not be needed. OCPD Traffic control at following intersections: 3rd Street & Baltimore Ave., 3rd St & Philadelphia Ave., 2nd St. & Philadelphia Ave., and 1st St. & Philadelphia Ave. Monitor the Boardwalk for pedestrian and bicyclists not associated with the event. One officer on bike to lead and one to follow race. Will also coordinate with the Worcester County Sheriffs Dept. and the State Highway Administration for traffic control as route exits the corporate limits of the Town of Ocean City. Total cost to the department is estimated at $828.00. RISK MANAGEMENT Insurance Certificate to be obtained and submitted prior to the event. TOURISM, RECREATION & PARKS, OCBP, FIRE MARSHAL, and EMERGENCY SERVICES, OCCC No comments, concerns or costs.

Things to Note: This event is the culminating activity of a four (4) week walking wellness unit. The students will walk 10 miles the distance from Showell to the O.C. Boardwalk during recess and Physical Ed. Classes to earn the ability to compete in the Boardwalk Walk. The participants will begin at the Inlet and then proceed to 27th Street. Things to Note: This event would consist of childrens soccer matches 5 versus 5 on 30x40 fields. This one-day event would take place on Saturday, with a rain date of Sunday. The event would set-up 20-30 soccer fields on the beach from Wicomico Street to 1st Street, but may only need to Caroline Street. Set-up for the event would take place on Friday, unloading on Talbot Street. Clean up of the event site would take place Saturday and Sunday, from 8-11 pm. The event coordinators request to set-up tents on the beach near Dorchester and Caroline Streets. The event coordinator will have sale items relative to the event, but no product sampling. Expected number of participants is 2,400.

The event sponsor must take responsibility to assure they, their participants and spectators do not block these critical access points. (2) Be pro-active in keeping the accesses and tram lane clear. (3) Set-up at least 30yards off the easternmost edge of the tram lane on the Boardwalk so OCBP vehicles can enter and exit the beach. (4) All loading/unloading in the area of the Dorchester Street ramp must occur before 8:00 a.m. and not resume until after 7:00 p.m. (5) The playing area may not extend any further east than the wooden walkways, which are perpendicular to the Boardwalk and extend to the waters edge. SUBJECT: Staff Recommendation Conditional Use Wind Turbine 1405 Atlantic Ave. DATE: February 28, 2012 _____________________________________________________________
I have reviewed the results of the noise and vibration test performed by On-Site Acoustical Testing LLC, a copy of which you previously received. The result of the test indicates a noise level ranging from 43dBA to 54dBA. The fact that noise levels up to 2,500 feet from the turbine were the same as those adjacent to the turbine indicates that the noise at the turbine site was primarily ambient noise (most likely traffic and wind). Ambient noise in the location of this installation from the ocean and the boardwalk will most likely be louder than any noise produced by the turbine. I talked with a representative of the manufacturer by telephone. He assured me that the system is frictionless and is virtually noise free. He said since there is practically no perceptible noise their specification sheet does not list a noise level. In my opinion, the results of the independent test are sufficient to satisfy the code requirement that the system produce noise no greater than 55dBA. (As an aside, State law allows heat pump units to produce noise up to 75dBA, much louder than this system will be.) The conditional use will have to meet all code requirements, so after installation, if the unit does exceed the 55dBA maximum, it would have to be retrofitted or removed. With regard to the appearance of the installation, I believe the applicant has done everything possible to minimize the intrusion on the surrounding area. The turbine as proposed will be much more attractive than many rooftops in town that are topped with numerous visually disturbing antennas. I recommend that the Planning Commission send a favorable recommendation on this application to the Mayor and City Council. It is as good an application of the wind turbine regulations as I can imagine.

