The Republic of Dasoi is a tropical country in South Asia and is one of the fastest growing economies in the world.

Dasoi has a largely rural population which is primarily dependant on agriculture. There are two major political parties, the Radical Organisation for Freedom and Liberty Party (ROFL) and the Labour Organisation Leadership Party (LOL), constantly at logger-heads with each other, forming governments at the Centre almost alternatively but even with all the political tussle, the environmental policy of the country has been largely uniform and pro environment. Republic of Dasoi is rich in natural resources with large mineral deposits and forest cover. The country has one of the longest coastlines in the world, extending to almost 7500 kms with rich marine flora and fauna. In recent times, the economic boom and industrial activity has resulted in a major power shortage with the entire nation in a power crisis. The State-run electricity Boards in almost all the states of Dasoi had scheduled power cuts ranging between 2-8 hours a day. These power cuts severely affected the industries and thereby, the investments that came into Dasoi. The ROFL has been in power since March 2005 and in their election campaigns, had promised to reduce power cuts, if not completely stop the scheduled cuts by use of nuclear power. In June 2005, the Government took a policy decision to set up a nuclear power station in Bondavi District of Brinji state and also set up mining activities in Pakodavi district in Brinji state, which had rich uranium ore deposits, using open pit and underground mines for extraction. The electricity generated by nuclear activity in Dasoi at that time was less than 2% and the Central Government promised a ten-fold increase on the said figure. The decision of the Government came at a time when most countries were in the process of phasing out nuclear energy in light of several nuclear disasters. The Central Government then set up a Joint High-Level Expert Committee to study the technical, scientific, environmental and economic feasibility of the project. All the members of the Committee were of exemplary repute in their respective fields but had at some point in their careers, served with the Government under the ROFL regime earlier. The Committee submitted its report within a short span of 2 months and recommended that the project be implemented. However, one of the panel experts had raised an issue that the project might harm the forests, fresh water and sensitive coastal ecosystem as the power plants were scheduled to come up along the coast but further added that the said problems can be taken care of by planting trees around the proposed power plants and treating the water used for cooling in the plant. The Government claimed that the plan for the nuclear project was path-breaking and the technology used in these plants were fail-safe and designed to alleviate the dangers of the earlier nuclear disasters around the world. The Government then set up the plants and the construction of the same was immediately commenced. Gaya, an NGO primarily working for tribal upliftment, filed a Writ Petition through its President, Chitti, before the Supreme Court of Dasoi against the decision of Government to set up uranium mines and nuclear plants, on various grounds including threat to environment and life and a subsequent direction for clean energy practices to be adopted by Dasoi. The writ was pending in admission stage itself and the Government was directed to get instructions in the matter.

In the meantime, the nuclear power plant became operational in July 2008 and the project was initially a success. The Government therefore, commissioned another uranium mine in Chapappu district in the state of Gongura, which has vast areas of reserve forests and perennial rivers that serves as a potable water source for 6 states in Dasoi. In the meantime, an independent panel of experts from Keeri, an association actively promoting clean energy and educating the public on the ill-effects and dangers of nuclear energy on the people and environment, carried on a detailed study for over 2 years and made their report public in the month of November 2010. The report revealed extensive damage to the marine ecosystem and pollution to large water bodies because of the decision of the Government in setting up nuclear plants along the coast. They also found a marked decrease in the number of Olive Ridleys that usually nested along the south eastern coast of the country. The report also shockingly stated that the power plants fell within Seismic Zone- II. The report further stated that the mining activities in Pakodavi district in the state of Brinji have caused serious damage to the environment including pollution of soil and water among other resources. Keeri instituted a PIL before the High Court of Gongura in relation to the issue of damage to the environment because of the mining and power plant activities. While the matter stood thus, an earthquake of magnitude 6 on the Richter occurred in the state of Brinji. The storage tank containing radioactive waste in the Bondavi plant was damaged and caused a radiation leak which resulted in the death of 150 farmers and damage to almost 200 acres of farm lands. An application was filed before the Nuclear Damage Claims Commission, which dismissedthe application quoting Section 5 of the Civil Liability for Nuclear Damage Act, 2010. The said order, the Civil Liability for Nuclear Damage Act and more specifically Section 5, were challenged before the High Court of Brinji under Article 226 of the Constitution by the affected parties. Mr Rajai, a public spirited person filed PIL in SC under Art. 32 for the violation of Art. 21 of the Indian Cosntitution on behalf of all affected persons. The Supreme Court of Dasoi withdrew the writ petitions pending before the High Courts of Gongura and Brinji and clubbed it along with the writ petition pending before it and placed the matter for final hearing. NOTE: All provisions of the Civil Liability for Nuclear Damage Act, 2010 are in force and the Commission under the Act has been constituted.
