While enclosing herewith a copy of same indicating activity wise and chapter wise rate finalized, you are advised that while placing the orders, the following general precautions may be observed:1. 2. Work orders may be placed strictly as per requirement and budget provision available. The general terms & conditions as are in force and amended from time to time shall prevail on each contractors during execution of work and no deviation should be made (copy enclosed). 3. 4. The registered contractors may be asked to furnish their consent for the rates. The rates have been finalized chapter-wise for the year 2012, which may please be complied with carefully. The rates/ prices are firm and inclusive of all taxes/duties & contribution of CPF, EPF, ESI & other liabilities except service tax which will be paid extra if applicable on production of proof. 5. 6. The payment shall be made by the Circle Accounts Officer in accordance with the terms and conditions of the work order. Work orders shall be placed as per DOP in force and should fully comply with the procedure laid therein.

Subsequent amendments/orders if any issued shall also be complied while placement of work orders on CLRC by the field officers. The revised CLRC rates will be applicable with immediate effect on new contracts only. No increase will be entertained in the CLRC-2012 rates atleast for a year. The contract already awarded on existing CLRC will remain unchanged.

ABSTRACT OF GENERAL TERMS & CONDITIONS


1. SECURITY FOR EXECUTION OF SUCCESSFUL CONTRACT

All those contractors who are registered in E-I,E-II,E-III & E-IV category and have deposited permanent security of Rs.5.00 lacs ,Rs.1.25 lacs ,Rs.0.50 lacs and Rs. 0.20 lacs respectively then this permanent security deposit cover the requirement of 2% security deposit, which is to be deposited by the contractor after award of contract. No refund of cash security shall be made. 2. TIME SCHEDULE The basic consideration and the essence of the contract shall be strict adherence to the time schedule for performing the specified works to be decided mutually with order placing authority. Hence all the works are to be completed within so decided period as stipulated in respective work order to be issued by the Nigam authorities. In case of delay in execution of works beyond stipulated period the following recovery /action shall be made applicable. (I) Recovery shall be effected for delay in delivery/ execution @ % per week or part thereof subject to a maximum of 5% of contract value. The amount of recovery will be worked out on the basis of Ex-works price of labour rate contract on the date on which delivery/ completion was due without including taxes, duties, freight, insurance etc. In case where Ex- works price have not been indicated, then the recovery shall be worked out on the basis of prices indicated in the relevant order. II) To cancel the contract and if so desired to get the work completed by the other agencies/contractor at the risk and cost of the contractor. The stipulated time period will be decided on the basis of providing complete material to the contractor. Non availability of matching material will not be counted as delay on the part of the contractor. 3. CPF/EPF SCHEME:

The contractor will have to furnish the information in the Performa formC para 6.5(a) every month or with every bill in respect of the employees engaged in connection with the execution of work from the date of its commencement and upto the date of completion. If the contractor fails to furnish this information, the concerned circle Accounts Officer JdVVNL shall deduct the amount from the bills at the rates applicable at the time of payment as per CPF rules act and kept under the head 46.921( miscellaneous deposits) of the contractor/ employees till furnishes the information in the above mentioned Performa along with nomination form within stipulated period falling which, the amount is so deducted shall be deposit ed with Regional P.F. Commissioner within stipulated period as per CPF act. 4. SECURITY AGAINST MATERIALS i. The contractor shall be fully responsible for the safe custody of all the equipments/ material issued to it by JdVVNL for the execution of work(s) as per quantity mentioned in the bill of material enclosed with the work order(s) till the satisfactorily completion and thereof handing over of the awarded project(s) to the JdVVNL including deposition of balance fresh

vis--vis retrieved material, if any. For this, the contractor shall take suitable one time composite storage cum erection insurance cover note from a scheduled insurance company equivalent to the amount of Bank Guarantee required for each class of category towards security for safe custody of the equipment and material issued to the contractor for

execution of the awarded work(s) and not for the entire work order value of material. Such insurance will cover any destruction / risk., loss or

damage of material by way of theft, missing, damage or deterioration in transit as well as at the site whatsoever, in part or in full and shall be valid until the project / work is satisfactorily completed and handed over to the entire satisfaction of the JdVVNL. The valid insurance cover note issued by a nationalized insurance company is to be submitted by the contractor while claiming the payment of works. Any loss inflicted on the Nigam on this account and due the reason mentioned in the above

