THE dilly-dallying in the Armed Forces modernization program might have emboldened foreign governments to stake their claims in the disputed islands in the South China Sea, military ofcials said over the weekend. The ofcials, who attended the Air Power Symposium held at the SMX Convention Center of the Mall of Asia in Pasay City, said that if the Philippines had sustained the defense capability that it had after World War II and up until the 1970s, Chinese vessels would not have ventured into the Panatag or Scarborough Shoal, and there would have been no standoff between Beijing and Manila today. MALACAANG said Tuesday the government had been looking to supply other markets for Philippine bananas as a result of Chinas stringent requirements on the fruit, but the Trade Department said it could not ignore the Chinese market because of its size. Presidential spokesman Edwin Lacierda said the government was in discussion with the United States the Middle East and Cambodia for the possible entry of cavendish bananas in those markets. He said a delegation would be going to the Middle East two weeks from now to explore the possibility of exporting Philippine bananas there. And Agriculture Secretary Proceso Alcala said Dole Philippines would soon be exporting bananas to the US mainland. They are now discussing freight costs, Next page Alcala said.

THE Foreign Affairs Department on Tuesday conrmed a Navy report that there are 28 Chinese vessels in the disputed waters around the Panatag (Scarborough) Shoal after earlier reporting a mutual withdrawal from the area.
Foreign Affairs spokesman Raul Hernandez said the vessels probably returned to the shoal days after they left on Friday, although the Chinese Embassy in Manila denied that China intended to pull out its ships from the area. On Monday, Hernandez reported that there were no ships from either side anchored in the lagoon of the disputed shoal as of Friday.

The Chinese shing boats have obviously returned, Hernandez said in a statement. The Navy reported Tuesday that there were three Chinese maritime surveillance ships, two sheries and law enforcement vessels, six shing boats and 17 dinghies in and around the Panatag shoal. Two Philippine vessels, a Coast Guard boat and a Bureau of Fisheries ship, were pulled out on June 18 because of the bad weather brought about by Typhoon Butchoy and had not returned. Beijing on Monday urged the Philippines not to exacerbate the situation in the South China Sea, which Manila refers to as the West Philippine Sea. At a press conference, Foreign Ministry spokesman Hong Lei questioned the establishment of a Philippine kindergarten on one of the disputed islands and called it a violation of Chinese sovereignty. Asked whether the Chinese ships had withdrawn from the Panatag Shoal, which Beijing calls Huangyan Island, Hong said the Chinese government maintain jurisdiction and vigilance over the area. MALACAANG on Tuesday tossed back to the provincial governors their remarks on an unsigned executive order spelling out the governments mining policy, calling their threat to oppose the order as spitballing. Presidential spokesman Edwin Lacierda asked the local ofcials to wait and put on hold their concerns because changes were being made on the initial draft after the consultations with various sectors. We will just be spitballing here until we see the provisions of the executive order. Its just all talk, Lacierda said. Lacierda said Salcedas threat to go to court was premature and stressed that local laws cannot supplant national laws. Drilon, who was earlier reported to be among those being eyed by President Benigno Aquino III as a possible replacement for impeached Chief Justice Renato Corona, was nominated through a letter from lawyer Nicasio Tan. Workers Party slammed the Aquino administration for agreeing to lend $1 billion to the IMF. The IMF will use our $1 billion---which is the blood and sweat of the Filipino workers overseas---to bail out the bankers of Europe and squeeze money from the workers through cuts in wages, pensions, subsidies and social programs, group chairman Renato Magtubo said. Recto said the $1-billion loan to IMF could be better used to bankroll projects that would have a big impact such as school buildings, hospitals and other key infrastructure. The [Bangko Sentral] could remit the amount as dividend to the national government and use it for the countrys so many needs, Recto said. Or the [Bangko Sentral], like a regular bank taking care of business, could loan the amount directly to the national government under the same interest rate that it would get from the IMF. Defense Secretary Voltaire Gazmin said the Armed Forces was waiting for orders from President Benigno Aquino III to resume maritime patrols near the shoal. The Philippines and China have been locked in a standoff since April, when Chinese ships stopped the BRP Gregorio del Pilar from arresting Chinese shermen who were caught poaching protected maritime species in the area. The Coast Guard on Tuesday continued an aerial search for four missing Filipino shermen after their boat was rammed by an unidentied vessel in the waters off Bolinao in Pangasinan, leaving one of them dead and four others missing. The Coast Guard denied earlier reports that identied the Hong Kong-registered ship, the MV Peach Mountain, as the vessel that rammed the shing boat and left the area without rescuing the shermen. Presidential spokesman Edwin Lacierda also cleared the vessel. I have talked to Defense Secretary Voltaire Gazmin and, based on the investigation, the vessel had the markings of Hong Kong, Lacierda said. The Philippine Navy is conducting an assessment of the route and speed of the vessel, but this is not the MV Peach Mountain. This is another Hong Kong vessel that rammed our shermen, Lacierda said the government expected the operator of the Hong Kong-registered vessel to cooperate with Philippine authorities. He said the family of the dead sherman was given burial assistance of P10,000 and a family food pack. The Palace also gave the families of the other shermen P5,000 and family food packs. Senator Edgardo Angara on Tuesday warned the administration against premature ngerpointing. We should rst verify if China was indeed responsible for this incident to avoid inaming territorial tensions, said Angara, the vice chairman of the Senates foreign relations committee. He warned that a misstep would hurt efforts to resolve the territorial dispute between the two countries diplomatically. In the House, Quezon City Rep. Winston Castelo proposed a joint declaration of the entire Spratly Islands and the West Philippine Sea as an international maritime reserve as a middle ground that could dissipate the rising tension in the area. SENATOR Ralph Recto on Tuesday demanded that the Bangko Sentral explain why the Philippines would lend $1 billion to the International Monetary Fund when the country was continuously borrowing money from international lending and multilateral institutions for budgetary support and decit spending.
In a statement, Recto asked why the central bank would risk denying the Filipino people its sovereign claim to $1 billion worth of projects and programs that could change their lives even for a little bit. New storm to bring rain to Visayas and Mindanao


A LOW-PRESSURE area off Virac in Catanduanes has developed into a tropical depression and has been named Dindo, the weather bureau said Tuesday. The storm was spotted 670 kilometers east- northeast of Virac and had maximum sustained winds of 55 kilometers per hour, weathermen said. It was forecast to move west-nsorthwest at 19 kilometers per hou and affect the Visayas and Mindanao before heading to Japan. Weathermen said the Visayas and Mindanao would be experiencing occasional rain starting Tuesday afternoon, which would become frequent over the western sections. Southern Luzon will have cloudy skies with scattered to widespread rain showers and thunderstorms, which may trigger ash oods and landslides. Unlike Drilon, Santiago voted to acquit Corona during the impeachment verdict. Drilon and Santiago aside, six others were added to the initial list of candidates for chief justice: former Ombudsman Simeon Marcelo, constitutionalist and Ateneo law dean emeritus Joaquin Bernas, Camiguin Rep. Pedro Romualdo, Cagayan De Oro Rep. Rufus Rodriguez, Court of Appeals Justice Vicente Veloso, and University of Perpetual Help System law dean Ed Vincent Albano. Abdusakur Tan said Interior Secretary Jesse Robredo had called him up to clear up the conicting information on the status of Baker Atyani. He said Robredos information that Atyani was being held against his will came from another source and not from the Provincial Crisis Management Committee. Tan insisted that the Jordanian journalist was not yet a hostage or a kidnap victim despite the claim by the National Police.

