OFFICE MEMORANDUM Subject:-Recommendations of the Second Backward Oasses Commission (Mandai Report)-Reser~ vation for Socially and Educationally Backward Oasses in services under the Government of Indi.a. In a multiple undulating society like ours, early achievement of the objective of social justice as enshrined in the Constitution is a must. The Second Backward Classes Commission called the MandaI Commssion was established by the then Govemment with this purpose in view, which submitted its report ~:l. the Government of India on 31.12.1980. 2 .. Govemment have carefully considered the report and the recommendations of the Commission in the present context regarding the benefits to be extended to the socially and educationally backward classes as opined by the Commission and are of the clear view that at the outset certain weightage has to be provided to such classes in the services of the Union and their Public Undertakings. Accordingly orders are issued as follows:(i) 27% of the vacancies in civil posts and services under the Government of India shall be reserved for SEBC. (ii) The aforesaid reservation shall apply to vacancies to be filled by direct recruitment. Detailed instructions relating to the procedure to be followed fOl:enforcing reservation will be issued separately. (iii) Candidates belonging to SEBC recruited on the basis of merit in an open competition on the same standards prescribed for the general candidates shall not be adjusted against tl\e reservation quota of 27%. (iv) The SEBe would comprise in the first phase the castes and communities which are common to both the list in the report of the Mandai Comission and the State Governments' lists. A list of such castes/communities is being issued separately. (v) The aforesaid reservation shall take effect from 7.8.1990. However, this will not apply to vacancies where the recruitment process has already been initiated prior to the issue of these orders. 3. Siuular instructions in respect of public sector underta1cings and financial institutions including public sectOr banks will be issued by the Department of Public Enterprises and Ministry of Finance respectively. .

Subject:-Recommendations of the Second Backward Classes Commission (M~ndal Report)-Iteservation for Socially and Educationally Backward Classes in services under the Government of India.

The undersigned is dir~cted to invite the attention to O.M. of even number datcd the 13th AugUst, 1990, on the above mentioned subject and to say that in order to enable the poorer sec:tions of the SEBCs to receive the benefits of reservation on a preferential basis and to provide reservation for other economically backward sections of. the people not covered by any of the existing sc1\emes of reservation, Government have decided to amend the said Memorandum with immediate effect as follows:2. (i) Within the 27% of the vacancies in civil posts and services under the Government of India reserved far SEBCs, preference shall be given to candidates belonging to the poorer sections of the SEBCs. In case sufficient number of such candidates are not available, unfilled vacancies shall be filled by the other SEBC candidates. (ii) 10% of the vacancies in'Civil posts and services under the Government of India, shall be reserved for other economically backward sections of the people who are not covered by any of the existing schemes of reservations. . (in) The criteria ior determining the poorer' sections of the SEBCs or the oth~r economically backward sections of the people who are not covered by any of the existing schemes of reservations are being issued separately. ! 3. The O.M. of even number dated the 13th August, 1990, shall be deemed to have been amendcd to the extent specified above.

M. dated 13-8-90 and 25-9-91 providing for reservation in civil posts and services under the Govt. of India in favour .of SEBC and other Economically Weaker Sections. In this judgement the Supreme Court has directed all concerned authorities, High Courts and Central/State Administrative Tribunals that any petition or proceedings questioning the validity, operalion or implementation of the two impunged memoranda or any grounds whatsoever, shall be filed or instituted ONLY before the Supfeme Court and not before any High Court or other Court or Tribunal. para 2.30 The Parliamentary Committee on the Welfare of SC/ST has observed in their 24th Report that in certain Departments, public sector undertakings etc. initially appointments are made on ad hoc basis followed by regular appointments. Consequently, posts reserved for SC/ST in regular appointments are not filled up. The Committee has, therefore, recommended that there should be reservation in ad hoc appointments also. 2. There are no instructions to the effect that reservations are not applicable in the case of ad hoc appointments. In accordance with the instructions contained in M. H..A.'s O. M. No. 31/10/63-SCT (I) dated 273-63 and this Department's O. M. No. 36011/12/82-Estl (SCn dated 25-6-82, a separate roster should be maintained for purely temporary appointments of 45 days or more but which have no chance whatever of becoming permanent or continuing indefinitely. Reservation do not apply to temporary appointments of less than 45 days only. 3. It is, therefore, brought to the notice of all Ministries/Departments that whenever ad hoc appointments of more than 45 days dPration are made, reservation should be provided to SC/ST in accordance with the prescribed percentages. A separate roster should be maintained by the appointing authorities in this regard as already indicated in O. M.'s dated 27-3-63 and 25-6-82.

