Die TECHART Karosserieverbreiterung um sechs Zentimeter an der Hinterachse prsentiert sich wie aus einem Guss, was nicht zuletzt der Tatsache zuzuschreiben ist, dass die nahtlos mit der Karosserie verschweiten und verzinnten Kotflgelaufstze aus dem gleichen feuerverzinkten Blech wie die Serienkarosserie gefertigt werden.

Auf Basis des Porsche 911 Carrera (996) wurde ein Technik- und Design-Programm entwickelt, das neue Mastbe setzt. Mit der Zielsetzung die charakteristischen Linien des legendren "Elfers" wieder aufzunehmen, wurden die Karosserieabmessungen in der Lnge gekrzt und in der Breite erweitert. Der langgezogenen Karosserieform des 996 wurden somit die Attribute seines Vorgngers wiederverliehen, die ihn so einzigartig und faszinierend machten - z.b. die berhmte Taille an den hinteren Kotflgeln. Die TECHART Widebody Karosserieteile werden aus hochfestem Fiberflex Compound hergestellt, ein Werkstoff der auch im Flugzeugbau eingesetzt wird. Die aerodynamisch gestylte Frontschrze, die Kotflgelverbreiterungen vorn, die Kotflgel hinten mit integrierten Luftkanlen und Spoilerlippe, die Heckschrze und der optionale Heckflgel,

TECHART is taking the classic Porsche style to a new dimension with the all new TECHART Widebody. Based on the latest Porsche 911 (996), TECHART set out to continue the characteristic lines of the original style by slightly shortening the body and significantly widening it. The dramatic rear arches are reminiscent of the glorious past versions which created the legend in the first place.The TECHART wide body conversion is manufactured from the high tensile composite material FiberFlex, originally developed for aerospace applications. All components are heat treated and feature a special "softcode" surface. Every part is a precise fit, assuring easy installation. The aerodynamically styled front bumper spoiler increases down force on the front axle. The air intakes improve airflow to the radiators. The recess in the mid section of the front spoiler is designed to optimize undercarriage aerodynamics. The front fenders are flared and slotted towards the rear for better ventilation of the brake system. The side skirts tie the front fenders to the rear body section. The rear fenders with air intake scoops and spoiler house 11" wide light alloy wheels, extending the car`s width to over 6 feet. A rear apron integrates cut-outs for oval shaped, highly polished exhaust tailpipes. The optional rear wing continues the lines of the extended rear fenders providing down force for high speed driving stability. Utilizing specially developed dampers, springs and sway bars, the vehicle`s handling gains in responsiveness without sacrificing ride quality.

The latest, most powerful TECHART Performance Kit for the water-cooled six-cylinder boxer motor includes a high-performance exhaust with a specially designed header, a sport-air filter and a modified ECU. After the installation, which can be performed directly at TECHART or any other authorized TECHART center, the output and torque are both improved. Driving performance will improve accordingly. The most important factor for every day driving, is the increased torque creating an even more agile and responsive engine.

AUF DIE VORNEHME ART THE ART OF UNDERSTATEMENT

Ein schwarzes Armaturenbrett versprht einen Hauch von Zurckhaltung, die durch ein Ton-inTon gehaltenes Lenkrad nochmals unterstrichen wird. Die Besonderheit der Materialien ist dabei erst auf den zweiten Blick zu erkennen. Auf dieser Basis fhren gekonnt gesetzte Farbakzente zu einer besonderen Spannung. Das Blau der Armaturenblende wird durch die lederbezogene Leiste im Armaturenbrett aufgegriffen. Ergnzungsleder in Bereichen der Mittelkonsole fhren den Spannungsverlauf fort. Die Aluminiumteile geben Frische.
A back dash emanates a sense of understatement, which is further underlined by the color coordinated steering wheel. The quality and workmanship is immediately recognizable. Skillfully placed color accents create just the right visual tension. The blue of the dash cover is picked up by the leather cladding. Additional leather in the area of the center console continues the line. And the aluminum pieces give the whole ensemble a refreshing look.

