June 9, 2012 Dennis Weber, President Irving Weber Associates Dear Mr. Weber: On March 8, 2001, Scott Detwiler of Crawford and Company requested that I complete Contents Inventory Worksheets for the damaged personal property within the store. (See attached letter dated 3/8/01). The worksheets request the following information: Item, State & city where purchased, Purchase date, cost to repair, replacement cost and replacement store. On March 16, 2001, after approximately 15 hours of research and content inventory, I completed and forwarded to Crawford and Company a partial list of the damaged contents. (See attached Inventory Worksheets). I provided the replacement cost and the names of the stores and suppliers where replacements could be purchased, so that Crawford and Company could perform verification, if they so choose. On March 17, 2001, I received the attached letter from Crawford and Company who, at the direction of Joe Fassler, now requests that I provide receipts or valid documentation to support the supplied inventory of 188 line items. Receipts do not exists for all of the 188 inventoried items. The 188 items listed in this partial inventory were acquired over a 9-year period. Some were included in the initial turnkey store purchase. Others have been added one at a time over the years. I am not sure what valid documentation means. I would assume that the existence of these items, less the ones that were destroyed and subsequently discarded in the cleanup effort and restoration process, would suffice as valid documentation. As we have discussed previously, in my opinion as the insured, Mr. Fasslers handling of this claim has been less than professional and not the least bit helpful in trying to get Great American Cleaners up and running again. In fact, his actions, to date, have served to lengthen the time and expense that will be required to get back to full operation. In my opinion, his actions and/or lack of actions have threatened the continued viability of Great American Cleaners as a successful business entity. Some statements that he has made to me regarding this claim smack of immaturity or simply a lack of proper training. Such as on Friday 3/16/01: We havent decided that the dry cleaning machine will be covered as a loss. And Do you think were going to build you a whole new store? and If we send you a check for the dry cleaning machine, you cant call us next week claiming that other machinery needs replacing." Where do statements like this come from and why do I have to deal with them?

Statements he has made and then denied making are also a major problem. (I have suggested to Mr. Fassler that Firemans Fund needs to record conversations to ensure accuracy, as other companies do.) Such as his denial, on Friday 3/16/01, that he told me during week 1 that the DC machine was going to be replaced and that I needed to contact vendors to obtain quotations. Per his statement and request, I spent over 40 hours researching equipment and speaking with vendors from all over the country. I was invited, by three of those vendors, to visit their plants and see their equipment in actual working environments. I am glad I held off on making those trips. His claim, in his March 14, 2001 letter (see attached letter), that he and I had spoken about a $5,000 advance is totally erroneous. On March 14, 2001, he refused to provide the advance that he had previously claimed to be preparing when we spoke on March 2, 2001. In the 3/14/01 conversation, he stated that his accounting firm would have to perform their analysis before a check was cut. I subsequently spoke with you, Mr. Weber, about a $5,000 advance check. On Thursday, 3/15/01, I received a voice mail from Mr. Fassler stating that per our conversation of yesterday a $5,000 advance check is being cut Statements and letters like those I have referenced support the fact that Mr. Fassler is either trying to make a name for himself within Firemans Fund or is trying to cover his own ass while hanging me out to dry. I am considering the filing of a complaint against Firemans Fund and Mr. Fassler with the Florida Insurance Commission and the Public Relations Department of Firemans Fund. As a member of the Fabricare Forum, I know that my colleagues are awaiting an update of my experience with Firemans Fund and its handling of this claim. This latest demand of Mr. Fassler, via Crawford and Company, appears to be another attempt to avoid settling this claim in a timely fashion. It appears that, instead of allowing me to manage my business and ensure its continued operation, Mr. Fassler wishes that I become a full time bookkeeper in order to satisfy his unreasonable and petty demands. If this latest demand is left standing, it will necessitate the hiring of a public insurance adjuster to satisfy it.