Earlier, a Dole ofcial who declined to be named said Philippine bananas had nally gained entry to the US fresh fruit market with the company set to ship out the countrys rst-ever cavendish trial shipment to the United States. The ofcial said they would be starting out with one container van per week, and that they were expecting the demand for bananas in the US to increase. Domingo said the Chinese market accounted for a third of the Philippines banana exports before Manilas dispute with Beijing over the Scarborough Shoal broke out. Right now we are looking at other alternative markets in the region, Domingo said. But he ruled out the possibility of exporting more bananas to Japan, its biggest market for the fruit, because the Philippines is already supplying over 90 percent of Japans requirements right now. In his bill, Mr. Aquino said the nominees bypassed for three consecutive times would be declared ineligible and would be barred from reappointment by the same President to any position. A few good men and women


commissions are subject to approval by the commission, which is made up of 12 senators and 12 congressmen and presided over by the Senate president. The Constitution stipulates that the President has the power to make appointments when Congress is in recess, but those appointments will be effective only until disapproved by the Commission on Appointments or until the next adjournment of the Congress. The commissions rules are clear that these provisions were aimed at creating a system of checks and balances in the way the government is run. The Commission, being part of our republican system of checks and balances, shall act as a restraint against abuse of the appointing authority, to the end that the power of disapproval should be exercised to protect and enhance the public interest, unconvinced and the bill never passed. Still, if Mr. Aquino truly believed what he said then, he should not have reappointed Social Welfare Secretary Dinky Soliman and Justice Secretary Leila de Lima eight times, Interior Secretary Jesse Robredo four times, Tourism Secretary Ramon Jimenez Jr. three times, Audit Commissioner Heidi Mendoza four times, and Environment Secretary Ramon Paje ve times on June 7, after Congress was adjourned. All of these appointees had failed to win conrmation from the commission because of unresolved questions regarding their competence, ethical behavior or tness for the job, and Mr. Aquino must indeed be hard pressed to nd good help if he turns to the same rejected names again and again against the very principles he championed as a senator.

FINDING good help is such a chore these days, especially if you are the President. After all, what other reason can there be for President Benigno Aquino III to reappoint ve ofcials who have failed to pass muster with the Commission on Appointments not once, not twice but at least three times now? Mr. Aquino had condemned such practice when he was a senator, but now that the shoe is on the other foot, he seems to have no problem following the same road trod by his predecessor, President Gloria Macapagal Arroyo. As anyone who has studied the Constitution knows, the presidential appointments of heads of executive departments, ambassadors, other public ministers and consuls, military ofcers from the rank of colonel or naval captain, and the members of constitutional

REGARDING the much-ballyhooed and much-delayed executive order (or revised policy statement, as the Aquino administration sometimes calls it) on mining, this is what I fail to understand: There already is a Mining Law whose legality has been upheld by the Supreme Court. There are approved implementing rules and regulations that further spell out what details the law, presumably, has not discussed. So, what do we need an executive order for, if not to twist what the law and the implementing guidelines already tell us, to further the specic agenda of this administration or to favor the mining companies it likes? Or is a Palace directive necessary to allow President Noynoy Aquino to make adjustments for other special interests like the anti-mining groups led by the sister of the owner of a powerful media outt? These questions are important because it appears that the Aquino order will apparently be no different from what is already spelled out in the law, like the primacy of national legislation over local ordinances when it comes to approving mining claims. Of course, by the same token, a mere executive order cannot really go against an approved law, thus making the signing of an Aquino EO unnecessary, to say the least. The issuance of a superuous policy order about a very specic law that already has its own evenmore-specic guidelines that have been approved by the court is merely giving local executives the opening to challenge the order in court, as Albay Gov. Joey Salceda has already threatened. And that means only further delays for the mining industry and the benets that will be reaped by both the national and local governments and the communities where they will operate. The truth is, the fabled wishy-washiness of the Aquino administration is on spectacular display here. Of course, most people already have a name for that: noynoying. *** In a perfect world, Senator Miriam Defensor Santiago would be the handsdown favorite to be appointed the next chief justice of the Supreme Court. There is simply no other candidate more demonstrably intelligent, experienced, accomplished and independent than Santiago amongst the current crop of nominees to the position. But precisely because of all her sterling qualications, Miriam has about the same chance of getting

appointed chief justice as being named to the United States Supreme Courta tribunal that, had Santiago been born an American instead of an Ilongga, will certainly be improved by her perspicacious presence. There is, too, the small problem of Santiagos being the quintessential politically incorrect choice under an administration that will only give key positions to people who have demonstrated the most canine loyalty to the current appointing power. Indeed, its often said that the key difference between this Aquino administration and the similarly surnamed one that was installed in 1986 is that Cory (for all the accusations that she was as clueless, if not more so, than her son) was unafraid to surround herself with people she did not personally know and who were acknowledged experts in their respective elds. The reason why the KKK story has had amazing longevity, after all, is that President Noynoy Aquino has made it his top hiring policy to reward nobodies to positions of great power, as long as they are his former classmates, shooting buddies and other people with close personal ties to him. If Aquino had the stones and the gray matter to do whats truly right, he would use all his vast powers to persuade the Judicial and Bar Council to include Santiago in the short list of nominees to head up the highest court in the land. And then proceed to appoint Miriam to the post, simply because that is the true straight path. But anyone who thinks this scenario has any chance of coming to pass must have his head examined, while Miriam laughs herself silly in the background. Its just not going to happen. No freaking way. Right now, even as the number of nominees inches inexorably to record highs, the seeded candidates remain the same: a former Cojuangco family lawyer who was tipped for a high court justices position from the beginning of this administration but who was sidetracked to a top legal post in the executive simply because the original appointee messed up big time; the justice handpicked by a law rm that is hell-bent on regaining its absolute control over the entire Judiciary; and a bunch of butt-ugly, sycophantic shrews who already hold top positions but who are falling all over themselves to snag the chief justiceship, even if their only real qualication is their constant and sickening brownnosing to Aquino himself. Miriam, whose legal prowess has already been conrmed by her appointment to the International Criminal Court, just doesnt stand a chance. And that is our common loss, even more than it is Aquinos.

Syria, the promised land


SYRIA is in the throes of a civil war. But for some gullible Filipinos desperate for work, it can well be the promised land. Its hard to believe but criminal labor recruiters are still able to dupe Filipinos with promise of work in the violencewracked Middle Eastern country. Like silent lambs, the victims who are mostly women are shipped by way of Sabah from the Philippine south and then own to Damascus, the Syrian capital. The past few months, the Philippine government was able to repatriate 1,500 Filipinos from Syria. Either this latest wave of Syria-bound Filipino workers are dumb, dont read the news, or too desperate for work that they couldnt care less if the road to Damascus is paved with land mines. But there is an even dumber proposal from the House. Quezon City Rep. Maria Theresa Bonoan David wants to impose a $50 contribution from departing Filipino workers as if they are not saddled enough with nancial burden just to leave this benighted land. This, Bonoan David said, was to cover the cost of repatriation when the government has to evacuate them in cases of emergency like civil war, natural disasters or when these migrant workers are left stranded in some strange land by labor recruiters who had hoodwinked them with promise of work. The cost of repatriating these hardlucked migrants is the obligation of

the state. After all, when they are gainfully employed, they pay taxes to the government, help the economy with their remittances to kith and kin who otherwise would add to the rolls of the Conditional Cash Transfer doled out by Dinky Soliman in line with the national policy of perpetuating mendicancy Susan Toots Ople of the Blas F. Ople Policy Center aptly describes Bonoan Davids HB 6195 as insane. Miss Ople, a staunch advocate of labors rights and welfare, decries Bonoan Davids measure as just another form of tax. The Quezon City congresswoman is not totally mindless. Feeling the backlash from Filipino overseas workers and Migrante, the leftist militant labor watchdog, she has withdrawn her proposalmindful of votes she could lose. Susan is the daughter of the late Blas Ople, former Senate president, foreign secretary and labor minister who fathered the Overseas Filipino Workers Act. A former labor undersecretary, Susan who lost in her 2010 senatorial bid should make another run for the Senate. If the Liberal Party is looking to complete its 2013 senatorial slate, Susan Ople would certainly be an asset to the party. Miss Ople studied at Harvards Kennedy School of Public Administration What will happen to the proposed $50 contribution fund if implemented, since emergencies are not year-round occurrences? There are host countries that are stable; hence, repatriation is not necessary. The fund would only grow into a fat kitty that could tempt corrupt ofcials to dip their hands into it. Besides, this is a redundant , onerous

tax since the migrant workers are already contributing to the Overseas Workers Welfare Fund. Has Bonoan- David never heard of it? The overseas Filipino workers compose a large constituency and Susan Ople is recognized as one of its champions. So, why didnt she win in 2010? The simple answer is Susan does not have the wherewithal for a sustained senatorial campaign. Large campaign contributions come from big business. Why would prot-driven companies support Susan who ghts for workers rights? How come organized labor is not keeping the pressure on the politicians and big business to end their contractual hiring policy? Because the contract is only good for ve months and renewable only at the companys discretion, the employee at the end of his/her contract will have to start looking for another job. The widespread practice of sourcing employees from an employment agency spares the company of having to deal with a troublesome union. It also saves the rm the additional expense of providing workers benets such as medical insurance, bonuses, separation and retirement pay, plus having to remit its share to the Social Security System. Is it any wonder why many of our people are voting with their feet and braving bullets in strife-torn countries like Syria, Libya, Iraq and other godforsaken places? Meanwhile, instead of spending money for job generation, the government lent $1 billion to the International Monetary Fund to bail out distressed European economies. Now, that is insane!