I.Geltung Die nachstehenden Allgemeinen Geschftsbedingungen gelten fr alle Angebote, Vertrge, Lieferungen und sonstigen Leistungen einschlielich Beratungsleistungen, Ausknfte und hnliches. Abweichende Bedingungen des Bestellers, die wir nicht ausdrcklich schriftlich anerkennen, sind fr uns nicht verbindlich, auch wenn wir ihnen nicht ausdrcklich widersprechen. Fr alle mit uns abgeschlossenen Vertrge gilt das Recht der Bundesrepublik Deutschland. II.Angebot und Autragserteilung Unsere Angebote sind stets freibleibend. Die in Katalogen, Prospekten, Anzeigen und Preislisten oder in dem zum Angebot gehrenden Unterlagen enthaltenen Preise und technischen Daten knnen sich ndern. Vertragsabschlsse kommen erst durch unsere schriftliche(s) Angebot/Auftragsbesttigung/Rechnung zustande. Die Preise gelten fr 3 Monate ab Datum der Auftragsbesttigung/Rechnung. Bei allen Preisangaben ist die jeweilige gesetzlich vorgeschriebene Umsatzsteuer zu beachten. Sind lngere Lieferfristen vereinbart, so werden unsere am Liefertag gltigen Preise verrechnet. IlI.Lieferung und Lieferverzug Liefertermine oder Lieferfristen knnen verbindlich oder unverbindlich vereinbart werden; sie mssen in jedem Fall schriftlich von uns besttigt sein. Hhere Gewalt, Streiks, technische nderungen oder unverschuldetes Unvermgen bei uns oder unseren Lieferanten verlngern die Lieferzeit um die Dauer der Behinderung. Bei unverbindlichen Lieferterminen oder Lieferfristen kann uns der Besteller 6 Wochen nach der berschreitung schriftlich auffordern, in angemessener Zeit zu liefern. Mit dieser Mahnung geraten wir in Verzug. IV.Zahlungsbedingungen 1. Die Berechnung erfolgt in EURO zu den am Tag der Lieferung gltigen Preisen, ab LeonbergHfingen. Verpackungs- und Frachtkosten werden, sofern nicht anders vereinbart, zustzlich berechnet. Der Versand an Privatkunden erfolgt ausschlielich gegen Nachnahme oder Vorkasse. 2. Nachlsse oder Skontierungen sind ohne schriftliche Genehmigung nicht mglich. 3. Verzugszinsen werden mit 3% p.a. ber dem Diskontsatz der Deutschen Bundesbank zzgl. gesetzlicher MwSt. berechnet. Werden zustzliche Kosten, Bankspesen usw. nachgewiesen, so knnen diese an den Auftraggeber weiterberechnet werden. 4. Wird bei Auftragserteilung eine Vorauszahlung vereinbart, so ist diese vor Arbeitsbeginn zu leisten. Die Zurckhaltung von Zahlungen fr Gegenansprche des Bestellers oder der Aufrechnung mit solchen ist nur zulssig, wenn die Gegenansprche von uns ausdrcklich anerkannt oder rechtskrftig gerichtlich festgestellt sind. V.Gefahrenbernahme und Abnahme Alle Sendungen und etwaige Rcksendungen erfolgen auf Rechnung und Gefahr des Bestellers. Die Gefahr geht gem. 447 Abs.1 BGB auf den Besteller ber, sobald wir die Ware dem Spediteur usw. bergeben haben. Dies gilt auch fr Sendungen innerhalb unseres Erfllungsortes LeonbergHfingen. Wenn wir die Ware mit eigenen Fahrzeugen versenden, geht die Gefahr beim Verladen auf den Besteller ber. Verweigert der Besteller die Annahme einer ihm zugesandten Ware, so sind wir zur nochmaligen bersendung nicht mehr verpflichtet. Wir sind dann berechtigt, dem Besteller eine Frist von 14 Tagen zur Abholung der Ware bei uns zu setzen und den Rcktritt vom Vertrag anzudrohen. Holt der Besteller die Ware in der gesetzten Frist nicht bei uns ab, sind wir berechtigt, den Rcktritt vom Vertrag zu erklren und wegen Nichterfllung Schadenersatz zu verlangen, und zwar bei Fahrzeugen 15% und bei Teilen und sonstigen Leistungen 20% vom Brutto-Rechnungsbetrag, ohne dass wir die Hhe des uns entstandenen Schadens nachweisen mssen. Dieser Schadenersatz besteht nicht, soweit der Besteller nachweist, dass uns ein Schaden berhaupt nicht oder nicht in der Hhe der Pauschale entstanden ist. Wir sind immer berechtigt, unseren ber die Pauschale hinausgehenden Schaden geltend zu machen. Die vorstehende Schadenersatzregelung gilt auch, wenn von vornherein Abholung bei uns vereinbart ist - also keine Versendung erfolgen soll - und wir eine Abholfrist von 14 Tagen mit Kndigungsandrohung gesetzt haben. Vl.Eigentumsvorbehalt Die Ware bleibt unser Eigentum bis zur Bezahlung unserer smtlichen Forderungen gegen den Besteller, gleich aus welchem Rechtsgrund, bis zur Einlsung smtlicher uns in Zahlung gegebener Wechsel und Schecks, auch wenn der Kaufpreis fr besonders bezeichnete Forderungen bezahlt ist. Bei laufender Rechnung gilt das vorbehaltene Eigentum als Sicherung fr unsere Saldoforderung. Ein Eigentumserwerb