BUCKLEY: Alright, were going to have a final discussion here on, to finalize the recommendation to the Mayor and Council on the Conditional Use application for small wind turbines to be located at 1405 Atlantic Avenue in the Town of Ocean City, Maryland. The applicant Joe Bartell for Marguerite M. Villa Santa, File #10-12100001. Mr. Houston. HOUSTON: Yes, you had asked me to review the testing report from On-Site Acoustic Testing, LLC and as I said in the memo that I sent to you last week, the testing that they, the noise levels that were the result of their tests range from 43 to 54 decibels. They were also the same levels within 2500 feet of the turbine; which says to me that the noise they were measuring was essentially ambient noise that existed without the turbine. It was near a street, and wind and that kind of thing. And I also had a phone conversation with a representative from the manufacturer who, I asked him why they dont have measurements on their spec sheets, and he said that the system absolutely makes virtually no noise. They found no need, they tested it in the wind tunnel of their own, that kind of thing. BUCKLEY: Right. HOUSTON: They saw no need to specify a wind, I mean a noise measurement on their spec sheet because it essentially is noiseless. TAYLOR: So why wouldnt you put that on the sheet then HOUSTON: Well, they do, they say virtually, I cant remember the exact wording, but it says virtually noise-free, and I went up there to the site and when youre standing on the boardwalk, the waves, and the wind, and in the summertime, the noise on the boardwalk, is probably going to exceed 55 decibels anyway. And the other comparison is, state law allows heat pumps to be up to 75 decibels, so if you want to use a comparison, they could put heat pumps up there and we have, you know, no say over it. So anyway, the bottom line is, my analysis of it is, that this thing is going to be virtually noise free and aesthetically, you know, its probably as good an application of this kind of system as well see. And I just wanted to show you a comparison (put photos on screen). Okay, thats their rendering of it, with the enclosure on top of the building. BUCKLEY: Right.

HOUSTON: I mean you almost cant even see it from the boardwalk. BUCKLEY: Right. HOUSTON: And, this is what we get (referring to second photo) on any building in town without review, so you know, as far as the aesthetics of it, I dont think thats a problem either. So this is a Conditional Use, so if you do want to move it along, you need to send a favorable recommendation to the Mayor and City Council. BUCKLEY: Okay. HOUSTON: And if you do, well development the finding of fact real quick, and have you approve it before we do send it up. BUCKLEY: Okay, Commission members? MILLER: Happy to get the information, and satisfied actually. BUCKLEY: Um hm, yep. Okay, can I have a motion? MILLER: I make a motion we approve it based on the staffs recommendations and if there is a noise issue, under Conditional Use, we can come back, correct? HOUSTON: Well, thats true. I mean, if its approved, and installed and if it ends up exceeding the limitations that are in the Code, itll have to be retrofitted or otherwise removed. Upon a motion made by Peck Miller, seconded by Lauren Taylor, and carried by a vote of six (6) to zero (0), with Tom Singman absent, the Planning and Zoning Commission hereby gives a favorable recommendation for the installation of three (3) roof-mounted small wind turbines housed in a single enclosure at 1405 Atlantic Avenue

1. Population Change: The Commission found that there would be no population change in the neighborhood as a result of this use. The single-family dwelling that has been recently remodeled is located between the existing Commander Hotel to the south and the Harrison Hall Hotel on the north, fronting on Atlantic Avenue (Boardwalk) between 14th and 15th Streets.

2. Availability of Public Facilities: Facilities are existing and in fact, this installation may reduce the demand on the electrical supply system.

3. Present and Future Transportation Patterns: No change is anticipated to the existing or future transportation patterns as a result of the request.

4. Compatibility with Existing and Proposed Development for the Area: Based on the exhibits submitted and reports received, the Commission anticipates the use would be compatible with the area. 5. Relationship to the Comprehensive Plan: The use is in compliance with the Comprehensive Plan since the zoning ordinance was amended to include wind turbines as a conditional use permit. The property is zoned R3 and the system has been designed in accordance with Section 110-883 of Chapter 110, Zoning.

Therefore, the Planning Commission does hereby give a favorable recommendation for the installation of a roof-mounted small wind turbine system as requested subject to the following conditions: 1) Approved per the attached staff recommendations. This meeting of the Planning and Zoning Commission was held on Tuesday, October 18, 2011, in the City Hall Council Chambers located on Baltimore Avenue and 3rd Street, Ocean City, Maryland. Pam Buckley, Commission Chairperson, called the public hearing to order. BUCKLEY: This is pursuant to the provisions of Article II, Division 5, Conditional Uses. A request has been filed under provisions of Sections 110-394 and 110-883, uses permitted by Conditional Use in the R-3 General Residential District to permit installation of three (3) roof-mounted small wind turbines. And prior to any public hearing the chairperson shall read the following statement: Any person in attendance may object to a Commission Member taking part in this public hearing due to a conflict of interest. The Commission, excluding the person in question, shall decide by majority vote, whether the challenged person may take part. ESHAM: Under the penalties of perjury, do you hereby swear to tell the whole truth and nothing but the truth? SMITH: I do. After receiving the application for the Conditional Use for a small wind turbine, the zoning enforcement officer posted the property on September 29th and advertisements were ran in the Ocean City Digest on September 29th and October 6th, the year 2011, stating the time, date, place, and purpose of this meeting. We also sent by regular mail notice to adjacent properties within a 300 radius that this meeting was taking place and its purpose. The applicant has supplied a number of pieces of information, one of which is on the screen, which is a rendering of the dwelling indicating on the roof three white turbine I say white, theyre in the color white, Im not sure what color they actually will be, but that depicts the turbine that is proposed. Another, well, this is basically what we did - we posted the property in two different locations. Because of it being on the Boardwalk, we posted it so people on the Boardwalk would get notice, and then on the alley way, on the west side of the property, it was posted, so there would be dual postings of the property, and well put that in exhibit. In addition to that, we have a staff comment from the Ocean City Development Corporation, Glenn Irwin, they have reviewed the request and their design committee and staff have

