Law Enforcement If any officer wishes to question a student at school, a suitable place will be provided after the officer has presented proper identification. The principal/designee may be present during the interview at the request or authorization of the student. The conference area will be so located as to create as little attention as possible to the matter. If the officer decides to take the student from the school grounds, he/she will be permitted to do so only on the basis of a warrant of arrest, court order, or statement of the officer that he/she is placing the student under arrest or taking the student into custody. The officer shall be asked to sign an affidavit accepting custody for the student before removing him/her from the school grounds. Affidavit forms are available in the schools front office. The school shall make a reasonable effort in a timely manner to notify the parent(s)/guardian(s), when appropriate, that the student has been questioned or has been placed under arrest.

Non-Victim/Non-Witness Interviews/Suspect: When a law enforcement officer, an identified representative of the court on official business, or an identified Department of Children and Families representative makes a request to interview a student who is not a victim or witness of a crime or delinquent act or is not involved in a suspected childabuse case, the following steps shall be taken by the administrator or designee: 1. The parent shall be called and notified of the request. 2. If the parent objects to such questioning or if the parent cannot be contacted, the officer shall be requested to make arrangements for questioning the student at a later date when the parents or their representative can be present, unless a law officer has an investigative subpoena. 3. In the event an interview or interrogation takes place, the school administrator should request to be present in the room during the interview or interrogation.

Police Involvement in Searches and the Interrogation of Students If police are involved in the questioning of students on school premises, whether or not at the request of school authorities, it must be in accordance with applicable law and due process procedures. If deemed appropriate and or necessary, the Superintendent designee may confer with School

District legal counsel to address concerns and determine appropriate action. Administrators have the responsibility and the authority to determine when the assistance of law enforcement officers is necessary within their respective jurisdictions and shall at all times act in manner that protects and guarantees the rights of student and parents. Police officials have facilities in connection with police work. Police officials may enter school property or a school function to question or search a student or to conduct a formal investigation involving students only if they have: 1. A search or an arrest warrant; or 2. Probable cause to believe a crime has been committed on school property or at a school function; or 3. Been invited by school officials. Before police officials are permitted to question or search any student, the building principal or his or her designee shall first try to notify the students parent to give the parent the opportunity to be present during the police questioning or search. If the students parent cannot be contacted prior to the police questioning or search, the questioning or search shall not be conducted. The principal or designee will also be present during any police questioning or search of a student on school property or at a school function. Students who are questioning by police officials on school property or at a school function will be afforded the same rights they have outside of the school. This means: 1. They must be informed of their legal rights. 2. They may remain silent if they so desire 3. They may request the presence of an attorney.

General Procedures for Police The following general procedures should be followed whenever assistance from law enforcement agencies is required or if a representative of a law enforcement agency requests permission of school authorities to interview, interrogate, or apprehend a student. A. Non-School, Non-Emergency Related Issues 1) Preference for Off School Grounds - Interviews or interrogations of a non-school and nonemergency nature shall be conducted outside school hours and off school property whenever possible. 2) Principal Approval - If non-emergency, non-school related interviews or interrogations are

conducted on school property during school hours it must be with the approval of the principal or designee. Principals shall refer any disputes with police on these matters to the Superintendent or designee. If parent contact for permission is not able to be obtained or requested, the officer may proceed only if they deem the matter to be urgent or if it has the potential to move to an emergency status. 4) Information to School Authorities and the Interview with the Student - School officials shall be given a brief summary of the reasons for the interview or interrogation by the police. The principal shall open the conference by introducing the student to the representative of the law enforcement agency and will explain why the student has been called to the office. The principal shall be responsible for providing a place for the interview or interrogation that is as free as possible from outside influence, surveillance, and inappropriate stress on the student. The best interest of the child shall be paramount. 5) Protection of Class Time - All attempts to limit the interview/interrogation to non-class time shall be made (study hall, lunch, release time).

All staff members shall cooperate with law enforcement officials from city, village, county, State or Federal jurisdictions or other jurisdictions as determined appropriate by the Superintendent, principal or designee. 2. Whenever reasonable, law enforcement officials should contact/question students outside of school. When law enforcement officials question a student at school, the following procedures shall be observed: A. The meeting shall occur in a discreet location. B. Except as indicated in C below, an effort will be made to notify parents of the meeting between the police and student; however, if parents cannot be reached immediately by telephone at home or work, police may proceed to question a student without notification. C. In unique circumstances, the principal may not choose to notify parents of the questioning. Generally, a school official will be present during police questioning of a student;

however, police may question students without school personnel present if the Superintendent or principal and law enforcement officials agree that because of the nature of the case such questioning must be done in the absence of school officials. E. When the general questioning of a student at school for information gathering becomes accusatory in nature, in that the student being questioned is suspected of being implicated in a crime, then further questioning of the student should generally not proceed until parents have been notified, except in an emergency situation as determined by the Superintendent, principal or designee. F. Any court orders, valid subpoenas or search warrants shall be complied with by school personnel. 1) The decision to arrest or remove a student from school rests with the law enforcement officials only. When it is necessary to remove a student from school, law enforcement officials should notify the parent. If circumstances make it impossible for law enforcement officials to notify the parent, school personnel should attempt to notify the parents. 2) The violations listed below shall result in police notification. The decision of whether or not the police should meet with the student at school rests with the Superintendent, principal or designee in consultation with law enforcement officials: a) when the building administrator has reason to believe that a student has committed a felony; b) when the violation would constitute a felony, if the student were an adult; c) when a student possesses, transmits, uses or is under the influence of illegal drugs (including drug paraphernalia) or alcohol; d) to help determine if a youngster is under the influence of an illegal drug or alcohol as deemed necessary and e) other violations as determined appropriate by the principal or required by law. 3 of 4 Pickerington Local School District, Pickerington, Ohio File: JFG-REG In addition to the above circumstances, the principal/designee may request law enforcement officials to speak with students at school for counseling or preventive discipline purposes. In such cases, the parents shall be advised of such sessions, unless the principal/designee believes that parent involvement would not be in the best interest of the student.

If the police department needs to question a student, school officials have the responsibility of notifying the students parent or legal guardian regarding the questioning. The presence of the students parent/guardian at the time of the questioning is desirable to safeguard the self incrimination rights of the student. Whenever possible, the questioning should be conducted away from the school to avoid any display of law enforcement activities which can lead to unfortunate misunderstandings on the part of other students and members of the faculty.