des Bestellers an der Vorbehaltsware im Falle der Verarbeitung ( 950 BGB) ist ausgeschlossen. Eine etwaige Verarbeitung nimmt der Besteller fr uns vor. Die neue Sache dient zur Sicherung jedoch nur in der Hhe des Wertes der Vorbehaltsware. Bei Verarbeitung mit anderen, uns nicht gehrenden Waren steht uns das Miteigentum an der Sache zu, und zwar im Verhltnis des Wertes der Vorbehaltsware zu dem der anderen verarbeiteten Ware. Die neue Sache gilt als Vorbehaltsware im Sinne dieser Bedingungen. Die Forderungen des Bestellers aus dem Weiterverkauf der Vorbehaltsware werden bereits jetzt an uns abgetreten und zwar gleich, ob die Vorbehaltsware ohne oder nach der Verarbeitung an einen oder mehrere Abnehmer weiterverkauft wird. Die abgetretene Forderung dient unserer Sicherung nur in der Hhe des Wertes der jeweils verkauften Vorbehaltsware. Fr den Fall, dass die Vorbehaltsware vom Besteller zusammen mit anderen uns nicht gehrenden Waren, sei es ohne, sei es nach der Verarbeitung verkauft wird, gilt die Abtretung der Kaufpreisforderung nur in Hhe des Wertes der Vorbehaltsware. Der Besteller ist zur Weiterveruerung der Vorbehaltsware nur unter der Bedingung ermchtigt, dass die Kaufpreisforderung aus dem Weiterverkauf auf uns bergeht. Zu anderen Verfgungen ist er nicht berechtigt. Der Besteller ist zur Einziehung der Forderung, jedoch nicht zu anderen Verfgungen ber die Forderung, insbesondere nicht zur Abtretung ermchtigt. Solange er seinen Zahlungsverpflichtungen ordnungsgem nachkommt, werden wir von der uns zustehenden Einziehungsbefugnis keinen Gebrauch machen. Auf Verlangen hat der Besteller die Schuldner der abgetretenen Forderungen mitzuteilen und ihnen die Abtretung anzuzeigen. Nach vollstndiger Bezahlung aller unserer Forderungen aus der Geschftsverbindung geht das Eigentum ohne weiteres auf den Besteller ber, auch die abgetretenen Forderungen stehen ihm wieder zu. Die uns nach vorstehenden Bestimmungen zustehenden Sicherungen sind von uns - nach unserer Wahl - insoweit freizugeben, als ihr Wert die zu sichernden Forderungen um 20% bersteigt (jedoch mit der Magabe, dass mit Ausnahme der Forderungen im echten Kontokorrentverhltnis eine Freigabe nur fr solche Lieferungen oder deren Ersatzwerte zu erfolgen hat, die selbst voll bezahlt sind). Fr die Dauer unseres Eigentumsvorbehalts hat der Besteller uns von allen Vollstreckungsmanahmen, die sich gegen die Kaufsache in unverarbeitetem oder verarbeitetem Zustand oder gegen die im Wege des verlngerten Eigentumsvorbehalts sicherungshalber abgetretenen Forderungen richten, unverzglich zu benachrichtigen. Der Besteller hat fr den Fall einer Zwangsvollstreckung alle erforderlichen Manahmen sofort zu treffen, um eine Beeintrchtigung unserer Interessen und Rechte zu verhindern. Die Kosten etwaiger Interventionen trgt der Besteller. Bei Zahlungseinstellung ist der Besteller verpflichtet, die von uns gelieferten und noch vorhandenen Waren auszusondern und uns eine genaue Aufstellung einzureichen. Die Rcknahme der Eigentumsvorbehaltware durch uns gilt nur dann als Rcktritt vom Vertrag, wenn der Rcktritt ausdrcklich erklrt wird. Vll.Pfandrecht Wegen smtlicher Forderungen an den Besteller, steht uns ein vertragliches Pfandrecht, auch an anderen, vom Besteller uns bergebenen bzw. in unseren Besitz gelangten Gegenstnde zu. Vlll .Haftung Schadenersatzansprche irgendwelcher Art, insbesondere solche aus Verzug, Unmglichkeit der Leistung, positiver Forderungsverletzung, Verschulden bei Vertragsabschlu und aus unerlaubter Handlung sind ausgeschlossen, soweit der Schaden nicht durch vorstzliches oder grob fahrlssiges Handeln unsererseits verursacht wurde. Das Risiko einer Probefahrt geht zu Lasten des Bestellers. Soweit unsere Haftung in Frage kommt, kann nur Geldersatz bis zur Hhe des Zeitwertes veranlagt werden. IX.Gewhrleistung 1. Sind von uns gelieferte Teile mangelhaft, behalten wir uns vor, diese durch Neue zu ersetzen oder nachzubessern. Diese Gewhrleistung ist, sofern nicht anders schriftlich vereinbart, auf 6 Monate ab bergabe befristet. Voraussetzung fr die Haftung sind fehlerhafte Bauart oder mangelhafte Ausfhrung. Fr Materialmngel haften wir nur insoweit, als wir bei Anwendung fachmnnischer Sorgfalt die Mngel htten erkennen mssen. Die Gewhrleistung ist ausgeschlossen, wenn a. der Kufer bereits eigenmchtige Nachbesserungsarbeiten durchgefhrt hat; b. die gelieferten Teile in Motorsportwettbewerben eingesetzt werden. Fr Rennteile, die kurzlebige Hochleistungsprodukte sind, beschrnkt sich unsere Gewhrleistungspflicht auf eine dem jeweiligen Stand der Technik entsprechende Fehlerfreiheit im Werkstoff des fabrikneuen Teils zum Zeitpunkt der bergabe. 