IF THERE is any move to make Dolphy a national artist for lm, the best time for it is now, while the king of Philippine comedy still lives. As everyone knows, he is bed-ridden and ghting for his life. Many continue to pray for him, but he may not have much longer to live. In fact, now and then we read that the end has come, and each time his son Eric has to set the record straight. Reports of his passing are grossly exaggerated, Mark Twain would have said. But it would be most tting if President Benigno III could rst make good the award which his predecessor, Gloria Macapagal Arroyo, had conferred on Fernando Poe. Jr., the late king of Philippine movies, but which was never really physically delivered. This happened in December of 2004 as FPJ lay dying at St. Luke Hospitals intensive care unit. That award was never made good. After the 2004 electoral asco, FPJs family did not want to have anything to do with GMA or the award, and to this day they have not seen the ofcial plaque of conferment, nor have they received any of the benets for the family of a deceased national artist. At the time, the wounds inicted by the May 2004 presidential elections were still fresh. Millions believed FPJ, not GMA, had won, and at the proper command from the proper source, they would have stormed Malacaang at a moments notice. Susan Roces Poe, FPJs widow, and her family must have felt the award was being given purely

THE Aquino administration is lending $1 billionto be taken from the countrys gross international reserves to the International Monetary Fund to help prop up debt-ridden European countries. This is just pathetic. Are we a poor country trying to appear rich? I am not at all amused. We cannot even provide a decent health care program for our citizens, and pay our teachers, and build enough classrooms and install sanitary facilities. And yet we want to help the Eurozone? I recall that last year, when some parts of Japan were devastated by the twin tragedies of earthquake and tsunami, President Aquino handed out a $1-million aid to those prefectures. The Japanese must have laughed! Malacaang and the Bangko Sentral insist that the $1-billion loan, being such, would earn interest, and that it would indicate that the Philippines is economically stable. Oh yeah? Arent we ourselves bogged down by a debt of more than a trillion pesos? It is obvious that Aquino is just trying to win pogi points among the other members of the IMF. But as I said, its pathetic. How can $1 billion help when those countries are each indebted by the billions? Another thingwhen we borrow from the IMF, there are so many conditionalities. Still, the Aquino administration just wants the world to know that a poor country like the Philippines can afford to lend what it cannot give its people. That is criminal! *** The threat of blackouts in Luzon is real. The available power supply has sunk to precariously low levels. In fact, the brownouts may hit us sooner than expected. Based on data from the National Grid Corp. of the Philippines, Luzons grids power supply reserves are already thin at only 101 megawatts, placing the entire island of Luzon on yellow alert. This means that any further outage, even from a single power plant, can cause blackouts. The government has been wishywashy over the power supply problem. There have been assertions that the Luzon grid enjoyed a healthy buffer of about 1,700 MW to as much as 2,000 MW on any given day. Those who should be concerned do not realize that there could be drastic reduction in power supply reserves with the breakdown of several critical facilities and periodic maintenance of other plants. There was already a sign of this last week when the Sual (Pangasinan) coal-red power plant tripped, removing 550 MW of supply from the grid. Its worse since it would take six to eight weeks to complete repairs at this plant. Note that the Sual plant contributes heavily to the power grid of Luzon. There are also the 300-MW unit at Calaca coal-red power plant in

for political reasons, to mollify the angry crowd, and not because FPJ had long deserved it. So they did not want to accept it. They snubbed the awards-giving ceremony in Malacaang, but sent a representative to accept the tribute paid by FPJs fellow artists at the Cultural Center of the Philippines, led by lm director Eddie Romero, the national artist for lm. So many years of pain and anguish have passed. It is time for the government to correct the injustice. I understand Vice President Jejomar C. Binay, a good friend of FPJ and a strong supporter of Philippine cinema, has spoken to Malacaang about it. PNoy has everything to gain and nothing to lose by acting on it now. It would be good to honor Dolphy with his award. The nation owes them this. At 83, the comedy king has lived a full life. For at least two generations, he made the nation laughon radio, television, lm, and stage. Laughter was his common gift to all, rich and poor, young and old. Wholesome, earthy, infectious laughter, which made women rush to the bathroom or slap their thighs or somebody elses back. Slapstick comedy, no doubt, but no one was above it. Yet Dolphy has not only made us laugh. He has also made us think. During a season of political drought, after the political parties had lost all compunction about drafting popular incompetents for high elective ofce, somebody approached Dolphy to suggest that he run for president. And without batting an eyelash, as the saying goes, he replied, Ayoko, baka manalo ako. (I dont want to; I might win.) In a culture and trade where winning has become the ultimate and only objective, no statement could be more absurd. He looked completely winnable, to use the current grammatical atrocity, and he seemed completely mad not to waste upon it even a moments thought. The other fellow thought the comedy king was just trying to be smart-alecky, but to his immense surprise, the funnyman really meant what he said. Dolphy obviously knew the distinction between government and entertainment, and did not want to inict himself upon the one just because he had been an enormous success in the other. His genius to make crowds laugh did not permit him to have any illusion that he could organize a Cabinet, command an entire army, or lead a sober and sound democracy. He probably had seen enough celebrities who have tried to enact their crudest jokes into law or reduce the Constitution and the nations laws into a joke. He obviously knew the true meaning of popularity and did not think of it as an all-weather word that could shield ones personal weaknesses and limitations from public scrutiny. Without having read Bagehot, he probably had his own aversion to men and women who were popular for no other reason than that they were popular, even though they have never performed a single deed nor given expression to a single idea that improved lives or inspired others to think challenging thoughts or lead less supercial and sinful lives. Dolphys immortal quote comes to mind at this time not just because of the medical bulletins which could change the color of the skies soon enough, but because of the onset of the season when certain characters who have never been associated with the public good, or with the serious discussion of large public issues, are being advertised as the brightest stars in this dark and starless night in our nations politics.

Batangas that must be repaired. A 382MW unit at the Pagbilao coal-red plant in Quezon is also out because of scheduled preventive maintenance. Its during the rainy season, when power demand is thin due to cooler weather, that power plants undergo preventive maintenance. This is actually the reason that Energy Secretary Jose Rene Almendras is pushing hard for the construction of a 600-MW coal-red power plant at the Subic Freeport. But it seems hes having problems because of opposition. I recall that when power outages threatened Visayas and Mindanao, sitting administrations did not do anything about the problem. In fact, they dismissed it. As a result, Mindanao suffered blackouts ranging from four to eight hours. I dont want to go through those dark ages again! *** It looks like Senator Aquilino Pimentel III will not stay with the United Nationalist Alliance of Vice President Jejomar Binay, former President Joseph Estrada and Senate President Juan Ponce Enrile. That is, if UNA will have former Senator Juan Miguel Zubiri as senatorial bet for 2013. Its now pride and lack of magnanimity on the part of the young Pimentel. He has conviction, sure, but he is entirely unreasonable! Pimentel himself admitted that Zubiri did not cheat in the 2007 senatorial elections but only beneted from it. But is Pimentel even sure that he would win? *** Theres logic and reason to the calls in Congress and even among members of the Commission on Appointments to limit the number of times a President can reappoint bypassed members of the Cabinet and others within the ambit of the commission. It is unconscionable for the President to keep on reappointing members of the Cabinet who have been bypassed numerous times. When they are bypassed, thats already in indication that they are ineligible for the position. Perhaps, one, two and even three times, but, Santa Banana, not more than that! Read this and weep: As of June 7, when Congress went on sine die adjournment, President Aquino had reappointed Social Welfare Dinky Soliman and Justice Secretary Leila de Lima eight times. Boy, thats a record. Department of the Interior and Local Government Secretary Jesse Robredo has already been bypassed four times; Tourism Secretary Ramon Jimenez three times; Environment Secretary Ramon Paje ve times. Commission on Audits Heidi Mendoza has been bypassed four times. The reappointment is itself an indication of the utter disrespect by a President for the commission. Will these ofcials stay forever in the government? Most importantly, this raises the question of responsibility, integrity, competence and accountability of every public ofcial. The fact that they have been bypassed says a lot.

