This is the case whetherthe lease or rental agreement is in writing or was a verbal agreemen t. First, the landlord must give the tenant(s) written notice. If the notice allow s a tenant to fix theproblem, such as pay past due rent or to remove a pet, the landlord can only evict if the tenantdoes not fix what is asked in the notice. I f the notice is without cause, such as a 30-day notice tomove out in a month-tomonth tenancy, the landlord can file eviction (unlawful detainer) lawsuit insupe rior court as soon as the notice period ends. If the landlord has followed all the proper procedures, and the tenant either does not answer thecourt papers, or th e tenant answers but the court decides in favor of the landlord, the court willo rder the sheriff to evict the tenant. If the court decides in favor of the tenan t, the tenant will get tostay.