2. Fr neue Motoren, die gegenber dem Serienstand leistungsgesteigert sind, geben wir eine Gewhrleistung fr die Dauer von 12 Monaten ohne km-Begrenzung ab dem Tag der Auslieferung. Diese Gewhrleistung erstreckt sich bei Neufahrzeugen auch auf die Teile der Kraftbertragung. Fr gebrauchte Motoren, die leistungsgesteigert sind, geben wir eine Gewhrleistung auf den gesamten Motor bis zu einem Gesamtalter von 12 Monaten. Fr gebrauchte Motoren, die leistungsgesteigert und lter als 12 Monate sind, geben wir eine Gewhrleistung von 6 Monaten auf die von uns genderten Teile und Arbeiten. Bei Teilnahme an motorsportlichen Wettbewerben erlischt die Gewhrleistung. lverbruche mssen nicht den des Fahrzeugherstellers angegebenen Werten entsprechen, sie drfen bei leistungsgesteigerten Motoren bis zu 30% darber liegen. Alle Teile, die Gegenstand eines Gewhrleistungsfalles sind, mssen uns kostenlos zugestellt werden. 3. Bei leistungsgesteigerten Neufahrzeugen bernehmen wir Gewhrleistung fr die Dauer von 12 Monaten ohne km-Begrenzung ab dem Tage der Auslieferung. Die Gewhrleistung umfasst die Teile, die - abweichend von der Serienfertigung - Gegenstand des Austauschs oder der Bearbeitung waren und darber hinaus Teile des Fahrwerks und der Kraftbertragung. Fr leistungssteigernde Manahmen an Gebrauchtfahrzeugen gelten die Kraftfahrzeug- Reparaturbedingungen - empfohlen vom Zentralverband des Kfz-Handwerks, Bonn - (werden auf Wunsch von uns zugesandt), jedoch erstreckt sich unsere Gewhrleistung hier nur auf die von uns verbauten oder bearbeiteten Teile des Fahrwerks und der Kraftbertragung. Die Gewhrleistung beschrnkt sich auf die Wiederherstellung der Funktionsfhigkeit des fehlerhaften Teils. 4. Natrlicher Verschlei oder Beschdigungen, die auf schuldhafte oder unsachgeme Behandlung zurckzufhren sind, z.B. Fahren ohne Motorl, fallen nicht unter unsere Gewhrleistungspflicht. Ansprche auf Beseitigung von Mngeln, die unter Gewhrleistung fallen, werden von uns nur anerkannt, wenn sie binnen 14 Tagen nach Feststellung schriftlich angezeigt werden. Gewhrleistungsarbeiten werden ausschlielich in unserer Werkstatt oder bei durch uns genannten autorisierten Partnern durchgefhrt. Dabei ausgetauschte Teile mssen uns zur Begutachtung zugesendet werden und gehen in unser Eigentum ber. Instandsetzungsarbeiten kleineren Umfangs knnen mit unserem schriftlichen Einverstndnis auch in einer anderen Fachwerkstatt ausgefhrt werden. 5.Die Gewhrleistung erlischt wenn a.die im Fahrzeug-Kundendienstheft vorgesehenen Wartungsarbeiten nicht oder nicht ordnungsgem durchgefhrt werden, b.die Vorschriften der Betriebsanleitung miachtet werden, c.das Fahrzeug bei Wettbewerbsfahrten eingesetzt wird, d.das Fahrzeug in von uns nicht genehmigter Weise technisch verndert wird. Ansprche auf Wandelung oder nderung des Kaufvertrages oder Minderung des Kaufpreises sind ausgeschlossen, wenn wir unsere obige Gewhrleistung erfllen. X.Altteile Aus Fahrzeugen ausgebaute Teile (Original-oder Altteile) sind vom Besteller innerhalb einer Frist von 4 Wochen zu bernehmen. Fr eine ber diesen Zeitraum hinausgehende Lagerung bernehmen wir keine Gewhr. Eine Wiederbeschaffung ist ausgeschlossen. Diese Regelung gilt nicht bei Teilen die verrechnet werden oder in sonstiger Weise in das Eigentum von uns bergehen. Xl.TV-Abnahme Ein Anspruch des Bestellers auf TV-Eintragung in den Kraftfahrzeugbrief besteht grundstzlich nur bei dem TV, der den Musterbericht erstellt hat. Xll.Erfllungsort und Gerichtstand Wenn der Besteller ein Vollkaufmann ist, gilt Leonberg als Erfllungsort und als Gerichtsstand fr alle Streitigkeiten aus diesem Vertrag zwischen dem Besteller und uns. Der gleiche Gerichtsstand gilt, wenn der Besteller keinen allgemeinen Gerichtsstand im Inland hat, nach Vertragsabschlu seinen Wohn-bzw. Firmensitz oder gewhnlichen Aufenthaltsort aus dem Inland verlegt oder sein Wohn-bzw. Firmensitz oder gewhnlicher Aufenthaltsort zum Zeitpunkt der Klage nicht bekannt sind. Xlll.Lieferungen ins Ausland Die vorstehenden allgemeinen Geschftsbedingungen gelten auch fr Lieferungen ins Ausland. I. Scope The following General Terms and Conditions of Trade apply to all offers, contracts, deliveries and other services, including