Losing loose change


ARE WE THERE YET?
WHEN ABS-CBN launched last June 12on the occasion of the 114th celebration of the countrys independenceits Bente-singko para sa Kabayan ko (Twenty-ve for my fellow Filipino) project, I balked. The project is a donation drive that aims to get people to donate loose change for charity. But its really a public relations stunt meant to highlight the fact that the stations agship news program TV Patrol happens to be celebrating its 25th year anniversary this year. I have issues with such projects aside from its being unoriginal and, well, insincere. I wonder what it will take for people in this country to realize that projects like these contribute to problem of shortage of coins in circulation. The shortage is painfully evident in major stores and food chain outlets. It has become customary for cashiers to ask customers to give the exact amounts for their purchases, or at least for whatever coins the customer has in his or her possession. Recently, some stores have come up with what they think is an ingenious idea but which is truly infuriating: Asking customers to donate their change to some project that the store has chosen. What rankles is not that people are being asked to give to worthy causes, its just that no one likes being held hostage at checkout counters. The worst situation is when cashiers actually ask customers to forfeit loose changeits like being

asked shamelessly for a tip. Of course this wrinkle could be avoided altogether if only our leaders have the political will to totally do away with coins like some other countries. Or if stores simply peg the prices of their merchandise at the lowest round gure; instead of charging people P216.75 for, say, a shirt, they could just lower the price tag to P215. The absence of altercations at the checkout counter would probably boost productivity and earn more goodwill for the stores. But since we live in an imperfect world made doubly difcult by the absence of strategic thinking on the part of our leaders, we have to contend with the shortage of coins. It is easy to gure out why we have a shortage. Most of our coins are in various receptacles gathering rust and dust. Most of these receptacles are tied to various donation drives. Practically every worthy cause has come up with their own campaign to solicit coins from people and have come up with their own variation of the piggybankfrom ordinary plastic bottles repackaged as coin banks, to specially designed cans with slots where people can drop coins, to plastic contraptions fashioned into houses and other shapes, to ceramic gurines. Many of these receptacles, in fact, have been designed to be disposablethey need to be lled to the brim before they can be collected and disposed of. As a result, the coins that are dropped into these donation contraptions are not regularly collected, deposited in banks, and returned to circulation. A friend who works as a cash manager in a major store even told me that many organizations even forget about the coin receptacles that they leave in their stores. I can just imagine how many thousands of these coin receptacles are

currently just sitting in some counter or ofce table, almost forgotten. Of course the government cannot keep on minting new coins. Aside from the fact that coins are very expensive to produce (our coins are made of metal elements), it would also be disastrous to the economy if the Bangko Sentral were to ood the market with too many coins. So whenever some organization comes up with yet another of these coin donation campaigns, I am tempted to question the sanity of the organizers. Really, folkscant you come up with a more inspired fund-raising project? I think there was wisdom in the Pondo ng Pinoy (Pinoy Fund) project, which is widely acknowledged as the rst successful coin-donation campaign to be launched in this country. Yes, I am aware that those ubiquitous cans of the Salvation Army, the Red Cross, Bantay Bata and other causes were already there before Cardinal Gaudencio Rosales (then Archbishop of Lipa) launched the coin-donation campaign that gave life to the Theology of the Crumbs. Pondo ng Pinoy is a mass-based campaign that aims to propagate the idea that when crumbs are put together they can make a major difference in the community or in the lives of others. It promotes giving to charity even among the poor. But surely we do not have to follow the Pondo ng Pinoy model for all our charity projects! I am not sure of the wisdom of propagating the idea that token donations to charity is enough, particularly if one can give more. We should all be encouraging people to give more than just token donations to charity or other worthy causes. The way I see it, this country would be in far better shape if only most of us do something for others beyond giving crumbs.

Amid the glamor of her important job, Slaughter found herself wondering whether she had made the right choice living in Washington, especially as her 14-year-old son had resumed his habit of skipping homework, disrupting classes, failing math and tuning out any adult who tried to reach out to him. Her husband was doing his best to deal with the boy, but it seemed that it was not enough. In January 2011, Slaughters public service leave at Princeton University was due to expire. If she did not come back, she would lose her tenure as an academic. She resigned her State Department job and moved back home. Not that shes staying at home doing nothing. Shes back at the university, gives speeches and writes foreign policy papers left and right. But at least shes thereand feels she made the right choice. Did she cave in? What happened to the much-ballyhooed drive to succeed, to be at the top of her game, to have it all? In her essay, Slaughter wonders

whether the previous generation of feminists and high-prole career women, role models all, promised too much to younger women: that it WAS possible to have fullling careers and equally fulfilling home lives. If they didnt, something was wrong with them. Another high-profile mother is Myanmar s Aung San Suu Kyi. Her recent trip to Europe, her rst in 24 years, was much publicized. She received her Nobel Prize in Oslo, Norway and her honorary doctorate from Oxford University in England. She addressed British leaders at Westminster Hall, only the second woman to do so after the Queen. In her home country, she is a symbol of hope and unity. Around the world, she is regarded as the personication of grace, courage and principle. But at what cost? She left her family a husband and two teenage boys in London in 1988 to go to Burma, supposedly for just a week to tend to her ailing mother. She did not know that her mere presence in her country would change the political equation there. She

opted to stay and refused to leavenot because she was held as prisoner, but because of fear she would not be allowed back. She stayed on and has now been elected to parliament amid encouraging signs of reform. What are perhaps most touching are the images of Suu Kyi with her sons, now grown men, and grandchildren. She was not there for her boys while they were growing up. She was not able to see her husband before and after his death. There is no doubt that Suu Kyi has made extraordinarily tough choices between her personal and public lives. Do we conclude that Suu Kyi doesnt have it all? Anybody who believes that a woman can have it all must be delusional. Two weeks ago I was part of a group that interviewed female ofcers of the Philippine National Police, one of which was Director for Community Relations Lina Sarmiento, who just last week became the rst two-star woman police general in the country. Sarmiento said that it was tough to not be available for her children, to help them with their

lessons, for instance, because she was always out on duty. Fortunately, she has many brothers and sisters willing to take on her functions, enabling her to prove herself at the male-dominated police force. Other police officials like Emma Libunao and Grace Madayag who both enjoy strategic positions in the PNP volunteer that they are not married. They do not think any man would understand the demands of their calling. Can we say they dont have it all, because their success is not without complete with a husband and children, just as we can argue that college graduates who are now stay-at-home mothers are not successful? But who are we to say what all encompasses? Of course you cant have everything. Life is tough and full of harsh realities, biases and conicts. A truly empowered woman can have as much as she wants, just a little, or nothingbecause it is only she who can dene what her all is. The good news is that it is up to her. adellechua@gmail.com

106 people saved from trafficking syndicates


AT LEAST 106 people have been rescued from syndicates engaged in trafficking of humans as a result of the intensified efforts by the Inter-Agency Council against Trafficking. Vice President Jejomar C. Binay said that 85 of the victims were rescued on June 4 by members of the Zamboanga Sea-Based AntiTrafcking Task Force on board the ML Kadrina at the boundary of Zamboanga and Pilas Islands. This is one of the biggest hauls we had this year. We intercepted 150 people who were on board. But only 65 were ofcially declared on the ships manifest, Binay said. What is worse was that the lives of the passengers were also put at risk because the boat was overloaded, he said. The task force began monitoring the boat on June 4 after receiving information that it was to transport 40 victims to Malaysia via Taganak. Ten other people were intercepted at the Ninoy Aquino International Airport Terminal III on June 12 after causing a commotion that caught the attention of IACAT agents at the airport. It turned out that the passengers wanted to file a complaint against their recruiter who processed their travel documents and promised