It has been brought to the notice of this Department that vacancies reserved for SC/ST are being filled by the appointing authorities by transfer of general category candidates by relaxation of the recruitment rules instead of fJ1ling them 'by the prescribed methods of recruitment. In accordance with the provisions of this Department's O. M. No. 36012/6/88-Estt. (SCT) dated 25-4-89, there is a banondereservation of reserved vacancies to be fJ1led by direct recruitment Vacancies reserved for SC/ST and failing in the direct recruitment quota cannot. therefore, be filled by general category candidates even by relaxation of the rules. Where a reserved vacancy is to be fJJ.led and the recruitment rules do not provide for transfer as a mode of recruitment, it must be filled bya SC/ST cundidate even when it is done by transfer by relaxation of the recruitment rules. Filling up of such reserved vacancies by general category candidates by resorting to the method of transfer is not permissible. 2 The Ministries/Departments cerned for strict compliance. are requested to bring the above said instructions to the notice of all con-

The undersigned is directed to say that the Parliamentary Committee on the Welfare of SC/ST have observed in para 5.10 of the 24th Report that the information in respect of staff strength vis-a~vis shortage of staff for all the category of posts in respect of certain MinistrieslDepartments such as University services, judicial services, organised private sector had not been supplied due to non-availability of the requisite information. The Committee has recommended that the MinistrieslDepartments should ensure that up-to-date record of statistical figuresreiating to SC/ST employees should be maintained by the MinistrieslDepartments so that the same could be made available to the Committee as and when required. The Committee has also recommended that all necessary action should be taken against the MinistrieslDepartments which fail to supply the requisite information in this regard. 2 It is, therefore, requested that the statistical information relating to the SC/ST employees in respect of various offices/organisations under the control of the MinistrieslDepartments may be maintained and furnished to the Parliamentary Committee on the Welfare of SC/ST as and when required.

The undersigned is directed to say that consequent on the judgement Of the Supreme Court in Indira Sawhney and others Vs. Union of India and others, doubts have been expressed in some quarters whether the existing provisions of reservation for SC/ST in the matter of promotion are to be continued. In para 107 of their judgement in the above said case delivered on 16-11-92, the Supreme Court has given the following direction:

