Dear Sir, Under the instructions and on behalf of Sh. Radey shyam kashyap(Workmen) S/o Late Sh. Ram Karan Kashyap , I hereby serve you with the following legal demand notice :

That my client were/are employee of your corporation since 1987 and my salary was 5550/- per month. That keeping in view the past relations with you, my client agreed to give a friendly loan of Rs. 1,60,000/- and accordingly, my client gave a sum of Rs. 1,60,000/- cash to you as friendly loan for the period of one month. That as agreed, in the month of January 2010, my client asked you to repay the loan amount but you started showing your financial crises and promised to repay the loan amount in the next month and my client agreed for the same. That in the next month i.e. February 2010, my client again asked you to repay the loan amount and at this time, in discharging the aforesaid liability, you issued four cheques bearing no. 686709, 686710, 686700 & 686705 all dated 10/03/2010 drawn on Standard Chartered Bank, Saket, New Delhi-17, amounting of Rs. 40,000/- each, all dated 10/03/2010 drawn on Standard

-2Chartered Bank, Saket, New Delhi-17 and requested my client to present the aforesaid cheque after 10th of March 2010 and you also assured my client that the aforesaid cheuqes would be encashed at the time of their presentation. 5. That at the assurances made by you, my client presented the aforesaid cheques for their encashement but to the utter surprises to my client the aforesaid cheques returned unpaid due to the reason payment stopped by drawer and immediately thereafter my client contacted you and appraised with the return of aforesaid cheques unpaid and on that you told my client as you were not having sufficient balance in your account, therefore you got stopped the payment of aforesaid cheque and you requested my client to present the aforesaid cheques after some and also assured my client that this time the aforesaid cheques would be encashed at the time of their presentation. That my client again presented the aforesaid cheques for their encashment but again aforesaid cheques returned unpaid with the remark payment stopped by drawer vide cheque return memo dated 05/09/2010. That thereafter my client tried his level best to contact you but every time you avoided the same and neglecting to repay the loan amount to my client. That by issuing the aforesaid cheques in favour of my client despite having knowledge that you are not having sufficient balance in your account and therefore with malafide and bad intention, you got stopped the payment of the aforesaid cheques, thereby you have cheated and defrauded my client and also committed the offence under section 138 of Negotiable Instrument Act. I hereby call upon you to make the payment of the aforesaid cheques 686709, 686710, 686700 & 686705 all dated 10/03/2010 drawn on Standard Chartered Bank, Saket, Delhi, to my client within 15 days from the date of receipt of this present legal notice, failing which my client shall be advised to initiate legal action (civil as well as criminal) against you, entirely at your risks and costs.
