The parties have discussed how best to comply with the order, and Plaintiff National Organization for Marriage, Inc. (NOM), continues to appreciate Defendants offer to handle the paper filing. 1

NOM advised Defendants on March 7 that it wants to file only file-stamped documents. 2 NOM re-iterated its preference for file-stamped documents on March 14 and 15. 3 The file stamp will make it clear that these were the documents that were filed. It will also be clear to the public which publicly released documents were and were not filed under seal. NOM does not want to give anyone the (mis)impression that it produced the sealed documents other than with an agreement with Defendants that they be filed under seal. 4 While NOM appreciates that the Courts CM/ECF system itself makes filestamped versions of sealed documents available only internally to Court personnel, Melody of the clerks office helpfully offered to e-mail Defendants file-stamped copies of documents they filed under seal. 5 Today Defendants raised their disagreement over filing only file-stamped copies. 6 NOM submits their reasons are not persuasive. 7 In any event, they do not outweigh the advantages of filing only file-stamped copies. 8

Randy You are actually filing the sealed documents now pursuant to a COURT ORDER, not an agreement, so your argument makes no sense to me. The court has ordered us to submit the stipulated record in paper form. It did not specify that any of the documents should have file stamps on them reflecting the previous filing. In footnote 4 of its decision on the merits, upheld on appeal, the court stated that the parties must re-file the trial evidence as unsealed documents. It would be contrary to that order, in our view, to re-file them now with a Sealed Document stamp on the top of each page. We have already put significant staff time and cost into printing off all the documents to be filed, and redacting the bank account information pursuant to Rule 5.2. I see no reason why we should ask Melody Whitten to send us different versions so that we can repeat all of that work. Would NOM like to reimburse the state for these costs? Ive attached my draft cover letter to the court which makes clear which documents were previously filed under seal. The court can keep this on file with the trial record, so that the public will know. I think that is as much as we can or should do. --Phyllis

Dear Randy, We have printed out a paper copy for the court of all of your documents (the plaintiffs evidence), and they look fine. We have also collected all of the documents listed on the Stipulated Record index (Docket Item 157) as Defendants evidence and are now in the process of redacting bank account numbers in the deposition transcript pages where they appear. I also noticed, however, that our copy of NOM Deposition Exhibit 25 (National Organization for Marriage Board Update 2008-2009) has a redaction on the 10th page (the pages are not numbered). I recall that we asked Josiah Neeley to provide us with an unredacted page of this at some point during the discovery process, but rather than spend a lot of time searching for it, I thought it would be simpler to ask if you could send us that unredacted page. Ive attached a copy of the redacted document here for your reference. Tomorrow morning (as early as possible), we should be able to send you pdfs of all our documents so that you can check them over before we file anything with the court.