"It is further directed that wherever reservations are already provided in the matter of promotion-be it Central Services or State Services or for that matter services under any Corporation, authority or body falling under the definition of "State" in Article 12-such reservations shall continue in operation for a period of five years from this day". (16-11-1992). 2. In view of this direction of the Supreme Court, the existing provisions of reservation for SC/ST in the matter of promotion are required to be continued. 3. The above said position.,is brought to the notice of all MinistrieslDepartments for information and for ensuring that the existing provi~ons of reservation for SC/ST in the matter of promotion are implemented, without fail. The undersigned is directed to refer to this Department's O.M. No. 3601213119O-Estt. (SCI'), dated the 13th August, 1990 and 25th September, 1991 regarding reservation for Socially and Educationally Backward Classes in Civil Posts and Services under the Government of India and to say that following the Supreme Court judgement in the Indira Sawhney and others Vs. Union of India and others case [Writ Petition (Civil) No. 930 of 1990] the Government of India appointed an Expert Committee to recommend the criteria for exclusion of the socially advanced persons/sections from the benefits of reservations for Other Backward Classes in civil posts and services under the Government of India. 2. Consequent to the consideration of the Expert Committee's recommendations this Department's Office Memorandum No. 36012131J9O..Estt. (SCf), dated 13.8.90 referred to in para (1) above is hcreby modified to provide as follows: (a) 27% (twentyseven~ percent) of the vacancies in civil posts and services under the Government of India, to be filled through direct recruitment, shall be reserved for the Other Backward Classes. Detailed instructions relating to the procedure to be followed for enforcing reservation will be issued separately. (b) Candidates belonging to OBCs recruited on the basis of merit in an open competition on the same standards prescribed for "the general candidates shall not be adjusted against the reservation quota of 27%. (c) (i) The aforesaid reservation shall not apply to persons/sections mentioned in column 3 of the Schedule to this office memorandum. (ii) The rule of exclusion will not apply to persons working as artisans or engaged in hereditary occupations, callings. A list of such occupations, callings will be issued separately by the Ministry of Welfare. (d) The OBCs for the purpose of the aforellaid reservation would comprise, in the first phase, the castcs and communities which are common to both the lists in the report of the Mandai Commission. and the State Governments' Lists. A list of such castes and communities is being issued separately by the Ministry of Welfare. (e) The aforesaid reservation shall take immediate effect. However, this will not apply to vacancie~ where the recruitment process has already been initiated prior to the issue of this order. 3. Similar instructions in respect of public sector undertakings and financial institutions including public sector banks will be issued by the Department of Public Enterprises and by the Ministry of Finance respectively effective from the date of this Office Memorandum .

(c) parents, both of whom are Class II officers and one of them dies or suffers permanent incapacitation and either one of them has had the benefit of employment in any International Organisiation like UN, IMF, World Bank, etc. for a period of not less than 5 years before such death or permanent incapacuation; (d) parents of whom the husband is a Class I officer (direct recruit or pre-forty promoted) and the wife is a Class II officer and the wife dies; or suffers permanent incapacitation; and (e) parents, of whom the wife is a Class I officer (Direct Recruit or pre-forty promoted) and the husband is a Class II officer and the husband dies or suffers permanent incapacitation Provided that the rule of exclusion shall not apply in the following cases: Sons and daughters of (a) Parents both of whom are Class II officers and one of them dies or suffers permanent incapacitation. (b) Parents, both of whom are Class II officers and both of them die or suffer permanent incapacitation, even though either of them has had the benefit of employment in any International Organisation like UN, IMF, World Bank. etc. for a period of not less than 5 years before their death or permanent incapacitation . 1lI. ARMED FORCES INCLUDING PARAMILITARY FORCES (Persons holding civil posts are not included)

Son(s) and daughter(s) of parents either or both of whom is or are in the rank of Colonel and above in the Army and to equivalent posts in the Navy and the Air Force and the Para Military Forces; , Provided that:(i) if the wife of an Armed Forces Officer is herself in the Armed Forces (i.e., the category under consideration) the rule of exclusion will apply only when she herself has reached the rank of Colonel; (ii) the service ranks below Colonel of husband and wife shall not be clubbed together; (Hi) If the wife of an officer in the Armed Forces is in civil employment, this will not be taken into account for applying the rule of exclusion unless she falls in the service category under item No. II in which case the criteria and conditions enumerated therein will apply to her independently.

PROFESSIONAL CLASS AND THOSE ENGAGED IN TRADE AND INDUSTRY

Persons engaged in profession as a doctor, lawyer, chartered accounti:mt,Income-Tax consultant, financial or management consultant, dental surgeon, engineer,' architect, computer specialist, film artists and other film professional, author, playwright, sports person, sports professional, media professional or any other vocations of like status. in tMde, business and

Criteria specified against Category VI will apply: Explanation: (i) Where the husband is in some profession and the wife is in a Class II or lower grade employment, the .. ncome/wealth i test will apply only on the basis of the husband's income. (ii) If the wife is in any profession and the husband is in employment in a Class II or lower rank post, then the income/ wealth criterion will apply only on the basis of the wife's income and the husband's income will not be clubbed with it.