clause the contractor would be liable to make good the entire loss by 5

claiming the payment from the insurance and depositing the same with the Nigam. ii. In addition to above a onetime Bank Guarantee for the amount as mentioned below against respective category in the prescribed format and to be issued by a scheduled bank shall be furnished by the

contractor(s) registered under CLRC towards security and safe custody of the equipments/ material issued for execution of the awarded work(s) by the AEN concerned or by any other authorized officer of the JdVVNL to the contractor, so as to safeguard the interest of the Nigam against any loss and risk including embezzlement / misappropriation or theft of material amongst others as below:S.No. 1 2 3 4 Class/category E-I E-II E-III E-IV Bank Guarantee required for Rs. Above bank guarantee against the safe custody of the equipments and material will be taken after award of work. The contractor will be under legal obligation for completion of all the contractual formalities including furnishing of bank guarantee of the required amount against material to be issued. If the contractor fails to complete the required contractual formalities including furnishing of bank gurantee(s) within a period of one month after award of work order, then the work order will liable to be withdrawn/cancelled at the discretion of work

sanctioning / contract awarding authority. Further, if there is a recorded proof that material required for execution of work is not available in the respective store(s), the time period allowed for furnishing bank guarantee against the safe custody of equipments / material may be suitably recording reasons in writing. However, security deposit as deposited by a registered contractor at the time of getting itself registered is refundable at the time of cancellation / withdrawal of registration by the contractor. Such security deposit in the form of both cash and bank guarantee shall be refundable provided there is no recovery whatsoever 6 extended after ascertaining facts

due against the contractor and the awarded work(s) have been completed and handed over by the contractor and the requisite performance period is satisfactorily over. If there is any recovery due from the contractor the same shall be made good from the available financial hold whatsoever. (iii) The above bank guarantees shall be furnished and accepted by the respective registration enlisting authority along with the direct conformation letter from the issuing scheduled bank in proof of having issued the guarantee. The bank

guarantee shall initially be furnished for a period one year excluding a grace period of three months. The validity of the bank guarantee so furnished shall have to be extended from time to time to have the registration valid. (iv) Material required for the execution of the contract shall be issued only after the acceptance of the required bank guarantee by the enlisting authority. (v) In case a contractor either fails to execute or slow down the execution of the awarded work(s) despite getting issued the requisite material / equipments, and thus the awarded project(s) or work(s) get delayed, the executing officer shall immediately intimate to the respective registration authority with whom the bank guarantee(s) is / are available to invoke the same after serving a time bound notice to the contractor. (vi) The conditions shall also be applicable on existing / already enlisted / registered contractors with the Nigam and the concerned officers shall ensure the compliance of the above while finalizing and updating the registered contractors panel in a circle. 5. (i) TERMS OF PAYMENT FOR WORKS 95% (Ninety five percent) payment for the erection works shall be made to the contractor on submission of bills to the concerned circle Sr. accounts officer / account officer of Jodhpur Discom. (ii) Balance 5% (Five percent) payment will be released after ascertaining satisfactory performance of the work for a period of 12 (Twelve) months from the date of completion & accepted by the work order awarding authority or after furnishing a performance bank guarantee to the extent of 5% of the contract value, subject to completion of the contractual formalities incorporated 7

Under some eventually if contractor has to supply a small quantity of material then he should be paid for the material separately and no WCT be deducted, on the value of entire work order amount.

PERFORMANCE BANK GUARANTEE From the running Bills of contractor 5% payment will be retained towards satisfactory performance for which contractor shall furnish performance bank Guarantee from any scheduled bank in India for an amount equivalent to 5 % of the contract value on the Rajasthan State non-judicial stamp paper for Rs.100/duly authenticated by Ist class Magistrate or Notary public or directly confirmed by the issuing Bankers. Such Bank Guarantee shall be valid for a period of 12 months from the date of successful completion of the contract to entire satisfaction of the Nigam.