recommended approval of the wind turbine at 1405 Atlantic Avenue. They state that they hope that this first-time wind turbine project will spur others to complete additional projects with renewable energy in Ocean City. Well put that into evidence. (pause) This being one of the first application thats being proceeded with, we have had other applications but none of them have gone forward, I gave to the Commission the outline of Section 110-883, which talks about the criteria that we look at when considering small wind turbine, and as a Conditional Use, the review process is to determine whether or not the wind turbine in this particular location might have more adverse affect than it might be somewhere else, or if it would even have any adverse affect on the adjacent property and its compatibility, and to guide us in that manner, when the ordinance was passed, it did stipulate maximum rated capacity as to the output of the unit. This property is zoned R-3, General Residential, District, on the Boardwalk. It has a 32 setback from the easterly lot line to the main building; so the building does maintain a 32 setback and it also has a nice veranda porch on the Boardwalk which is allowed to go 12 into that setback. Then you have the dwelling itself, which I believe is three to four stories in height, and it has a high-pitched roof, and the proposal is that these wind turbine would be on the roof line near the ridge line. And, they may stick approximately 4 above the ridge line to get the wind velocity that they need. The applicant will talk about that, structural integrity, and things of that nature and some other things that are in the criteria such as the color, and operational things with noise and that type of thing. So those are other criteria that they will address in their presentation. Now the yard requirements, setback and height issues under this zoning proposal says that you have to maintain a certain setback from adjacent lot lines based on the height of the device. If you were to have a free-standing tower, monotower, then it would be 1.1 feet of that tower height. In this case, because its on the roof, were measuring the 4 height, which is from the base of this wind turbine to the top of it, and they are set in on the building. The building itself has a setback thats probably 12 or more feet, so theyre more than distant than what they need to be from adjacent properties, based on the height of the device should it fall, or fall down, it would fall on the property itself and not on adjacent property. So theres no issue as to the height of the unit on the roof. There will be certifications as to structural integrity and those types of thing, from both the manufacturer, the engineers, and the applicant, which have to be provided to the Building Official prior to the release of a building permit. They may speak of some of the integrity of the construction elements, but that has to be perfected prior to the release of a building permit under this regulation. Noise, they will talk to you about the db rating, Im sorry the dBA rating, the decibel rating. The Code stipulates that they cannot exceed 55 decibel, and they can talk to you how this is rated and what they understand about the rating of the sound that may be generated by the device. The appearance it says non-obtrusive color, this should be similar to the manufacturers color and they can talk about what the color is or what it appears to be and what it will be maintained as. Again it has to comply with Building Code. There have to be electrical inspections to make sure it meets the National Electric Code for its hookup and then, we have a provision about net energy metering, that should they provide energy back into the system, it has to be in compliance with the Maryland Net Metering Laws, which is a Maryland Code with the utility companies under Section 7-306, which I would imagine is probably the Annotated Code of Maryland. They have to comply with FAA, which is your Federal Aviation Administration, which I would suspect thats not an issue, because normally if youre less than 200 in height you dont normally encounter the FAA, and were talking probably something less than 50 off the surface of the ground. Public Service Commission says the property owner seeking to install a small energy system