Congress boosts terror-laundering laws


TWO weeks after the Senate and the House of Representatives ratied two bills that amended the anti-money laundering law and the anti-terror nancing law, Senator Teosto Guingona III said the country is now spared from the apparent backlash that could disrupt the remittances of Filipino workers overseas. Everything that the Philippines worked for has nally paid off as the Financial Action Task Force has recognized the efforts of the Philippine government to craft measures that will strengthen the AMLA law, said Guingona. During the FATF meeting in Rome, its member-countries agreed to accept and appreciate the two laws ratied and signed by President Benigno Aquino III on June 18. FATF even upgraded the countrys dark gray list to gray. The bills seek to empower the Anti-Money Laundering Council to inquire into not just the main account but also related accounts, dened as other bank deposits, investments, or other monetary instruments, owned or controlled by the person whose account is the subject of freeze order, or the funds of which originated from, or were transferred to such account. As chairman of the senate Blue Ribbon Committee, Guingona said he had witnessed the usual scheme wherein unlawfully acquired or stolen funds from government are moved from one account to another to conceal from authorities. People have laundered funds from their accounts to the accounts of their wives, brothersin-law, drivers, and every conceivable person within their network, he said. Another provision of the law penalizes any person who assisted the principal of the crime by concealing or destroying the effects of the crime, or by harboring or assisting the escape of criminals. Since terrorism essentially depends on the nancing it may obtain, it is a matter of grave and urgent concern to any reasonable government to criminalize the nancing of terror, said Guingona. FORMER president and Pampanga Rep. Gloria Macapagal-Arroyo has pushed for a bill seeking a full share of the Internal Revenue Allotment for new barangays. Cameras keep an eye on tollway


THE South Luzon Expressway has positioned all-weather rotating cameras at strategic points to monitor trafc, ensure quick response during emergencies, and complement regular patrols along the busy route stretching from Alabang to Sto. Tomas in Batangas. The tollway operator issued the statement in the aftermath of a mishap last Monday involving an LPG gas cylinder which blew up on the highway as a result of driver error. The South Luzon Tollways Corp. said pan tilt zoom cameras are linked directly to the Trafc Control Center. The cameras are an integral part of our trafc monitoring system and these complement our regular patrols at the SLEX, SLTC president Shadik Wahono said. Acquired in 2010, the PTZ cameras are also widely used for trafc monitoring and provide exible view selection and wider range for observation, allowing for a quick response time to accidents and incidents of less than 10 minutes. With these, we are able to constantly monitor movement of motorists, trafc situations and incidents for immediate coordination with eld personnel, emergency medical services, PNP-HPG, Bureau of Fire Protection and other government and non-government agencies,he said. Only 607 towns, cities have maternity clinics

AN eight-year old Burmese boy, who was kidnapped in Laguna last Friday, was rescued by agents of the National Bureau of Investigation during an operation at Pines Ville Subdivision in Barangay Dolores in Taytay, Rizal at 9:30 a.m. on Tuesday. Justice Secretary Leila de Lima identified the victim as Reynald Chew, a second grade pupil of the Montesorri Children Woodside in Binan, Laguna. The victims father Kyi Maung Chew and mother Khin-Khin Lin Chew, both Burmese nationals, thanked De Lima and the NBI after they were reunited with their son. According to police records, the victim was aboard a schoolbus along with 14 other children on their way to school when a red Nissan Sentra (TBK 827) blocked their path along the national highway in Barangay San Francisco around 7:30 a.m. Witnesses said three men got off the Nissan Sentra and entered the service van while a fourth remained inside the car. ONLY 607 of the countrys 1,646 towns and cities have at least one Philhealth-accredited maternal care provider, and that may be one of the reasons maternal mortality rates have gone up from 162 deaths per 100,000 births to 221 per 100,000 births in 2010, or 12 women dying daily.
Philhealth president Dr. Eduardo Banzon said maternal deaths during pregnancy or delivery are primarily due to delays in seeking medical care, in reaching appropriate care or in receiving care at health facilities. To address these delays, he said PhilHealth has started providing coverage for facility-based deliveries since 2003 through its Normal Spontaneous Delivery Package for accredited government and private hospitals and Maternity Care Package for non-hospital facilities. Over the years, the package has expanded from covering only the rst normal delivery at P4,500 to four deliveries at P8,000. The package also ensures the delivery

of both prenatal to postnatal care while Philhealths no balance billing policy for all member types removes any cause for worry when mothers deliver in PhilHealthaccredited non-hospital facilities and government hospitals. He also stressed it is also important to ensure that mothers are enrolled in the National Health Insurance Program to make them eligible for the package. The package is there, but there remains to be signicant barriers to access to this package. This is precisely why we launched the 1MOM (1 Municipality, One Maternal Care Provider) campaign, said Banzon. He cited the increase in the number of accredited Philhealth facilities to 998 as of March 2012 from 198 since it was founded 17 years ago. Despite the increase in number, however, Banzon revealed that their distribution still

makes Philhealth-accredited facilities scarce in many parts of the country, thus sparking the need for the 1MOM campaign, which is a call to action for players within and outside the health sector. If you believe that its unacceptable that our mothers are dying, join us in this campaign. There are many opportunities for you to contribute, Banzon urged. Among the areas of collaboration are developing management skills of frontline providers including midwives, generating resources for health facility enhancement to improve delivery of basic and comprehensive emergency care and designing creative information, education, and communication programs for mothers. He said the 1MOM campaign promotes access by proactively ensuring that there is at least one PhilHealth-accredited provider in each municipality.

THERE are 5.4 million working children in the Philippines and 2.9 million of them are performing hazardous work, according to a survey made by the National Statistics Office. The 2011 survey on children was a rider to the NSOs October 2011 Labor Force Survey and does not reect data on worst forms of child labor, which includes all forms of slavery, trafcking, recruitment for armed conict, prostitution and and other illicit activities, like drug trafcking, the agency said. Of 5.4 million working children, aged 5 to 17 years, 55.1 percent, or 3.02 million, were counted as child labor and 2.9 million or 54.5 percent reported to be exposed to hazardous child labor. Under the law, child labor is dened as any work or economic activity performed by a child that subjects him to any form of exploitation, or is harmful to his health and safety or physical, mental, or psychosocial development. On the other hand, hazardous child labor refers to employment in industries and occupations designated as hazardous under the countrys working standards. On the other hand, the Department of Labor and Employment said the government is determined to make every barangay in the country free of child labor to accomplish the countrys goal of reducing child labor by 75 percent in 2015. AN American fugitive who has been wanted for fraud in the US and a German convicted of a sex offense in the Philippines were deported by the Bureau of Immigration and banned from returning to the country. Deported and included in the bureaus blacklist were American William Elliott Phillips III and German national Dieter Manfred Vinzentz. Phillips has been wanted by a US district court in northern Ohio where he was charged with conspiracy to defraud the US and making a false personal income tax return. QC to shut down 34 UP dormitories

AROUND 34 boarding houses and dormitories in Barangay Krus na Ligas in Quezon City are facing closure after city building ofcials discovered that they purportedly did not have building permits. Isagani Verzosa, the citys building ofcial, said the 34 structures are three- to four-story buildings and were found not to have complied with re safety code and other security features, such as re alarms and emergency light installation. For lack of the necessary building permits, he said such structures could be considered squatters, but they will give the building owners the chance to comply with the safety standards set forth under the National Building Code and Fire Code. The boarding houses are occupied mostly by students and teachers of the University of the Philippines. According to city re marshal Sr. Supt. Bobby Baruelo, Mayor Herbert Bautista sees the need for more dormitories and the mayor wanted to ensure that all dormitory operators comply with existing laws. City hall inspectors have earlier inspected boarding houses and dormitories on Xavierville Avenue in Barangay Loyola Heights and they were deemed compliant with the citys re and safety regulations.