consultancy, information and similar services. Diverging conditions of the party ordering that we do not expressly acknowledge in writing shall not be binding for us even if we do not expressly contradict them. All contracts concluded with us are subject to the law of the Federal Republic of Germany. II. Offer and Conclusion Our offers are always made without obligations. The prices and technical specifications stated in catalogues, prospectuses, advertisements and price lists or in the documents enclosed with the offer may be subject to changes. Contracts are only concluded by means of our written confirmation of the order. The prices are valid for 3 months as from the date of the confirmation of the order. The legally fixed V.A.T. must be taken into account with regard to all price indications. In case longer delivery periods are agreed, we will charge the prices valid on the day of delivery. III. Delivery and Delay in Delivery Dates or periods of delivery can be agreed bindingly or not bindingly; in any case, they must be confirmed by us in writing. Force majeure, strikes, technical changes or not culpable inability on our side or on the side of our suppliers will prolong the period of delivery by the period of the obstruction. Eight weeks after the exceeding of a not binding date or period of delivery, the party ordering shall be entitled to demand in writing that we deliver within reasonable time. Receiving such demand, we will get into default. IV. Terms of Payment The charging is done in EURO on the basis of the prices valid on the day of delivery, ex LeonbergHfingen. Unless otherwise stipulated, packaging and freight costs are charged in addition. Private customers are exclusively supplied against cash on delivery or advance payment. The retention of payments for counterclaims of the party ordering or for offsetting them against such counterclaims shall only be permissible when the counterclaims have been expressly acknowledged by us or recognized by declaratory judgment. V. Assumption of Risk and Acceptance All consignments or possible return consignments of articles shall be made for the account and at the risk of the party ordering. According to 447 subpara. 1 BGB (German Civil Code), the risk passes to the party ordering as soon as we have handed the article over to the forwarder etc. The same applies to consignments within our place of performance Leonberg-Hfingen. In case we send the article with own vehicles, the risk passes to the party ordering when the article is loaded. If the party ordering rejects to accept articles consigned to him, we are not obliged to consign them a second time. In such case, we are entitled to give the party ordering a time limit of 14 days to collect the article from us and to threaten with the rescission of the contract. If the party ordering does not collect the article during the set time limit, we are entitled to declare the rescission of the contract and to claim damages for non-performance, i.e. in the case of vehicles 15% and in the case of parts and other services 20% of the gross amount of invoice, without being obliged to prove the amount of the loss we have incurred. Such damages shall not exist if the party ordering proves that we have incurred no loss at all or no loss to the amount of the lump sum. We are always entitled to claim our damage exceeding the lump sum. The above damage regulation is also valid when collection from us was agreed from the outset - i.e. there was no forwarding to take place - and we set a collecting deadline of 14 days under the threat of rescission. VI. Reservation of Title The article shall remain our property until the payment of all of our claims against the party ordering, for whatever legal grounds, until the payment of all bills and cheques given to us in part exchange, even if the purchase price for individually designated claims has been paid. With current accounts, the reserved property shall be regarded as security for our claim of balance. The acquisition of the ownership in the reserved article in the case of a processing ( 950 BGB) is excluded. The party ordering does such processing for us. The new product, however, shall serve as security only to the amount of the value of the reserved article. In case of a processing with other articles that we do not own, we shall be entitled to a co-ownership in the product, i.e. in the proportion of the value of the reserved