must comply with all requirements of the Maryland Public Service Commission and provide written documentation of such with the building permit application, so that will come later. They may or may not talk about the Public Service Commission, and again with net metering and some other things, they would coordinate with the state in that manner. It says unsafe or abandoned systems should the system get approved and get installed and then for one reason or another its discontinued or not used, this requires that it be removed from the property, in a reasonable amount of time, which is 30 days, if it remains idle for more than 12 months, so, if it becomes a system that they dont want to keep, they will need to remove it from the property after a certain amount of time. Some of the power the towers, theres provisions that you have to safeguard kids from climbing up the tower for the first 12 feet, and this case, thats not an issue because they dont have access to the roof, normally, so theres not an issue as far as safety or protecting, or access to these turbine, it would be from the building itself. Those are the main criteria that we have to look at, and the applicant could give you specifics on the systems, its design, whether it be the decibel rating or the sound system, its colors, and the other thing is that it cannot have any type of advertisement on the system, other than maybe a manufacturers identification, so I would assume they can answer any question that you would have as to the installation and operation of the system. MILLER: It cant be lit up either. SMITH: No lighting. BUCKLEY: Okay, that would be the staffs comments opening up the case. Anything else, any other questions of Mr. Smith from the Commission? My limitations or, I guess my area of involvement with the turbines is going to be to assist with the installation and meeting structural requirements, you know, helping with the permits. Things of that nature. Scott, over here, is with a company that is actually going to fabricate and you know, supply, you know, the material. He knows a lot more about the specifics of the unit, whereas Im

here to more or less supervise and make sure that the installation goes the way that its supposed to, and make sure that the permits are adhered to and the zoning regulations and so forth. So, unless you have any sort of general observations or remarks, if you have anything specific, Id rather go ahead and turn it over to Scott at this point. BUCKLEY: Okay, I think well hold our questions oh well TAYLOR: I just are they going to be mounted individually or on a platform? LEBOWITZ: Theyll be mounted on three platforms just beyond the ridge line from the front of the house. Sort of like the way an old satellite dish wouldve been mounted. Itll be an aluminum platform that comes out and down, and itll rest on top of top of that. MILLER: Itll be on the west side of the roof line or the LEBOWITZ: Yes, the west side. You wont see it from the front of the house, all youll see is the turbine itself. BUCKLEY: And you dont see any structural reasons why this, why they cant be put on that roof? BARTELL: No, I dont. BUCKLEY: On that property, oh okay. BARTELL: No, Im sure it can be accommodated. BUCKLEY: Okay, alright, we will let you turn it over to Scott. LEBOWITZ: Um, some of the questions, or some of the things that came up basically, the turbines, they generate individually, 2 kW themselves. So in total with the three its 7 kW per hour. They will be no higher than 4. As for the noise scenario, the decibels that it basically will generate is virtually nothing. Theyre virtually quiet and no vibration to them. As for color, we can paint them any color. Were basically contemplating doing them as the roof color at this point, unless there is some objection to that and then we basically go from there. Other than that, do you have the pictures of what they actually look like? MILLER: Not really. BUCKLEY: Thats what we were trying to figure out, what this is? LEBOWITZ: Okay, that is a represent- that is what it actually looks like. MILLER: So it has the fins, the glass fins on it. Yes, it has Lucite plastic fins that come out from a central structure that is about this big (gesturing). Its stationary, and the inside of it thats corrugated almost, the open section is what spins and the fins are whats basically generate, basically MILLER: Directing the air.

LEBOWITZ: directing all the air into it. MILLER: So theyre fixed, and how, what is the diameter of? LEBOWITZ: The diameter of it is 4. MILLER: The outside diameter of the fins is 4, so LEBOWITZ: And the picture that you have of the house, those cylinders on top are actually representational sizes of it. MILLER: So thats a 4 LEBOWITZ: Thats a 4 x 4 cylinder sitting up there. MILLER: So are you talking about painting these Lucite fins the color of the roof? LEBOWITZ: No, theyll be, the structure itself, which is the inside of the fins MILLER: The interior. LEBOWITZ: will be the color of the roof. Or we can leave it the Aircraft Aluminum (color), and just seal it. BUCKLEY: Hm, Im liking sky blue. (chuckle) Periwinkle blue? MILLER: It says here that youre not going to see these fixed wings. LEBOWITZ: No. MILLER: I mean theyre going to be translucent, theres not a whole lot of framework with them. BUCKLEY: Right. LEBOWITZ: No. MILLER: Do you have something we could see what the framework looks like? LEBOWITZ: You have my MILLER: Or am I looking at it? LEBOWITZ: Youre looking at it. If you look at, lets see if mines better. TAYLOR: So, from wing tip to wing tip, including the central portion, what is the diameter of the central core? BUCKLEY: He said 4 across.

