CATERING CONTRACT
This is a catering contract executed on 20th April, 2012. BETWEEN Mr. Raza Anwar House No.2, Star Homes, Saddar, Karachi 0332569884 known for the purposes of this Agreement as "Client," AND Mr. Abid Hussain House No.3, Al-Marium Homes, Garden West, Karachi 03326396654 known for the purposes of this Agreement as "Caterer."

1. Capacity of parties: Both the parties are competent to the contract as both are of the age of maturity, have sound mind, and are not disqualified from contracting by law

Client and Caterer agree to the following: 1. Services 1.1 Caterer agrees to provide services to the Client for the Marriage Ceremony of his son, Mr. Asad, taking place on 20th April, 2012 . 1.2 For this Event, Caterer agrees to provide the following: food, decorations, cutlery, equipment, furniture and personnel.

1.3 Client agrees to provide the following: transportation, fuel, food and lawn area.

2. Lawful object: The above, is the object of this contract. It is legal and moral.
2. Deposit 2.1 Client is required to pay a deposit of Rs. 10,000 upon signing this Agreement. 2.2 Deposit is refundable if Client cancels within a period of one week.

3. Payment 3.1 For the above services, Client will pay Caterer a total amount of Rs.60,000 including the deposit outlined in Section 1. 3.2 Client may request additional services, with the knowledge that these services will add to the total cost agreed upon by this contract, and must be agreed to in writing, either as an addendum to this Agreement, or in a separate document. 3.3. The balance on the total cost for the Event is due at the end of Event, once all property has been returned to Client and/or Caterer, within 15 days of the Event..

3. Lawful Consideration: The above point numbers 3 and 4 are the consideration for this contract. It is lawful, in this case.
4. Guests 4.1 Client agrees to provide Caterer with the total number of guests no later than 10 days before Event. 4.2 Client agrees to break down the guest list into adults and children, and include any food allergies or special dietary requests, if applicable.

5. Menu 5.1 Client will choose from Caterer's available options. 5.2 Menu must be confirmed by one week before the Event or else Client will be subjected to penalty fee amount of Rs. 2000. 5.3 Menu will be fixed, and no changes may be made, 72 hours before Event.

6. Cancellation Policy 6.1 Client may cancel this Agreement within one week of signing it. 6.2 Cancellation occurring 3 days before Event will result in a loss of 50% of deposit as outlined in Section 2.

4. Certainty of terms: The terms of the above contract are clear, complete and certain.
7. Arbitration 7.1 Should either party failure to provide or breach this Contract in any way, the offending party will be liable for any damages. 7.2 Both parties agree to seek a third-party mediator or arbitrator for any disputes that arise as a result of this Agreement.

5. Legal obligation: Here the two parties have created a legal relation. It means that if any one of the parties will not fulfill his promise, then he shall be liable for breach of contract.
8. Jurisdiction This Agreement falls under the jurisdiction of the district of Karachi South, and is therefore subject to all of its laws and regulations.

6. Writing and registration: Here the contract is in writing, and it will be therefore easy to prove in court.

7. Free consent: Here the consent of the parties is free from any coercion, undue influence, fraud, misrepresentation or mistake.

8. Offer and acceptance: This is a valid contract as the offer and acceptance in this contract, satisfy the requirements of Contract Act.

9. Possibility of performance: This is an enforceable agreement by law, as it is legally and physically possible to perform.

Not expressly declared void: This agreement is not expressly

declared void. Therefore its a valid contract
