TO ALL PARTIES AND TO THEIR COUNSEL OF RECORD: The Securities and Exchange Commission (the Commission) will, and hereby does, move the Court, pursuant to Rules 26, 34 and 37 of the Federal Rules of Civil Procedure, for an order requiring Defendant Alternate Energy Holdings, Inc. (AEHI) to produce documents and information in its possession or under its control in response to written Requests for Production of Documents. In particular, and for the reasons set forth in the accompanying Memorandum in Support, the Commission seeks an Order, as set forth in its proposed order, requiring AEHI to: (1) produce non-privileged documents in its possession, custody or control that are responsive to the First Request, (2) include in its production documents from AEHI China and AEHI Korea, and (3) disclose the steps it has taken to comply with the Courts Order and its discovery obligations in this action, no later than 20 days from entry of an order granting the Commissions motion. The Commissions Motion is supported by the accompanying Memorandum, the Declaration of David A. Berman and the exhibits attached thereto, and the Proposed Order. In conformity with Local Rule 37.1, the Commission has made reasonable efforts to reach agreement with the attorneys for defendants on each of the issues raised in the Commissions Motion.