Procurement will be conducted through open competitive bidding procedures in accordance with R.A. 9184 and its Revised Implementing Rules and Regulations. V will conduct the eligibility checking using the Civil Works Registry (CWR) System and the preliminary examination of bids will be conducted by the BAC of this office. Unregistered contractors, however, shall submit their applications for registration to the DPWH-POCW Central Office before the deadline for the receipt of LOI. The DPWH-POCW Central Office will only process contractors applications for registration, with complete requirements, and issue the Contractors Certificate of Registration (CRC). Imports fall 13.7% on electronics drop

IMPORTS tumbled 13.7 percent year-on-year in April, the biggest drop in 31 months, as the European debt crisis dampened orders for electronics as well as petroleum products. The National Statistics Ofce said merchandise imports amounted to $4.8 billion in April, down from $5.5 billion a year ago, as purchases of electronic products dropped 22.1 percent to $1.3 billion. This was the steepest drop in imports since October 2009, when it contracted by 16.8 percent. Imports also declined 11.2 percent on a monthly basis from $5.4 billion registered in March. The NSO said with exports rising 7.6 percent to $4.6 billion in April and imports falling 13.7 percent to $4.8 billion, the trade decit narrowed to $135 million from $1.2 billion a year ago. Imports in the rst four months also fell 4.6 percent to $20.3 billion from $21.3 billion. Aussie oil company plans IPO

FRONTIER Oil Corp., a unit of Frontier Gaselds Pty. Ltd. of Australia, plans to conduct an initial public offering at the Philippine Stock Exchange to raise $30 million to $50 million to nance exploration projects. Australias BioProspect Ltd. on Tuesday said it reached an agreement with Frontier Oil for a 50-percent stake ahead of the local units planned IPO. BioProspect is the parent company of Frontier Gaselds. BioProspect said in a ling with the Australian Stock Exchange that it signed an agreement to sell its 50-percent shareholding in Frontier Gaselds in exchange for 430,000,000 newly issued shares in Frontier Oil, each having a par value of P1. Frontier Oil, a Philippine company registered with the Securities and Exchange Commission, is engaged in oil and gas exploration and development. Frontier Oil holds a 50percent interest in and operator of service contract 52, an onshore oil and gas block in the Cagayan Valley. Frontier Oil is also in negotiations to acquire two additional oil exploration and appraisal projects in the Philippines. Frontier Oil Corporation is currently nalizing the acquisition of a number of oil and gas projects in the Philippines ahead of a planned... IPO, BioProspect said. It said the issuance of shares was dependent on the approval of Frontier Oil shareholders and the Securitries and Exchange Commission. The shares represent approximately 35 percent of the issued common stock of Frontier Oil on a preIPO basis. Should the IPO raise the maximum targeted amount of $50 million, BPO [BioProspect] would hold approximately 13 percent of the issued common stock, it said. Frontier Gaselds is an Australian oil and gas company focusing mainly on exploration, production and development in the Philippines. BioProspect owns a 50percent interest in Frontier Gaselds, whose interests include SC 52.

ADB okays $350-m loan
THE Asian Development Bank approved Tuesday a $350-million program loan to the Philippines. The loan, called Increasing Competitiveness for Inclusive Growth Program, aims to help the Philippines improve its business climate through a mix of policy reforms and programs to promote competitiveness and develop labor skills among out-of-school youth. There has been marked improvement in the Philippines global competitiveness, but regulation, lack of domestic competition in key sectors, underinvestment in infrastructure and a mismatch of skills in the labor market are keeping the country from realizing its full potential, said Kunio Senga, director-general of ADBs Southeast Asia Department. To help young people better integrate into the labor market and develop workplace skills, ADB is working closely with the Labor Department to design a youth job search program, called MyFirstJob, which will start in 2013. The program will initially provide up to 1,600 youth with career counseling services, grants for vocational training, and internships with employers. Lailany P. Gomez

New mining tax system


THE Chamber of Mines of the Philippines has proposed the enactment of a new law adopting a progressive tax system that will allow government to increase its share in mining revenues. The countrys biggest mining group did not provide details on the proposed law, as membercompanies await the approval of a new mining policy that they hope will help the sector maximize operations and bring in more capital investments. The group added the inux of more direct investments would help bring out socioeconomic development and alleviate poverty in the poorest provinces in the country. Mining companies noted that while miners in Australia and Chile were taxed on the basis of net prots, local rms pay taxes based on gross output. Govt to hold hearings on IPP guidelines


THE Board of Investments will hold public consultations on the implementing rules and regulations of the 2012 Investment Priorities Plan after Malacaang approved it last week. The IPP lists industries that will be given tax incentives by the government. This years IPP has been crafted to focus on four critical areas: job generation, enhanced delivery of social services, international competitiveness and climate change mitigation and adaptation, President Benigno Aquino III said in signing Memorandum Order No. 40 dated June 13. We have strategically calibrated the 2012 IPP to further strengthen last years investment generation agenda, ensuring that our new initiatives will address present economic challenges and effectively establish sustainable gains, the President said. Two new items were added to the preferred list, namely iron and steel and hospital and medical services. Trade Undersecretary and Board of Investments managing head Adrian Cristobal said the agency wanted inputs from different sectors because our direction now is get value for incentives and used those incentives effectively. The 2012 IPP will be effective 15 days after publication. I cant comment on the exact date of its effectivity...maybe soon, Cristobal said at the sidelines of a DTI press brieng in Makati on Tuesday. PH eyes compensation from Thailand over tobacco dispute

THE Philippines will seek compensation from Thailand once it nds out the Southeast Asian country failed to comply with an earlier ruling by the World Trade Organization correcting the taxation scheme for Philippine-made cigarettes. Trade Undersecretary Adrian Cristobal said a team would be sent to Thailand to verify if that Southeast Asian country failed to meet the May 15 deadline for compliance. We are vigilant on our tobacco case against Thailand. If necessary, we will go for the issue on compensation, Cristobal said. Article 22 of the WTO said compensation and the suspension of concessions or other obligations are temporary measures available in the event that the recommendations and rulings are not implemented within a reasonable period of time. IN ONE of his rare appearances, Britains top domestic spy Jonathan Evans disclosed the astonishing cyberspace threats being faced by the West from hostile nation states. Although the source of such threats has not been named, intel community members have ngered Chinawith such suspicions reinforced by recent developments like Canadas move to ban foreign IT rms from participating in a new telephone system in Ottawa. (A few months ago, reports came out about Chinese hackers penetrating highly classied information from a number of Canadas ofces such as the Finance Department and Defence Research and Development.) Evans, the British MI5s director-general, disclosed that cyber attacks against a major British rm caused losses amounting to over 800 million. The magnitude of Internet-based espionage, which Evans said involves thousands of people lying behind both state-sponsored cyber espionage and organized cyber crime, has all the elements worthy of a Hollywood ick. Except this time, the war is conducted not in jungles but in air conditioned rooms with technogeeks doing the ghting, their weapon of choice being a laptop instead of machinegun-toting burly soldiers in camouage. Its no secret that a number of countries including the US, UK and Australia are unhappy with Chinas (as well as Russias) alleged support for cyber spies and techno spying with online methods getting more and more sophisticatedtriggering fears that inltration of both government and big business computers could pose security as well as economic threats. Run against torture E d s a motorists a n d commuters took a slightly bigger dose of daily torture during an advocacy run Monday commemorating the UN International Day in Support of Torture Victims. Starting at the DILG ofce in Quezon City, over 500 runners occupied southbound bus lanes from Kamuning Street to Santolan, causing a slight trafc buildup that lasted for almost an hour. Arnulfo Burgos Jr.) has been getting good feedback over perceptions that it is taking the bull by the horndisclosing that military personnel implicated in or proven guilty of violations have either been dismissed or put behind bars, with their privileges forfeited. Even the PNP is stepping up efforts, distributing (international) Red Cross cards containing the text of the Miranda rights and warning against torture as a reminder to police personnel that they should Mirandize and respect the rights of arrested suspects, since there have been whispers about some police personnel who get carried away by their passion and employ extreme methods of arrest. No more home along da riles? A party list representative is urging government to use unproductive land and idle assets like abandoned/empty offices and warehouses to provide affordable housing for the homeless. LPG-MA partly list Rep. Arnel Ty said housing authorities should conduct an inventory to determine which could be spared into housing projects for the poorest and those displaced by fires, landslides, floods and other calamities. Congress has set aside some P7 billion for public housing plus an additional P1.3 billion for the National Housing Authoritys resettlement projects this 2012. Might as well use some of that money to reduce the number of informal settlers (close to a million households by modest estimates), many of whom live along waterways, near airports, train tracks (riles) and other risky locations--posing a hazard not only to themselves but to many others. ALTHOUGH the Philippines had come up, in response to the Financial Action Task Forces critical review, with only two laws relating to money laundering and terrorist nancing, the international watch dog, last Saturday (Manila time) expressed satisfactionfor the momentwith our efforts not by merely maintaining our previous rating of dark gray, but by even upgrading it to gray. The FATF obviously was aware that the new statutes were enacted despite the Senates being in the midst of trying the impeachment charges against former Chief Justice Renato Corona. The FATF knew that those months were indeed amongst the countrys best of times and worst of times. The rst of the two savior laws is R.A. No. 10167. That law amended two crucial sections of the Anti-Money Laundering law which was R.A No. 9160, as amended by R.A. No. 9194. The two amended sections were 10 and 11. Section 10 was on the matter of bank account freeze. The original law gave the Anti-Money Laundering Council authority to freeze bank accounts for not more than 15 days. If needed, the freeze period may be extended upon order of the court. Strangely, the law did not say what court is authorized to extend the freeze. The amendment introduced by R.A. No. 9194 removed the motu propio power to freeze from the AMLC. If the AMLC wanted to freeze a bank account, it was instead required to le a petition for that purpose, albeit ex parte, with the Court of Appeals. The initial freeze order was lengthened to a period of twenty [20] days. The latest law, R.A. No. 10167, made the process a bit more stringent. It required the petition to be veried, i.e. to sworn to by the ler based on his or her personal knowledge. This matter of form was not specic in the old law. But, by way of compensation for this additional formality, R.A. No. 10167 forces the Court of Appeals, stressing the urgency of the matter, to act within twenty-four [24] hours from the ling. This proposed measure, said Senator T.L. Guingona III in his sponsorship speech, particularly addresses a situation where the account holder or property owner acquires knowledge or information about the investigation being conducted against him by the AMLC or about the fact that an application for freeze has been led against him or his bank account and/or properties. Co-sponsor Franklin Drilon added: The purpose of these proposed revisions is to make the freezing process more efcient to ensure that criminal proceeds will not be disposed of pending investigation by the AMLC. The affected depositor is not without his remedies. He may contest the freeze by ling a motion to lift. The Court of Appeals is required to resolve the motion within the 20-day freeze period. The end result, by the squeeze of the freeze, is the approximate restoration of the ability of the AMLC to act as quickly as was envisioned in the original law; but this is balanced by the ability of the depositor to just as quickly move for, and For feedback, e-mail thetrustguru863@gmail.com.