SAFETY MEASURES : The Contractor shall follow a safe method of working so that no damage/loss is caused to JdVVNL regarding material and also injury to any of his workers. The JdVVNL shall not be responsible in any way for the injury caused to contractors labour while working. The Contractor is advised to get insured his all workers 8

against accident from any Nationalised General Insurance Company. The Insurance charges shall be borne by the Contractor himself & furnish the proof of the same to the contract awarding authority. 8. DEPOSITING OF UNUSED AND RETRIVED MATERIAL After completion of erection work, all surplus & retrieved material, complete towers and line materials including bolts and nuts, conductor, earth wire, hardwares, Insulator & other material etc. shall be returned & deposited by the contractor to the Store(s) of JdVVNL as per instructions of Engineer Incharge at contractors cost. 9. SUPPLY OF MATERIAL All required material such as PCC poles, Conductor, G.I. Stay sets, Cross Arms with Clamps, Insulators with Hardware accessories and earth wire and substation material etc. will be supplied from the store(s) of concerned Assistant Engineer of JdVVNL. The poles will be available along the line route at one or more places generally. No T&P, labour etc. for this work shall be supplied/ provided by JdVVNL. If the material is supplied by the contractor for completion of work, after written permission of the concerned Superintending Engineer (O&M), the cost of material supplied /used by the contractor shall be paid as per Nigams issue rates on date. 10. MEASUREMENT OF CONDUCTOR The length of Conductor shall be allowed on the basis of route length of the line measured along with sag during final survey of 33KV/ 11 kV/LT line(s). The contractor shall be responsible to return back excess conductor issued to him after taking into account the permissible wastage(s) as specified. 11. MAINTAINING OF PASS BOOK A duly authenticated pass book shall be issued to all contractors under this contract which shall be properly maintained by them. All entries of orders placed shall be made in this pass book by order placing authorities so as to know the total work awarded to him before placing fresh orders. 12. INCOME TAX (TDS)

The income tax shall be deducted from each bill at applicable rate while arranging the payment to the contractor. 13. WORK CONTRACT TAX Where the material has been provided / supplied by the contractor to execute the CLRC work, the W.C.T. shall be deducted on applicable rate irrespective of the value of material supplied by the contractor. 14 E.S.I Wherever ESI is applicable same shall be reimbursed by the Nigam in addition to the charges indicated in the respective chapter. 15. Delegation of power to award the contractor under CLRC The CLRC works can be assigned/awarded to the eligible contractors through panel or out of panel as per delegation provided under note- 6 appearing below the item No. 14 (A) of DOP following above general guideline & procedures. 16. (i) Procedure for operating the panel: Whenever any work is required to be carried out through CLRC, falling in the competency of higher authority the field officer/XEN would send the G-schedule of the work based on the CLRC rates, indicating the quantity therein to the competent authority. The circle SE/XEN will keep such proposals in order of their receipt in the circle /division preferably through fax/email and receipt of which in SE/XEN office will determine their priority However, confirmatory hard copy is required to be sent as usual (ii) After examination of the proposed G Schedule (s) of work(s) and estimates, the letter of intent LOI shall be given to the eligible contractor after ensuring the delegated competency, as per its turn appearing in the circle SE/XEN officer panel/roster register, which will be in the order of registration i.e. oldest registered contractor shall be at priority No 1& so on. The contractor in turn shall have to give its unconditional consent within a period of 5 days to execute the work on CLRC rates, terms and conditions indicated in the G-Schedule. Example :- if in any Division or circle a contractor is chosen for the work having value lower than his bigger entitlement, then such contractor loses its chance to claim the work as per roster till its turn comes next. The work of higher value say Rs. 10

20 Lacs would be to those who falls next in roster/panel and so. This system will apply to all categories of contractors. (iii) Sub-divisional officer would send any number of proposals for works of CLRC rate contract along with G-schedule (s) not more than two times a week. If more than two requests are received in circle office, the circle SE shall consider such request(s) in the subsequent week. (iv) If the contractor whose turn is due but he does not give its consent in stipulated time , it shall not be considered till its next turn. Further in case contractor withdraws its consent, he shall not be considered for next turn and if he repeats such default twice in a row, it shall not be considered for next one year. (v) The contractors registered under category E-IV and who have been executing electrical works in a particular circle/ division at least for the last one year, and have already executed such total works valuing with a minimum of Rs. 5 lacs may also be considered for awarding a single contract valuing not more than Rs. 10 Lacs in parity with that to the contractors registered under category E-III. This is subject to their recorded satisfactory performance in past. However , the ceiling of total value of in-hand-contractors at the time of awarding a contract would remain unchanged i.e. Rs. 20 Lacs. (vi) It is also to be ensured before awarding under CLRC that the performance of the a work to a registered contractor earlier work completed by the