MILLER: No, thats the wings. Outside outside, outside the wings is going to be 4 x 4. A 4 circle basically. LEBOWITZ: This is the frame BUCKLEY: That includes the, thats what we had. LEBOWITZ: The core unit is just over 2 if I remember correctly. TAYLOR: So these look like theyre more than twice that. LEBOWITZ: They arent. Theyre arent visually what it is, its 4 from end to end. MILLER: Is it kind of a box or kind of a curve? LEBOWITZ: A circle, okay, a circle with these curves items coming off of it. MILLER: And theres four of them, okay. LEBOWITZ: The larger one we have right BUCKLEY: Have you installed this particular model anywhere? LEBOWITZ: Uh, we have four of them pending to be installed in Baltimore; were waiting for the wonderful City ordinances to catch up!

BUCKLEY: Okay. LEBOWITZ: And since theyre revamping everything, there are several of them that are installed on the west coast and throughout the mid-west. The nearest one is in North Carolina. TAYLOR: And when the wind is blowing, at lets say, 15 miles an hour, they have to make some noise. LEBOWITZ: Im being told, and from what Ive seen, and Ive seen one running, that it is virtually noiseless and vibration free. I will basically say that I dont expect it to make any more noise than a compressor. TAYLOR: Or three compressors. MILLER: Theres a lot of compressors that are loud though (chuckle). LEBOWITZ: Yeah, I mean, we have one sitting on top of a building now that isnt installed that I, we physically put up there, just to see what it did, and I cant hear it running. MILLER: Do they have a dB rating at all? LEBOWITZ: Ah, no. Or yes it does. Um, exactly what I was told from the manufacturer is it is noiseless. MILLER: But it has to have a dB rating then. TAYLOR: There isnt any such thing as noiseless. MILLER: Well, I mean, theyll give it a zero dB rating, but theyll give it a rating. Thats something we have in our Code that I think we at least need to be aware of what the dB rating is. LEBOWITZ: Okay, that I will supply to you tomorrow. MILLER: Okay. LEBOWITZ: I mean, if you dont want it the color on the roof, I would BUCKLEY: Leave it the same. LEBOWITZ: I would think that aesthetically it would be better off if it were actually that aluminum color? BUCKLEY: Um hm. Isnt that what it, right? LEBOWITZ: As opposed to being something of a different color that doesnt go with the roof. TAYLOR: No, I think the aluminum would just blend into the BUCKLEY: Yeah, LEBOWITZ: Okay. BUCKLEY: I think because it picks up the shades of things and blends in with the sky, kind of, so to speak, you know. LEBOWITZ: Right, that makes sense. TAYLOR: You know, did I already miss this, what is this material? LEBOWITZ: Its some sort of composite plastic. BUCKLEY: Clear. LEBOWITZ: Clear. MILLER: And do you have a photograph of the house instead of just an architectural rendering, or BUCKLEY: (chuckle) LEBOWITZ: We can make that happen. MILLER: Yeah. SMITH: Well, both of these have transient occupancy for residential. MILLER: Right, thatll be all. BROUS: But 55 dBA is comparable to what? SMITH: Us talking, thats the sound of speaking. MILLER: Yeah, I think its something we need to look into SMITH: And it is an acceptable level that we have in our noise ordinance that when you rate something at 55 decibels as a maximum, daytime you would 80-some decibels? No, no, 69. HOUSTON: 65 in daytime, 55 at night is the noise ordinance. MILLER: I mean, I just think we need to know what those numbers are before we, maybe in its condition, but we to at least SMITH: Right. This one says no more than 55 at all times. MILLER: Our Code says that. SMITH: Yes. MILLER: Yeah, so. LEBOWITZ: Ill also supply that to you tomorrow, thats not a big deal. BUCKLEY: So, we need a dBA rating. BROUS: At the property line, which is MILLER: Well, its the dBA rating period.