secure, a defrost. The other section amended by R.A. No. 10167 is Section 11. This section relates to the AMLCs power to inquire into bank deposits. Understandably, probably because by the time the bill was on second reading at the Senate, the impeachment case against former Chief Justice Corona was quickly going down on a tail spin on account of the revelations concerning his bank deposits, this amendment effected the more changes. The most signicant change in Section 11 is the explicit statement in the law that the AMLC is authorized to examine bank accounts upon order of any competent court based on an ex parte application. It is as explicit a repudiation can be of the Supreme Courts dubious conclusion and legal argumentation in the case of Eugenio which was the subject of my column last week. The second change is an expansion of the instances when no such court application is required. Under the new law, also exempted are felonies or offenses of a nature similar to those mentioned in Sections 3(i)(1), (2), and (12) which are punishable under the penal laws of other countries, and terrorism and conspiracy to commit terrorism as dened and penalized under Republic Act No. 9372. R.A. No. 9372 is the Human Security Act of 2007. Thirdly, in line with the repudiation of Eugenio, it put bank inquiry at par with account freeze and compelled the Court of Appeals to act on the application also within 24 hours of ling. The fourth change is enigmatic. Prior to R.A. No. 10167, the Bangko Sentral may inquire into or examine any deposit... In contrast, under the new law, the BSP may only check the compliance of a covered institution with the requirements of the AMLA and its implementing regulations. It is a thorny question whether checking compliance with law, is the same as looking into a deposit. I tend to think, and I hope I am wrong, BSPs power to inquire into a deposit has been if not removed, at the very least severely watered down. The fth change is the inclusion on the coverage of AMLCs application to inquire into a bank account of so-called related accounts. Related accounts are those the funds and sources of which originated from and/or are materially linked to the monetary instrument(s) or property(ies) subject of the freeze order(s). A court order too is required for these related accounts. Finally, although the Constitution is deemed read into every law legitimately passed, there is an explicit requirement to comply with the requirements of Article III, Sections 2 and 3 of the 1987 Constitution. These sections refer to provisions against unreasonable searches and seizures (Sec. 2) and privacy of communication and correspondence (Sec. 3). There is no question that, as appreciated by the FATF, these changes brought about by R.A. No. 10167 are steps forward. Whether they will be considered big steps or small steps at the next FATF review remains to be seen. At least for now, we luckily got an A for effort. Unless some remaining questions are addressed by implementing regulations, we may not be as lucky, come the next grading period.

Delivery of the GOODS is required by September 25, 2012 or within Sixty (60) calendar days from receipt of the Notice to Proceed. The description of an eligible Bidder is contained in the Bidding Documents. 3. Bidding will be conducted through open competitive bidding procedures using non-discretionary pass/fail criteria as specified in the Implementing Rules and Regulations Part A (IRR-A) of Republic Act 9184 (R.A. 9184), otherwise known as the Government Procurement Reform Act, and is restricted to Filipino citizens/sole proprietorships, organizations with at least sixty percent (60%) interest or outstanding capital stock belonging to citizens of the Philippines, and to citizens or organizations of a country the laws or regulations of which grant similar rights or privileges to Filipino citizens, pursuant to Republic Act 5183 (R.A. 5183) and subject to Commonwealth Act 138 (C.A. 138). In a resolution penned by Associate Justice Noel Tijam, the CAs former special former ninth division denied the motion for reconsideration of Antiporda seeking acquittal in the killings of Edwin Cusit, Johnny Alonzo and Ben Magguddayao. The appellate court sustained its earlier decision, which afrmed the conviction of Antiporda for three counts of homicide and one count of attempted homicide by Manila Regional Trial Court Judge Teresa Soriaso in February 2000 and sentencing him to 44-year imprisonment. Antiporda had insisted in his appeal that he should be acquitted following recantation made by witnesses of the prosecution during trial. As settled, only when there exist special circumstances in the case which when coupled with the retraction raise doubts as to the truth of the testimony or statement given can retractions be considered and upheld. As we have earlier stressed, there is nothing, other than the retractions themselves, that creates any doubt on the guilty of accusedappellant. Associate Justices Fernanda LampasPeralta and Antonio Villamor concurred with the ruling. Apart from afrming the guilty verdict, the CA division also ordered Antiporda to indemnify each of the families of the three victims with P50,000 each. The mayor was also found guilty for attempted homicide for plotting to kill Jimmy de Guzman also in May 1995. Antiporda, then only 22, was Sangguniang Kabataan chairman.

Town chief faces raps over falls resort in Palawan


BROOKES POINT-Mayor Narciso Leoncio and 19 others are facing charges for turning Sabsaban Falls into a resort without clearance from the Palawan Council Sustainable Development, an ofcial said. PCSD legal chiefAdel Belena accused him and fellow executives of violating the Strategic Environmental Plan for Palawan Act and its implelenting rules and regulations when they put up an eco-tourism facility within a protected timberland in an ancestral domain. Also in the complaint were ABSCBN Foundation executive director Gina Lopez and ofcer-in-charge James Adrian Bicaldo including Department of Environment and Natural Resources community ofcer Emelina Cojamco. Belena said administrative case 438 was led before the the PCSD Adjudication Board led by chairman Alfredo Abueg, Jr. with former Palawan Vice Governor David Ponce de Leon, former congressman Vicente Sandoval and PCSD executive director Romeo Dorado as members. The foundation should have secured separate SEP clearances for occupation of Sabsaban Falls, development of the place, cutting of trees, construction of cottages and others, Belena said. Engr. Teodoro Baltazar, chief of the PCSD Enforcement Unit, took up reports of felling trees on ndings of Robert Paalan, of Brookes Point Federation of Tribal Councils. Baltazar also sought the issuance of a cease and desist order stopping the foundation from doing any further development in the premises. Likewise listed in the charge sheets are Barangay Ipilan Chairman Jonathan Lagrada with Kagawad Artizo Mandawa, Edgar Sadang, Jane Araullo, Wilfredo Rodriguez, Adelaido Cacacha, Melchor Inog and SK Chairman Joana Jane Enero. Along with Barangay Aribungos Chairman Ratib Milosin and his Kagawad Nora Francisco, Elmer Sadang, Leonard Martinez, Sabtaine Abdulsattal, Renaldo Inso, Nashran Taha, Maylene Utalah and SK Chairman Inso, and Sister Xenia Mae Juanitas of the Missionaries Association of the Philippines. In an earlier complaint led with the National Commission on Indigenous People, the federation of tribal councils accused the foundation of developing Sabsaban Falls without the required free and prior informed consent, and certicate of pre-condition. The certicate which the commission issues on the basis of an approved consent is among the requirements for SEP clearance. Other vital documents are social acceptability as certied by the indigenous people in the area in the form of the said consent endorsed by the barangay, municipal and provincial government. Herminia Caabay, PCSD Legal Ofcer, said a memorandum of agreement between the foundation and Brookes Point town was not a substitute of an SEP clearance and the solicited signatures didnot supplant the needed consent as part of social acceptability.

