Robert Paul Morris, amending his Complaint against Scenera Research LLC and Ryan C. Fry at paragraphs 73 and 74, and adding a paragraph 7 to the prayer for relief, alleges and says that: COUNT II Retaliatory Employment Discrimination (REDA) 73. 74. Paragraphs 1 through 72 of the Complaint are incorporated herein by reference. Morris filed an employment discrimination complaint with the Commissioner of

the North Carolina Department of Labor on August 21, 2009, asseliing that defendants fired

Morris in willful retaliation for threatening to file a complaint with the Department of Labor for

their refusal to pay wages due; Morris received his "Right-to-Sue Letter" under the North Carolina Retaliatory Discrimination Act (REDA), on February 23, 2010; Morris has complied with all conditions precedent by statute for pursuit of his REDA claims; and Morris is entitled to compensation for lost wages, lost benefits and other economic losses, and to have those damages trebled along with an award of attorneys fees for defendants' willful violation of G.S. 95-241, all pursuant to G.S. 95-243.

WHEREFORE, Mr. Morris respectfully prays this Court: 7. For lost wages, lost benefits, economic losses; for trebling of those damages; and

for costs and expenses including attorneys fees under G.S. 95-243.