BUCKLEY: Right, its just a rating of whatever we um MILLER: Its the noise level that determines how far it sits from the property line. BUCKLEY: It looks like smokestacks. TAYLOR: Id like to see what the rear of the house is going to look like. That alley gets a lot of use, and I think you can see it from the Harrison Hall Room. BUCKLEY: So we need a rear rendition and we need an actual photograph of the house at this point. We still have the testimony to get through. LEBOWITZ: Okay. MILLER: Alright, I guess a couple questions I have, to Joe or Blaine or whoever it would be nice to see an actual photograph of one of these mounted on a roof, of how the base is going to, like, Lauren wants to see the base, and how the base is going to look. But it would be nice to see what they actually do in scale with the house. I mean, we can do artist renditions or we can do the drawings that I guess Joe Hill, or whoever did these drawings of the house with them on top, but it would be nice to see what its really going to look like. Because you may find that, and the owner may decide that it, it makes sense to paint them like chimneys, or maybe it makes sense to paint them blue, or, keep them the way that they are, but I think with actual photographs we could tell a lot better what its going to be. Right now its a lot of pieces that were putting together, I think. BUCKLEY: If we could get an actual photograph of the house, and an actual photograph of the unit itself thats going to go on there, we could probably figure out what it would look like on the house. MILLER: And some kind of design of how its going BUCKLEY: Be attached. MILLER: the roof structures going to be and how big thats going to be. LEBOWITZ: Okay. MILLER: If youre having, I mean, are you planning on putting up a 4 platform on the roof at each section, so it sits, or do the fins not have to be on the platform? LEBOWITZ: The fins dont have to be on the platform, so its that, just over 2 that its going to have to fit on MILLER: 2 x 2 square. LEBOWITZ: Yeah, maybe at most its 3 by 3 that its physically sitting on and bolted down to. BUCKLEY: And then its, but its going to be an L-shape, correct?

LEBOWITZ: Yes, itll come out from the roof pitch like this (gesturing). BUCKLEY: Its going to come out and then go down. MILLER: And be supported, right. BUCKLEY: Right, okay. MILLER: It would be nice to see all of that? LEBOWITZ: Okay. MILLER: Because this is the first one were doing. LEBOWITZ: Oh, I dont disagree. MILLER: And its Code compliant, and we applaud you for, and its a neat, its a system that wasnt available two years ago. BUCKLEY: Right. LEBOWITZ: Yes, it was, but nobody knew about it. We spent almost two years going through every turbine that was out there before we ultimately settled on this. MILLER: Its relatively efficient is what youre saying, right? LEBOWITZ: Oh yeah, its the best product that weve managed to find out there. TAYLOR: Then why isnt it installed anywhere? BUCKLEY: Oh it is, just not here. LEBOWITZ: Its installed in the mid-west and on the west coast, and in Florida. BUCKLEY: And in North Carolina. LEBOWITZ: North Carolina. TAYLOR: I thought you said they were only LEBOWITZ: They havent done anything here. They havent done anything on the East Coast and the mid-Atlantic outside of this one installation in North Carolina, and theyre actually moving that turbine from where it is somewhere else on that campus. Its at a school and it wasnt installed in the right spot, and it wasnt getting enough wind. Theyre based out of Florida, and manufactured out of Florida. Its a very interesting company and a very interesting turbine. MILLER: And they probably didnt get the (indistinguishable) (chuckle). BUCKLEY: No comment.

LEBOWITZ: Theyre very busy, theyre selling lots of them. MILLER: Yeah, I can imagine. BUCKLEY: Yeah, well this looks good to me. I mean, I think it, its appropriate, you know, size-wise, that sort of thing, but we would like to be able to confirm that and of course we do have to take more testimony, so. LEBOWITZ: Okay. My partner and I, Brandon Caperollo, we started First Solar and Wind Energy Company in Ocean City and we represent a silent and bird-friendly product thats been tested, thats actually installed at the University of Maryland, and we have the back-up data, thats non-biased data, and the manufacturers data that we can prove. So, we are happy to see small wind turbines come to Ocean City; dont get this message wrong. Were here in support of the fact that wind should be developed here, but we want to see that its really a) silent; proven by more than the manufacturers word; and b) that its really avian friendly. We live in a resort where our wildlife is here all the time, and they are everywhere. Ours is passed by Unesco Worldwide Preserve for being silent and bird-friendly. We would like to see a similar device thats going to be installed proved that theyre going to back it up, and b) what they say they are. Application-wise, on the roof. Wed like to see a structural engineer whos done this before, and can say yes or no to this, because this kind of application, just the builder saying, hey, I can put it up there, its okay doesnt cut it in my opinion. We would subscribe to a higher level of engineering to have somebody know that this would really work in the

attachment, and pretty much, thats it. Were for small wind, were happy that somebodys trying to do this and somebody wanted to buy a product, we just wish they found us. Thank you. I just wanted to say, Joe couldve said the same thing, but since Im here Ill say it, we tried to find somebody local, by the way, and we did speak to several local companies over the course of the two-year period. We actually even applied with one of those local companies and then we were, we found necessary to withdraw that application, which I think the Department is aware of its probably all in the file, because they really werent up to speed with the product and/or the installation, and we have an engineer, obviously. Fred Legge, and our general contractor, who, you know, has already talked to Fred about how to do this; were going to hire Mumford to build the platforms. I dont know if youre aware of the kind you can put your condensing unit on the side of your house BUCKLEY: Um hm. VILLA SANTA: instead of putting it on the ground BUCKLEY: Right. VILLA SANTA: and its just an aluminum shelf thats braced like that, so we were envisioning something like that that the engineer would design that Mumford would build and that Joe would install, so not as if we havent thought that through. We thought that that would come at the permitting BUCKLEY: Okay. VILLA SANTA: process, level, as opposed to, actually we tried to figure out what it is we needed to bring here today, and we didnt think we needed, actually I think we were told that we didnt need engineered drawings, which we will get, at that we didnt want to spend money on engineered drawings if we dont get approval. BUCKLEY: Understand, understand. Right, understand.

