CHAPTER1 OVERVIEWOFTHEMANUAL
Extraditionhasalonganddistinguishedhistory.TheU.S.systemofextraditionisempowered bytheU.S.Constitutionandisadministeredunderapplicablefederalandstatelaw.InVirginia, theprovisionsgoverningextraditionproceduresaresetforthinSections19.2through19.2118 oftheCodeofVirginia(1950)asamended. Whiletheconceptofextraditioniseasilyunderstood,theprocedurestobefollowedinany particularextraditioncasecanbecomequitecomplex.Thisisduetothemyriadoflegalissues associatedwithextradition,thenumberofactorsinvolvedintheextraditionprocess,andthefact thateachextraditioncaseisunique.Thismanual isdesignedtohelpguidestateandlocal officialsthroughthisprocess. Themanualisdividedintofourdistinctbutinterrelatedparts.PartIisdesignedtoprovidethe readerwithanintroductiontoboththemanualandtotheextraditionprocessaspracticedwithin theCommonwealth. PartIIisconcernedwithlegalissues.Itcontainschaptersdealingwiththefollowingsubjects: sourcesoflaw,extraditableoffensesandtheinterstateagreementondetainers.Thispartis supplementedbyseveralappendices,whicharealsoconcernedwithlegalissues.AppendixA providesaseriesofsampleformats,whichcanbeusedbyVirginiaofficialsinperforming extraditionactions.AppendixCofthemanualcontainsrelevantexcerptsoftheCodeofVirginia, thedocumentwhichgovernsextraditionpracticewithintheCommonwealth.AppendixD providesdefinitionsoflegaltermsandacronymsassociatedwiththissubject. PartIIIofthemanualis,insomerespects,themostimportant.Withinitsfivechaptersare detaileddiscussionsoftherolesandresponsibilitiesofmajoractorsinvolvedintheextradition process.Actorsdiscussedinclude:lawenforcementofficials,magistrates,clerksofcourts, CommonwealthsAttorneysandjudgesofthedistrictandcircuitcourts. PartIVexaminesextraditioncaseswithrequirespecialconsideration.Discussedwithinthe twochaptersofthissectionaretheextraditionofjuveniles,parolees,fugitives,military personnel,NativeAmericansandotherspecialcases.ThissectionissupplementedbyAppendix B,whichoutlinesthespecialrequirementsofotherstates. Whilethismanualattemptstocoverthemyriadofissuesassociatedwithextradition, questionswillneverthelessarise.TheOfficeoftheSecretaryoftheCommonwealthwillgladly assistVirginiaofficialsinobtainingtheanswerstosuchquestions.Theofficecanbereachedat (804)7862441.