article to the value of the other articles processed. The new product shall be regarded as the reserved article within the meaning of these terms. The receivables due to the party ordering from the further sale of the reserved article is assigned to us already now, regardless of the question whether the reserved article is resold, whether without or after the processing, to one or several buyers. The assigned claim shall serve as our security only to the amount of the value of the reserved article respectively resold. In case the reserved article is sold by the party ordering together with other goods that we do not own, whether without or after the processing, the assignment of the purchase price receivable shall apply only up to the amount of the value of the reserved article. The party ordering shall be entitled to resell the reserved article only on the condition that the purchase price receivable from the resale is assigned to us. He shall not be entitled to make other dispositions. The party ordering shall be entitled to collect the receivables, but not to dispose otherwise of them, in particular not to assign them. As long as he duly performs his obligations to pay, we will not make use of the right of collection we are entitled to. Upon request, the party ordering has to indicate the debtors of the assigned claims and to inform them of the assignment. After the complete payment of all of our claims under the business relationship, the ownership shall pass directly to the party ordering and he shall also be entitled to the assigned claims again. The securities due to us according to the above terms shall be - at our choice - released by us as far as their value exceeds the claims to be secured by 20 % (however, provided that, with the exception of the claims in the real current account relation, a release shall only be made with regard to such deliveries or their replacement values that have been fully paid). During the time of our reservation of title, the party ordering shall be obliged to inform us immediately of all enforcement measures directed against the object of sale, whether in an unprocessed or processed state, or against the claims assigned as security by way of an extended reservation of title. In the case of an enforcement, the party ordering has to take immediately all necessary measures to avoid detriments to our interests and rights. The party ordering bears the costs of possible interventions. In the case of cessation of payments, the party ordering shall be obliged to separate still existing articles delivered by us and to give us an exact list of them. Our taking back of the reserved articles shall be considered as a rescission of the contract only when the rescission is expressly stated. VII. Right of Lien Because of our claims under the order, we are entitled to a contractual right of lien on the items we have taken possession of due to the order. The contractual right of lien can also be asserted with regard to claims from previously executed work, spare part deliveries and other services as far as they are connected with the subject of the order. With regard to other claims against the party ordering, the contractual right of lien shall apply only as far as such claims have not been contested or have been established by court. VIII. Liability Claims for compensation of any kind, in particular such resulting from delay, impossibility of perform-ance, positive breach of an obligation, culpa in contrahendo and from unlawful acts are excluded, unless the damage was caused intentionally or by gross negligence on our side. The risk of a test drive shall be borne by the party ordering if the car is driven by himself or by his representative during the test drive. As far as our liability is applicable, only a monetary compensation up to the amount of the present market value can be demanded. IX. Guarantee 1. If parts delivered by us are defective, we reserve to replace such parts by new ones or to repair them. This guarantee is restricted to a period of 6 months as from the day of delivery. A defective design or a faulty workmanship are the precondition for liability. As to faulty materials, we are only liable insofar as we should have detected the defects by applying professional care. The guarantee is excluded when: a. the buyer has already executed arbitrary repair works; b. the delivered parts are used in motor sport competitions. For racing parts which are short-lived high performance products our guarantee obligation is limited to a faultlessness of the material according to the present state of technology - of the part fresh from the factory at the time of delivery. 