contractor has been satisfactory and the balance unutilized/retrieved material along with MAS account has been got deposited. (vii) Any new contractor having registered itself for the first time in category E-IV then such contractor will be entitled to carry out the work upto Rs. 5 Lac only at a time and on successful and timely completion of this assigned work, such contractor (s) would be eligible to get further /mentioned under category E-IV upto 20 lacs. (viii) The record relating to receipt of proposals for works on CLRC rates in circle/division shall be well maintained to be periodically verified and signed by the TA to SE & circle AO in the circle and by the XEN concerned in the 11 work up to fall entitlement

division . The circle AO while examining/vetting the cases will invariably see and verify the priority contract. (ix) The contractor who is giving slow progress in spite of the notice (s) or has defaulted in execution of work already awarded will not be allowed to keep his turn till default is overcome, to the entire satisfaction of the work order awarding authority. (x) The committee consisting of circle SE and Sr. AO/AO will essentially review the progress of CLRC contracts, in each sub-division and Division on quarterly basis on the basis on the basis of their performance. They will finalize the list of such contractors who will not be eligible to get the work in terms of forgoing sub Para -ix in future because of their slow progress or default committed by the during the execution of the awarded work (s) . Similarly Zonal Chief Engineer (O&M) will review the progress once in every six months with SE/Sr.AO/AO (O&M) & and the respective Contractors. (xi) At the time of award of contract, entry thereof shall invariable be made in the pass book of each contractor to check and ascertain the eligibility of the contractor and pending works in hand on the date of receipt of G-Schedule, which SE/AO/XEN should invariably check while examining and recommending the cases. (xii) The registering authority shall circulate such list of defaulting contractors on quarterly basis in respect of every sub- division and division along with intimation to such defaulting contractors. Contractor shall joint/weld the members to form the mounting structure as per drawing. Necessary tools, welding, machines, lifting devices etc. shall be arranged by contractor. Civil works Erection of lattices in alignment including excavation and concreting of structure foundation including cement, sand and grit 20 mm size (crusher broken) having ratio 1:3:6 and grit 40 mm size for ratio 1:5:10 and curing for period as required (21 days). Metering Equipments: The requisite metering equipments (CTPT set, meter,meter box & suitable conductors for jumpers), will be provided by the concerned Assistant Engineer in healthy condition at site. The cables from CTPT set to meter box laid down in 50 mm GI pipe with suitable bends & nipples, shall be provided by contractor alongwith the consumable items such as PVC tapes, petroleum jelly etc. The cable should be PVC multi strand copper 4 core 2.5/4 Sq. mm ISI marked and firm & tight connections shall be made by suitable connector e.g. at CTPT sets by using clamps and at meter/TTB by suitable lugs etc. The CTPT sets so installed shall be earthed by means of the MS Flat (size 50x6 mm) by joining it with the nearest earthing available at the sub-station. Requisite earthing material shall be made available by the contractor. Meter: Meters should be fixed firmly inside the tamper proof box, as per drawing. All the meter fixture will be provided by contractor including all consumables. Meter Box The meter box shall be provided by the concerned Assistant Engineer. However, hardware or any other items required to fix the meter inside the meter box will be provided by contractor. The meter box will be fixed firmly with sufficient strength at a place as per drawing. The test terminal block(TTB) link type shall be provided by contractor in the meter box.

Labour charges for over all inspection of sub-station with two per trans. transformer for job requiring works analysis and testing of dielectric strength of oil, insulation resistance value and earth resistivity etc. Add for each power transformer. Labour charges for opening the transformer tank top cover(if required to facilitate maintenance of transformer) after removing required accessories.Including all required T&P Up to 5 MVA transformer. Preventing oil leakage by changing main gasket with material after removing cover. Upto 1.6 MVA transformer Above 1.6 MVA & upto 3.15 MVA transformer. Above 3.15 MVA & upto 5 MVA transformer. Change of HV/LV bushing gasket ring and rubber washers including supply of required material & draining /re-filling of oil as required. (a) For additional HV/LV bushing work. * This amount will not be payable incase the work of removing of Top cover gasket is also awarded in the same order. Change of gaskets of valves/radiator / Buchhloze's Relay including cost of gaskets etc. Valve's/Buchhloze's Relay Radiator Valves.
