hereinafter referred to as PTA PRESIDENT; MOUNT APO FOUNDATION, INC. (MAFI), a non-stock, non-profit corporation duly organized and existing under Philippine laws with office address at Eugenio Perez St., Kidapawan City, Cotabato Province, Philippines, represented herein by its Executive Director, Atty. Ermelo N. Libre, and hereinafter referred to as the FOUNDATION; WITNESSETH: WHEREAS, the FOUNDATION under its High School Financial Assistance Project (HSFAP) provides financial assistance to high school students within its area of responsibility; WHEREAS, the PoP STUDENT is a beneficiary of said project being an enrolled student in the said high School supervised by the PRINCIPAL/TIC; WHEREAS, said High School has a Parents-Teachers Association (PTA) headed by the PTA PRESIDENT; NOW, THEREFORE, for and in consideration of the foregoing, the parties hereto hereby agree to the following terms and conditions: I. Benefits/Privileges, Duties, Responsibilities of PoP STUDENTS/PARENTS/GUARDIANS and Penalties (a) Be entitled to the PoP assistance for the current school year from the HSFAP of the Foundation including all other assistance granted by the foundation to high school students; (b) Exemption from payment of any fees during the current school year except for the fees of the following school activities that the PoP student wants to attend/join, the payment of which shall be the obligation of the PoP students and their parents: (1) Junior-Senior Prom, (2) High School Graduation Ceremony, (3) Students Retreat and Recollection, (4) Student Field Trips, (5) School Christmas Party, and TESDA Assessment; (c) Must maintain passing grades in all subjects during the school year. Non-maintenance of passing grades will be a ground for disqualification as PoP student; (d) Must not incur more than 10 days of unexcused absence during the school year. Unexcused absence of more than 10 days shall be a ground for disqualification as PoP student; (e) Must actively participate in all school extra-curricular activities; (f) Must always avoid the use of illegal and prohibited drugs and other substances; (g) Must always maintain good behavior, ethical conduct and honorable reputation in school and in the community; (h) Must observe and follow all existing rules and regulations of the school and other duties and obligations that from time to time may be assigned by the school principal/TIC or other school officials; (i) Parents or guardians of PoP students must provide moral support and exert the best effort to extend financial support to their children children/students. Parents of PoP students shall assume the obligation of paying the fees enumerated in I, b) above, if the PoP student wishes to attend/join; (j) Non-observance of the above-mentioned responsibilities of the PoP Student shall be a ground for disqualification as PoP student;

II. Duties and Responsibilities of SCHOOL PRINCIPAL/TIC (a) Establish and organize annually the School Selection Commitee (SSC) for the selection poorest of the poor high school students; (b) Acts as the chairperson of SSC in all its meetings and makes sure that all the action, deliberation and decision of the SSC are always guided by policy guidelines of HSFAP; (c) Ensure that PoP Form 4 is posted in school bulletin boards, copy furnish to MAFI, and its content announced during the first PTA meeting/assembly; (d) Entertain and resolve complaints regarding the selected/admitted PoP students and furnish MAFI of notice of resolution; (e) Ensure that that the Memorandum of Agreement (Pop Form 6) is executed and signed by the parties; (f) Ensure that the required liquidation of HSFAP support fund is complied within the given period of time as provided in the policy guidelines of HSFAP; (g) Ensure the submission to MAFI of the performance report of PoP high school students (PoP Form 5 ) every 15th day of April each year; (h) Ensure the submission to MAFI of the Masterlist of Enrolled High School Students for current school year and the List of officers/officials for the current school year of the Parents-Teacher Association (PTA), Student Body Organization (SBO), Home Room Organization (HRO) and Student Club Organizations th (SCO) in the school, including its organization and club teacher advisers, if any, on or before the 15 day of July of each year; (i) Ensure that the fund from the Foundation for Student Body Organization (SBO), Student Athletics (SA), Student Club Organziation (SCO), Home Room Organization (HRO) and Other Student Services (OSS) and other support funds) is utilized efficiently, effectively and honestly in accordance to the purpose/objective stated in the approved request for availment; (j) Ensure that the procedure/documentary requirements in the withdrawal or utilization of the HSFAP fund are complied in accordance to the policy guidelines of HSFAP; (k) Submit to MAFI other information as may be required from time to time for the purpose of evaluation, audit and improvement in the implementation of HSFAP; III. Duties and Responsibilities of PTA PRESIDENT (a) Attend and participate in all meetings of the School Selection Committee (SSC); (b) Ensure that the PTA support fund from the Foundation and other funds from the Foundation that may come to the PTA are utilized efficiently, effectively and honestly according to the purpose/objective to which it was disbursed; (c) Assist the High School principal/TIC in the implementation, monitoring and evaluation of HSFAP of the Foundation; IV. Duties and Responsibilities of FOUNDATION (a) Provide the high school financial assistance to HSFAP beneficiary school in accordance and subject to its policy guidelines; (b) Monitor and review the utilization and disbursement of HSFAP funds by the school, Parents-Teachers Association (PTA), Student Body Organization (SBO) and Home Room Organization (HRO); (c) From time to time, gather information from the school, Parents-Teachers Association (PTA), Student Body Organiztion ( SBO) and Home Room Organization (HRO) for the purpose of evaluation and improvement in the implementation of HSFAP; (d) Suspend, withdraw and/or cancel any or all HSFAP financial assistance in the event of misuse, fraud, misrepresentation, falsification and other forms of dishonesty in its preparation, utilization, disbursement and/or liquidation; V. Effectivity and Expiration This Memorandum of Agreement shall take effect upon the start of school enrollment activity of school year 2011-2012 and shall expire automatically at the end of school year 2011-2012.
