THE Department of Budget and Management (DBM) will not withdraw its recently implemented circular which sets limits on the grant of incentives for state workers, since Budget Secretary Florencio Abad has the legal authority to do so, Malacaang said on Monday. Presidential Spokesman Edwin Lacierda deemed as baseless the threat of the Confederation for Unity, Recognition and Advancement of Government Employees (Courage) to file a class suit against Abad over the issuance of Budget Circular 2011-5 and Circular Letter 2011-9. In terms of legal authority, the DBM has legal authority to issue such circulars. The issue is whether he [Budget Secretary] has authority to issue that circular and to limit it [source of incentives] and the answer is the DBM secretary has such authority. Theres no legal basis to oppose the circulars, Lacierda said. He said that the DBM has oversight functions over the CNA [collective-negotiation agreement] and therefore, there are parameters by which the CNA [incentive] can be granted or specifically, if there are savings from the MOOE [maintenance and other operating expenses] and productivity. As such, Lacierda said, there is no plan so far to withdraw the circulars being contested by state workers led by Courage, an umbrella organization of public sector unions and state employees associations. Circular 2011-5, dated December 26, 2011, provides supplemental guidelines on the grant of CNA incentive for fiscal year 2011. It cited Senate and House of Representatives Joint Resolution 4 approved in 2009, which authorizes the Chief Executive to modify the compensation and classification system of civilian personnel and the base par schedule of military and uniformed personnel in government. It prescribed additional guidelines pertaining to the accomplishment of performance targets, specific fund sources, and ceiling on the amount of the CNA incentive, to rationalize the grant of the latter, and to supplement the policy and procedural guidelines under Budget Circular 2006-1 dated February 1, 2006, and Circular Letter 2011-9 dated September 29, 2011. Under BC 2011-5, the CNA Incentive shall be sourced solely from agency savings from released MOOE allotments for the year under review. It also provided that the CNA Incentive for FY 2011 shall be determined based on the amount of savings generated by an agency following the prescribed guidelines but not to exceed P25,000 per qualified employee.