2. For new motors with an increased output in comparison with the serial standard, we give a guarantee for a period of 12 months as from the day of delivery, without km-limit. In the case of new vehicles, that guarantee includes the transmission parts as well. For used motors having an increased output, we give a guarantee for the entyre motor up to an overall age of 12 months. For used motors having an increased output that are older than 12 months, we give a guarantee of 6 months on the parts changed by us and the work executed. In the case of a participation in motor sport contests, the guarantee shall be extinguished. The consumption of oil is not required to correspond to the values indicated by the car manufacturer; for motors having an increased output, it may be up to 30% higher. All parts that are subject to a guarantee case must be delivered by us free of charge. 3. For new vehicles with an increased output, we give a guarantee for a period of 12 months as from the day of delivery, without km-limit. The guarantee includes the parts which - departing from the serial production - have been subject to a replacement or a reworking and, in addition, parts of the chassis and the transmission. Output increasing measures in used vehicles are subject to the Conditions of Motor Vehicle Repair (Edition of 9 March 1977); here, however, our guarantee includes only the parts of the chassis and the transmission that we have mounted or reworked. The guarantee is limited to restoring the operativeness of the defective part. 4. Normal wear and tear or damages attributable to culpable or improper treatment, such as driving without engine oil, are not covered by our guarantee obligation. We only recognize claims for the removal of defects covered by the guarantee when they are notified in writing within 14 days after their detection. Guarantee work shall be carried out exclusively in our workshop or by authorized partners indicated by us. Parts replaced in such work must be sent to us for examination and pass into our ownership. With our approval in writing, smaller repair works can also be carried out by another specialized workshop. 5. The guarantee shall be extinguished if a. the maintenance work required in the service book of the vehicle is not carried out or not as required, b. the instructions of the operating manual are disregarded, c. the vehicle is used in contests, d. the vehicle is altered in a way we have not authorized. Claims to a rescission or alteration of the contract of sale or to a reduction of the purchase price are excluded when we fulfill our above guarantee. X. Old Parts Parts removed from vehicles (original or old parts) must be taken over by the party ordering within a period of 4 weeks. We do not guarantee a storage beyond that period of time. A replacement is excluded. That regulation does not apply to parts that are set off or otherwise pass into our ownership. XI. Inspection by the TV (Technical Control Association) On principle, a right of the party ordering to a TV-entry in the motor vehicle registration document exists only with the TV-office that has drawn up the model report. XII. Place of Performance and Place of Jurisdiction If the party ordering is a merchant entered in the commercial register, Leonberg shall be the place of performance and the place of jurisdiction for all disputes resulting from this contract between the party ordering and us. The same place of jurisdiction shall apply if the party ordering does not have a general place of jurisdiction within the country, if he transfers his place of residence or firm seat or his ordinary residence to a place abroad or if his place of residence or firm seat or his ordinary residence is unknown at the time of the law suit. XIII. Deliveries to Foreign Countries The above General Terms and Conditions of Trade apply also to deliveries to foreign countries. All legal matters resulting from the business relation are exclusively subject to German law and German place of jurisdiction. XIV. The Invalidity of Individual Provisions The invalidity of individual provisions shall affect neither the effectiveness of the Contract nor the remaining provisions.
