Nixon Peabody knows the sense of frustration and anger that those who are victims of the
recent fraud involving Bernard L. Madoff and Bernard L. Madoff Investment Securities, LLC feel.
We have represented many clients who were victimized in similar frauds, and we know well the
extent of the harm these frauds can cause.
Since the evening that the Madoff fraud was disclosed, we have been working with clients on the
issues it raises. The specialties that will be needed to deal with this fraud are among our strengths,
including:

 We have extensive experience representing investors – both institutional investors and


individuals – who are victims of ponzi-scheme frauds.
 We have industry-leading experience representing clients regarding redemptions and
liquidations, so we know the problems you may face in that respect.
 We have acted as receivers appointed by the United States Securities and Exchange
Commission in several recent frauds, so we have a strong sense of what the receiver in this
case will do, and by extension, what you will need to do.
 With regard to pursuing your theft losses, we have acted as receivers for insolvent securities
firms under the auspices of the Securities Investor Protection Corporation (commonly
referred to as “SIPC”). We have also advised investors on their rights and obligations in
connection with seeking recoveries from SIPC.
 We have a substantial bankruptcy practice, with deep experience representing clients on
creditors/investors committees, which will likely become important here.
 We have a highly-regarded white-collar criminal defense and government investigations
group, which will provide insight into what the government will be doing.

Our New York office will be deeply involved in our client representations because of the location of
