AMENDED DECLARATION OF CARRIE LYNNE ZEBLEY

I, CARRIE LYNNE ZEBLEY, formally CARRIE LYNNE SEDILKO declare the following:
1. I am the daughter of Marguerite Sedilko and Frank Sedilko. 2. I am also the sister of plaintiff Stanley Sedilko.

3. I have lived at 2529 Hernando Rd, Sacramento, Ca 95825 for the last 9 years as caregiver to my mother and had to forego regular employment to provide for her care.. 4. I am disabled and I have applied for permanent disability under Social Security. 5. My brother has never provided any assistance to my mother who required extensive care.
6. I am a beneficiary of a WILL and TRUST which involves the subject property for which my

brother seeks to evict me. (Exhibits A and B, respectively) 7. My brother is the trustee and executor of the will which left me half of my mothers property. 8. I am not a tenant of the property and no landlord and tenant relationship has ever existed which is the subject of the unlawful detainer. 9. I am an equitable owner pursuant to my mothers will and trust attached as exhibit A and B respectively.
10.The Last Will and Testament of my mother (Exhibit A), Marguerite Aileen Sedilko, dated

September 3rd, 2002 states the following at p. 2, FIFTH provision: I hereby give, devise and bequeath all of my property, whether real, personal or mixed, or whatsoever kind and wheresover situated, to my husband, FRANK SEDILKO. In the events that my said spouse and I should die as a result of a common calamity, or he should fail to survive me for a period of sixty (60) days, I give, devise an bequeath all of Property to my children[STANLEY SEDILKO and CARRIE LYNNE ZEBLEY] who may be living at the time of my death, in two (2) equal shares, share and share alike.
11.The Trust Documents entitled SEDILKO 2002 REVOCABLE TRUST (Exhibit B) states at

p. 3, item 2.9 entitled GUIDELINES OTHER Sources Considered: In making distributions, the trustee may (1) consider any other income or resources of a beneficiary known to the trustee and reasonably available; (2) pay or apply for one beneficiary more than the other and may make payments or applications of benefits for one beneficiary to the exclusion of the other, and (3) consider the value of the trust assets, the relative needs, both

presents and future, of each beneficiary, and the tax consequences to the trust and to the beneficiaries 12. I am willing to be responsible for half the sewer and garbage as well as pay for water. 13. I am also responsible for half of the property taxes which can be paid out of the sale of the property. 14. I have a right to stay on the property as an owner til the property is sold: and I am willing to show the property on weekdays nine to five and later on weekends if necessary with 1 hour notice. 15. There is no mortgage on the property. 16. I would endure immeasurable hardship if I am forced to leave before the sale of the property and the distribution of the proceeds.
17. Plaintiff made an oral agreement with our mother to deed the house to me as compensation

for my caregiving services for the past 9 years but he failed to honor that agreement.(See Exhibit C where he makes reference to the agreement.) I declare under penalty of perjury under the laws of the State of California that the foregoing is true and correct. Respectfully,
