ParticipantCancellationPolicyYoumaycancelyourplaceontheCoursebygivingnoticeinwritingtotheCourse Administratorupto(andincluding)7daysfromthedateLMAconfirmsyouracceptancetotheCourseinaccordance withCondition1andyouwillnotbeliableforthepaymentofanyfeesandanyfeesalreadypaidtoLMAforthe Coursewillberefunded,excludingtheapplicationdeposit.IfLMAreceivesyournoticeofcancellation8daysor morefromthedateLMAhasconfirmedyouracceptancetotheCourseyouwillstillreceivearefundofyourfees alreadypaidtoLMA,subjecttopaymentbyyoutoLMAofa500cancellationfeetocoveradministrativecosts (whichshallbepayableimmediatelyuponyourcancellation,unlesstheapplicationdeposithasalreadybeenpaid), providedsuchnoticeofcancellationisreceivedbyLMAbeforethefirstdayoftheCourse.LMAregretsthatno refundscanbegivenforanycancellationnoticeitreceivesonorafterthefirstdayoftheCourseand,insuch circumstances,thefullfeesremainpayablebyyoutoLMA.Pleasenotetheapplicationdepositisnonrefundableif approvedontothecourse. GoverningLawandJurisdictionThisAgreementwillbegovernedbythelawsoftheEnglandanddisputesunderorin connectionwiththemshallbesubjecttothenonexclusivejurisdictionoftheEnglishcourts. LimitationofLiabilityLMAsliabilityforlossesyousufferasaresultofLMAbreachingthisAgreementorotherwisein connectionwiththeCourseislimitedtothoselossesthatareaforeseeableconsequenceofLMAbreachingthis Agreement.LossesareforeseeablewheretheycouldbecontemplatedbyyouandLMAatthetimeLMAacceptyou ontotheCourse.TotheextentthatLMAisliableforsuchlosses,LMAstotalliabilitywillonlyextendtothefeespaid byyoutoLMAundertheAgreement.Inaddition,LMAshallnotberesponsibleforanyindirectlosseswhichhappen asasideeffectofthemainlossordamageandwhicharenotforeseeablebyLMA.Fortheavoidanceofdoubt, nothinginthissection9shallseektolimitorexcludeLMAsliabilityfor:(i)deathorpersonalinjuryresultingfrom negligenceor(ii)fraudorfraudulentmisrepresentation;(iii)anybreachofLMAsobligationsimpliedbysection12of theSaleofGoodsAct1979orsection2oftheSupplyofServicesandServicesAct1982;(iv)anylossesforwhichitis prohibitedbysection7oftheConsumerProtectionAct1987tolimitliability;or(v)anyothermatterforwhichit wouldbeillegalorunlawfulforLMAtoexcludeorattempttoexcludeitsliability. SeveranceIfanyprovisionofthisAgreement(oranypartofanyprovision)isfoundbyacourtorotherauthorityof competentjurisdictiontobeinvalid,illegalorunenforceable,thatprovisionorpartprovisionshall,totheextent required,bedeemednottoformpartofthisAgreementandthevalidityandenforceabilityoftheotherprovisionsof thisAgreementshallnotbeaffected. WaiverNofailurebyeitherPartyinexercisinganyright,powerorremedyshalloperateasawaiverofthesame. ForceMajeureLMAshallnotbedeemedtobeinbreachofthisAgreementorotherwisebeliabletoyouasaresult ofanydelayorfailuretoperformitsobligationsifandtotheextentthatsuchdelayorfailureiscausedbyaforce majeureevent(thismeansanyeventarisingthatisbeyondthereasonablecontrolofLMA,includingbutnotlimited to,anyindustrialdispute,healthscaresorepidemics,tutor,consultantorparticipantcancellationorwithdrawal, venuedamageorcancellation,governmentalregulationsoraction,fire,flood,disaster,civilriot,actsofterrorismor war).Iftheperiodofdelayornonperformancecontinuesfor3months,eitherpartymayterminatethisAgreement bygiving14days'writtennoticetotheotherpartyandanyfeesalreadypaidtoLMAfortheCoursewillberefunded.