PROPERTY OWNERS

A Agricultural holdings

Sones) and daughter(s) of persons belonging to a family (father, mother and minor children) which owns (a) only irrigated land which is equal to or more than 85% of the statutory area, or (b) both irrigated as follows: and unirrigated land,

(i) The rule of exclusion will apply where the pre-condition exists that the irrigated area (having been brought to a single type under a common denominator) 40% or more of the statutory ceiling limit for irrigated land (this being calculated by excluding the unirrigated portion). If this pre-condition of not less than 40% exists, then only the area of unirrigated land will be taken into account. This will be done by. converting the unirrigated land on the basis of the conversion formula existing, into the irrigated type. The irrigated area so computed from unirrigated land shall be added to the actual area of irrigated land and if after such clubbing together the total area in terms of irrigated land is 80% or more of the statutory ceiling limit for irrigated land, then the rule of exclusion will apply and disentitlement will occur. (ii) The rule of exclusion will not apply if the land holding of a family is exclusively unirrigated. B. Plantations (i) Coffee, tea, rubber, etc. Criteria of income/wealth specified Category VI below will apply. in

(b) Persons in Categories I, II, III and V A who are not disentitled to the benefit of reservation but have income from other sources of wealth which will bring them within the income/wealth criteria mentioned in (I) above. Explanation: (i) Income from salaries or agricultural land shall not be clubbed; (ii) The income criteria in terms of rupee will be modified taking into account the change in its value every three years. If the situation, however, so demands, the interrugnum may be less. Explanation: Wherever the expression "permanent incapacitation" occur in this schedule. it shall mean incapacitation which results in putting an officer out of service.

No. 12011168/93-BCC(C).-The Government of India have had under consideration the judgement of the Supreme Court dated 16-11-92 in the case of Indira Sawhney and Others Vs. Union of India and Others (No. 930 of 1990) relating. to reservation of 27% vacancies in civil posts and services under the Government of India in favour of Other Backward Classes OBCs. 2. The OBCs for the purpose of the aforesaid reservation as per orders of the Government of India issued vide O.M. No. 36012122/93-Estt. (SCT) of 8th September, 1993 by the Ministry of Personnel, Public Grievances & Pensions (Department of Personnel & Training), would comprise, in the first phase, the castes and communities which are common to both the lists in the report of the Mandai Commission and the State Governments' Lists .. 3. The Expen Committee on 'Creamy Layer' headed by Justice (Rtd.) R.N. The undersigned is directed to refer to this Department's O.M. of even number dated the 8th September, 1993 on the above subject and to say that in accordance with the Supreme Court Judgement in the Indira Sawhney case, the reservations contemplated in clause 4 of Article 16 should not exceed 50%. For the purpose of applying the rule of 50%, an yeC'r should be taken as the unit and not the entire strength of the cadre, service or the.unit as the case may be. This position would also apply in the case of carry forward vacancies. Therefore, the Ministries/Departments are requested t<>ensure that the reservations provided to SC/ST/OBCs put together do not exceed 50% of vacancies arising in an year. 2. In the light of the reservations provided to other backward classes, it is necessary to revise the existing reservation rostcrs. In respect of direct recruitment on All India basis by open competition where there is a reservation for 15% for SC and 7-1V2% for ST, the existing 40 point-roster has been revised into a 200 point-roster as in the model indicated in Annexure-A The revised roster will come into effect immediately. Vacancies filled on or after 8-9-1993 should be shown in the ncw roster now prescribed in Annexure-A The old roster shaH be decmed to have been closed from this date. The reservations which had to be carried forward in the previous roster shall now be carried forward to the new roster. 3. There is no change in the existing reservation rosters in so far as promotion is concerned, as there is no reservation for OBCs in promotion. 4. No other relaxation/concession is admissible to OBCs. There is no provision for any relaxed standard to be applied in the case of OBCs. S. In para 2(d) of this Department's O.M. of even number dated 8thSe'Ptember, 1993, it has been stated that a list of C:lstes and communities for the purpose of the reservation for OBCs is to be issued separately by the Ministry of Welfare. The Ministry of Welfare have since notified the said list vide their Resolution No. l2011/68/93-BCC(C) dated 10th September, 1993 published in the Gazette of India Extraordinary Part I Section I dated 13th September, 1993. I am directed to say that the Government of India has issued instructions on 8.9.93 providing for reservation to Other Backward Classes in the services and posts under the Government of India (A copy of this O.M. is enclosed). The Other Backward Classes for the purpose of the above said reservation would comprise, in the first phase, the castes and communities which are common to. both the lists in the report of the MandaI Commission and the State Government's list. A list of such castes and communities was notified in Resolution No. 12011168193-BCC(C), dated 10th Sept. 1993 published in the Gazette of India, Extraordinary Part I Section I dated 13.9.93. For the purpose of verification of the castes and communities the Government of India has prescribed a certificate from the following authorities as in the case of SCIST vide this Department's O.M. No. 3601V22/93-Estt. In the light of the Supreme Court's judgement in the Indira Sawhney case, this Department has specified the persons/section ("Creamy Layer") to whom the benefit of reservation shall.not apply vide column -3 of the Schedule to the Department of Personnel and Training O.M.No. 36012122/93Estt. (SCf) , dated 8.9.93. It has been considered that the same authorities who are notified as competent to certify OBCs status should also be authorised to certify that a candidate does not belong to the "Creamy Layer". It is, therefore, requested that instructions may be issued to the District Authorities under your control to verify and issue the necessary certificate to the candidat~s regarding his OBCs status as well as exclusion from the "creamy layer". To enable the District Authorities to