VILLA SANTA: It just didnt make any economic sense. So at every level well spend more and more and more and more and more money, and by the way, this is a very expensive installation BUCKLEY: I would imagine. VILLA SANTA: and the noisy units, by the way, are the ones that look like propellers. TAYLOR: Um hm. BUCKLEY: Right. VILLA SANTA: Theyre terribly noisy, you know, for what I know about them. And, theyre also not bird-friendly from what I know about it, which Im not an expert in any of this so, we went with something that wasnt noisy, that was bird-friendly, that was small, I mean, these are really teeny units. Smaller than I am, so I think thats all I had to add as I was hearing all the questions come up, and as to the color, we grappled with should it be sky-blue, so it blends in with the sky, should it be the color of the roof shingles, we went through that same exercise that you went through, and we just, where we ended up was the color of the shingles, although the Lucite pieces, theyre see-through anyway, so were not sure we want to paint them any color, because you can see right through them anyway. MILLER: Yep. VILLA SANTA: So we went through this long arduous several year process while we were rebuilding the house and since we rebuilt the house, which was a long arduous process, so TAYLOR: But beautiful. VILLA SANTA: Thanks, thanks! BUCKLEY: So youre saying that the one youve got in the application here is avian friendly and that they do have some sort of comments on that? LEBOWITZ: Yeah, I will get you everything that they have tomorrow. VILLA SANTA: I dont have that, but Ive been told that, thats why we picked it because its silent and bird-friendly. I think if we can dot our is and cross our ts a little bit as far as the information that we need to, as far as it pertains to Code, I think it looks like a good project. Id like, Im sure theyve done studies with this particular project to see what is the least obtrusive color or situation, I mean, its on the roof, usually it blends with the sky. I mean, I would assume it would be as illustrated on the paper here, so I wouldnt suggest that youd paint it like the roof or anything like that, I think it looks fine the way it is, and I, it has my vote. BUCKLEY: Okay, Lauren. TAYLOR: Um, I just dont think theres anything thats totally noise-free. Even a childs pinwheel when it goes around makes noise. So, theres got to be some decibel level, if this things being sold, manufactured and sold, there has to be some data on that, because anybody thats doing a requisition, an RFP, have got to have that information, so its got to be somewhere. My other concern is from the back that is a highly visible spot, that alley gets a lot of views; there are rooms that look over it, that were not creating an eyesore. I dont see any reason why it would be, Im not saying that. Im just saying that Id to see what it, the actual, we havent seen what the installation would look like, all weve seen is some drawings some things that are drawn on the top of a building, so Id like to see the back of the building, and Id like to have information from the manufacturer or some other installation about the noise level. BUCKLEY: Peck? MILLER: I like the project; we are looking for these in town, and hopefully were gonna, this is something that will work. I know that I want to have accurate data on the noise