examine the claims of the candidates a model format has been devised as in Annexure B.,This may be suitably revised if considered necessary. The format of the certificate that may be given by the concerned district authorities may be as in Annexure A 3. It is also requested that wide publiCity may be given to the Ministry of Welfare Resolution No. 120l1/68/93-BCC(C), dated 10-9-93published in the Gaze~ ofIndia/Extraordinary Part I Section I, dated 13-9-93 containing the list of Backward Castes as well as to DaPT a.M.No. 36012/22/93-Estt. (SCn, dated 8-9-93 which specifies the criteria which will determitte the persons who belong to the creamy layer and to whum the reservations1HnI not apply. This will facilitate the candidates to ascertain their eligibility for reservation. It would also be advisa1?le to appropriately brief the certifying Authorities and to provide them with sufficient number of copies of the above mentioned Gazette Notification and the Deptt. a.M. date 8-9-93 in order to ensure prompt and correct certification. 4. A copy of the orders issued by your Government in this regard may also be endorsed to this Department for information.

The undersigned is directed to say that in the light of the reservation provi'ded to Other Backward Classes the existing reservation roster in respect of direct recruitment on All India basis by open competition where there is a reservation for 15% for $C and 7YJ% for ST was revised to a 200 point roster vide para 2 of this Department's O.M. of even number dated 22.10.1993. 2. In respect of direct recruitment on All India basis otherwise than by open competition where there is a-reservation of 16~(1 for SC and 7Yz % for ST, the existing 40 point roster has been revised % into a 120 point roster as in the model format indicated at Annexure I. In respect of direct recruitme~to G~o.uP 'C' and 'D' posts normally attracting candiates from a locality or region, the existing 100 point rosters have also been revised as in the model indicated at Annexure II.

3. The revised rosters will come into effect immediately. Vacancies fiUed on or after 8.9.93 should be shown in the new rosters. The old rosters shall be deemed to have been closed from this date and the reservations which had to be carried forward in the previous rosters shall be carried forward to the new roster.

NEW DELHI OFFICE MEMORANDUM Subject: Reservation for OBCs in services and posts under the Government of Indiadereservation and carry forward of unfilled vacancies rcserved for OBC candidates. The undersigned is directed to say that the question of de-reservation and carry forwaret of unfilled vacancies reserved for Other Backward Classes has been examined by the Government. It has since been decided that the vacancies reserved for Other Backward Classes which remain unfilled should not be de-reserved but should be carried forward as such for a period of three recruitment years or till the vacancies are filled by OBC candidates, whichever is earlier.