before we say yes, so if we do a condition its going to with accurate data supplied; and thats a cumulative thing not just one machine but all three, how thats going to affect whats going on. The color Im not real sure. I understand about hiding the color, but at the same time, perhaps from a bird-friendly thing maybe a darker core would keep birds from flying into a column, I dont know. Because youre going to have Lucite thats going to collect whatever goes by the wings. So I would say that Id like to get a professional opinion on what color it could be to be the most bird-friendly as you possibly could. I think thats a phone call or two, but I think it needs to be looked into. From an engineering, structural standpoint, I mean, our Town takes care of that, well have an engineer required. BUCKLEY: Right. MILLER: But with those three things addressed Im looking forward to seeing a project like this in Town. I think its a great place to put it and a high-profile location. BUCKLEY: Joel, same thing? BROUS: Yep, already the same, I dont want to hold it up, instead of keep waiting and waiting I would like to try to pass something tonight, even with the conditionals, get the rating back but not hold up the process, I think its a good project. BUCKLEY: Right, I do as well. I think its a great location for it, like you say, its very visible and but we do, obviously, the same things that theyve all said we need the dBA rating, we need to know the installation, and if, Im sure in California, or maybe the one in North Carolina, you can grab a photo of, maybe theyll email you something to let us see how theyve installed those, and possibly get a check mark of what colors they did paint them, if it did make a difference in how it operated, because that was my concern with the Lucite panels that how does a bird know those are there, but I think thats a little bit of research that you need to follow-through on, and okay. So well go for a motion, and like I said, these will more than likely be conditions, but I dont do motions, so MILLER: I can try a motion. BUCKLEY: okay, you try one. MILLER: I just make a motion we approve based on Blaines, pardon me? BUCKLEY: You need any of these, or are you okay? MILLER: No, Im okay, based on staffs information and also added in that we need to have an accurate dBA rating for the three units, work- check into the colors so that its the least offensive thing we can put up there from bird standpoint and its a coastal version of birds not just a tree version, we have seagulls flying everywhere so; and then the structure, again, is something that the Town can work with. Anything else you want to add Lauren? TAYLOR: No, and I dont think it really, theres a bunch of birds that live in the trees next to, behind the Commander, same there. But I dont think any of them go that high. BUCKLEY: Can I get a second on the motion? Then well discuss it.

DearMrLebowitz, Ithasbeenourpleasureinworkingwithyoutoprovidenoiseandvibrationaltestingof theFTC10kWturbineassembly,andwelookforwardtoprovidingaccurate,reliable, andunbiasedmeasurementservicesforEnergyDynamicsLLCmovingforward. OnSiteAcousticTestingLLCperformedsitetestingoftheFTC10kWwindturbine locatedinItaly,TXonFebruary9th,2012from2and4PM.Temperaturethatdaywas approximately61degreesF,barometricpressurewas30.4,andwindspeedaveraged 5mph,withgustsinthemiddleteens. Theturbinewassituatedonthetopofageodesicdomewhichwasconstructedofa steelframe,withasteelskinnedpanelizedexterior.Typicallythiskindofstructurewill tendtoamplifynoise,duetoitsresonantanddiaphragmaticnature.Theturbineitself wasapproximately24'abovegroundlevel. Theareainwhichtheturbinewaslocatedwasinmediumproximity(lessthan500' feet)fromamoderatelyusedhighway,whichhadnormallevelsofvehiculartraffic. Thistrafficwasresponsibleforthemajoritynoiseinthearea,whichwasotherwise relativelyquiet. Weusedthe(sitecalibrated)RionNL31Type1IntegratingSoundLevelMetertotake avarietyofnoisemeasurementsinthevicinityoftheturbine,andwithina2500foot

radiusofthedevice.Additionally,vibrationalmeasurementsweretakeninsideand outsideofthedome,andonadjacentstructuresusingtheRionVM81.Testingwas donetoASTMandStateofTexasstandards. Results: Noiselevelsrangedfromalowof43dBAintheabsenceofvehiculartraffic,toahigh of54dBAinthevicinityoftheturbineunit.Comparisonofmeasurementstakenwithin the2500'radiusofthedeviceyieldednodifferencesbetweenareasclosetothe turbineunit,andthoseattheouteredgeoftheenvelope. Additionally,therewasnoperceptiblenoiseofanysortthatwasaudiblefromeither theground,noratapproximately10'offofthegroundthatwasattributabletothe turbineunit. Similarly,vibrationallevelsbothinsideandoutsideofthedome,andonadjacent structureswereunaffectedbytheoperationoftheturbine.Normalspikes(inthe vicinityof.35mm/s)werenotedwhenlargevehicleswouldpassbyontheroad, indicatingnormaloperationofthevibrationmeter. Conclusion: ItisouropinionthattheFTC10kWturbinewilloperatewithinvirtuallyanystandardfor noiseandvibrationallevel.Duringitsuseitislikelytobecompletelyimperceptibleat normaldistancesfromtheground. As for the size of the installation since we have changed the orientation of the turbines and enclosed then in a structure in keeping with the house The dimensions are approx 14ft wide X 5 high X 5ft deep this is based on 5ft 5

using 2 sections If Mario decides to add a 3 rd section it would increase the width to 20ft Final dimensions will be
determined after architectural drawings are done
The question of bird safety has been answered by the orientation change Wire mesh will line the inside of the structure Thus making it not possible for a bird to get near the turbines

We are also down two one generator with either 2 or 3 sections Not the three independent generators as before
Color isno longer an issue The structure will match the house