Health coupon model


LUCENA CITY-Governor David Suarez said the health coupon of Quezon has been nominated to the Galing Pook Awards 2012. The program authorizes village chiefs from 39 towns and two cities to issue the coupon for indigent patients to give them access to services in province-run hospitals. Each village chief has a minimum P25,000 worth of these coupons yearly, Suarez said, noting that the allocation is based on the localitys population. He said the barangay heads have been clustered to facilitate distribution to the beneciaries while ensuring accountability and preventing any diversion. Suarez said the province has simplied a componenent of the health program to enable the capitol to reach even far-ung towns and villages. The Department of Interior and Local Government is encouraging executives to come up with innovative and cost-effective measures to speed up delivery of basic services while giving incentives to come up with best practices. With the mission to assist PCG in four major functions -Maritime Search and Rescue, Maritime Safety, Maritime Environmental Protection and Community Relations--the operations of component units will be standardized. Plans and programs for trainings are being developed and shall be implemented in no time in order to continually improve the quality, effective and efcient members of the Auxiliary, Cabalde said. Cabalde graduated civil engineering at Feati University and took his masteral degree in Construction Project Management at the Ateneo de Manila University and Structural Engineering in the University of the Philippines. As professional civil engineer, he became part of the several multi-million housing projects for the Royal Commission of Jubail and Royal Air Defense in Riyadh, Saudi Arabia in the late 70s. Cabalde is also a licensed real estate broker, who served as executive vice president of MultiAddweal Corporation and scientist for the National Research Council of the Philippines. He is chairman of Supreme Builders, and president of Cabalde & Cabalde Realty Corp. and Designers Pad. He became a member of PCGA since 1998 under the 106th Squadron of CGAD NCR-CL. TUGUEGARAO CITYRep. Randy Ting, said at least P142.3 million has been set for the education, infrastructure, health and livelihood in the third district of Cagayan. He said P20 million for Students assistance (Scholarship), and P3.3 million of computer sets, P91 million will go to infrastructure projects, P21 million for health for its nancial assistance, and P7 million for livelihood assistance. The construction of school buildings will give the populace access to education, a tool to achieve self-improvement, Ting said. About 90 computer sets worth P1.5 million have been distributed to public schools in Pallua Sur, Pallua Norte, Baggay, Cattaggaman Elementary school, along with classroom furniture. Information and communication technology is crucial in waging a campaign against illiteracy, Ting said. Ting said he led a measure for the conversion to a national highway the local road traversing the villages of Gadu, Carilucud, Ubong, Parog-Parog, Bantay, Nabbotuan, and Palao of Solana going to Barangay Macutay in Kalinga. Another bill took up the road across the villages of Sampaguita, Solana; Warat, Piat; La suerte, Cataruan, Nanuccauan, Bayabat of Amulung to Alcala town. Chinese rm gives up smelting in Eastern Visayas


CENTURY Huaguang Smelting Inc., a subsidiary of publicly-listed Century Peak Metals Holdings Corp., will stop its smelting project in Leyte due to nancial constraints facing its technology partner and investor in China. In a disclosure to the stock exchange on Tuesday, Century Peak said its mainland partner sought the stoppage of the project. CHGSI shall discontinue the development of its ferro-nickle smelting project and other related operations located at the Leyte Industrial Development Estate in Isabel, Leyte upon request of CHGSIs investor and technology partner in China to halt the smelting plant due to financial difficulties in China, Enrico Trinidad, corporate information officer, said in a statement. CHGSI has halted all development work related to the ferro-nickle smelting project, Trinidad said. He said Century Peak will channel its resources in expanding its mining activities in Dinagat Island. Century Peak owned 55 percent of CHGSI. ART is not a topic we talk about a lot. Artsy is not something we aspire to be. Here, art isnt hip or trendy. We have a pseudoworking knowledge of the concept of art and the Picassos and the Michelangelos of this world, but thats about it. Talk to the average Pinoy and its highly unlikely that hell be able to name even one Filipino artist.
In 1976, the Metropolitan Museum of Manila was established to be the countrys artistic hub. Its purpose was to display art from all over the world to broaden the Filipinos awareness of different cultures expressed through art. Ten years later, the museum expanded to include Philippine artan obscure, often forgotten discipline. Since then, the Met has been a champion

to the local contemporary art scene. Its programs were always to study the creative process, aesthetics and art narratives of our artists and to develop museological functions within a Filipino framework. In 2010, the exhibit, Re-Collect: Revisiting the Met Collection, was mounted, showcasing the entire art collection of the museum for the rst time. Composed of over a hundred art pieces created by Filipino artists, including paintings, prints and sculptures, it was a visual narrative of Philippine modern

historyfrom the 1950s to the 1990swith emphasis on social concerns, circumstances and victories. This year, a similar exhibit is on display. Re/Curating the Met Collection 1948-2011 serves as the second presentation of the Met collection in its entirety. The exhibits press notes describes it as an invitation to look back at the countrys recent history through the same works but which have been organized to explore, rst, use of materials and techniques, themes, genres and, nally, using portions of

it to usher engagement with new art forms. Various pieces like the Manongs in the Rockies by Venancio Igarta, Myth of Bukidnon Creation by Roberto Feleo and Bum na Bum by Pablo Baen Santos provide a range of emotions and visual representations of Filipino life and important social issues. Also in the mix are abstract expressions by Phyllis Zaballero and the dramatic guration of Flor Contemplacion by national artist Ben Cab. The exhibit, which ran until June 9, sought to provoke thinking and discussion by looking into and evaluating the past; and how it relates to the present and perhaps, the future. It was also an invitation to update, a welcome of sorts to new art forms, as the museum hoped to inspire artists to come up with their own artnew expressions that it can eventually present to the public. As an enrichment exercise, the presentation of the collection was an opportunity to reassess the relevance of individual works in a collection and the relevance of the collection itself in the context of designing museum programs and their roles in museology in general. The Met also believes in exposing to art even those who do not go to galleries. As part of the effort to reintroduce art to the public, the Met partnered with SM Supermalls to literally bring art to the malls, a kind of presentation that makes art less intimidating to the uninitiated. The two institutions have previously joined forces for the Abakada ng Sining, Likhaan: Visual Arts and Ako Self Portraits: From 1800s to the Present. This time, they are presenting and fusing two art formsfashion and photography. As most of us are familiar with both disciplines, Fashion Take is a fantastic way to get people interested in the subject. A diverse documentation of Philippine clothing from 1903 to recent years, the exhibit highlights fashion as seen through photographs, paintings and sketches of Filipino photographers, artists and fashion designers. Covering such a vast period, Fashion Take shows the evolution of local fashion and how it wasand still is instrumental in dening eras. The Met thinks of fashion as a key player in reecting values, shifting common ideas and molding attitudes, leading to the shaping of the aesthetic notions of a people. The exhibit seeks to examine the power of clothing and its impact on Philippine society. Fashion Take is curated by Met trustee and consulting curator Corazon S. Alvina. It opened at the SM Mall of Asia on June 6 and ran till June 13. The show will then travel to SM Megamall and SM Pampanga in the coming months. THE awarding ceremony of 2012 Pro-Friends Art Competition was graced by the tilts winners and contestants. The awarding ceremony was led by St. Edward Integrated School (SEIS) Board of Trustee, Crisanto Hilario, and SEIS Principal, Dr. John Cabalo. This years art competition theme was Transforming Filipino Lives Through Education. THE last 12 months have been fantastic for British author E. L. James, one of Time magazines 100 Most Inuential People in the World for 2012. Her first book, the widely successful and highly controversial erotic novel, Fifty Shades of Grey, is a hot topic worldwide. in new GMA Network show, no merger seen this year

GMA Network unveiled its new shows over lunch at its 17th oor executive lounge recently amidst talk of buyout and merger.
GMA Entertainment TV Group hopes the series it recently launched, Makapiling Kang Muli with Richard Gutierrez and Carla Abellana could give the Kapamilya network reason to be alarmed. Mark Anthony Fernandez and Sarah Lahbati add avor to the drama with powerful support from Phillip Salvador, Robert Arevalo, Rio Locsin, Mark Gil and Gloria Romero. Lets see how the competition takes a turn in the coming weeks. The network is also hoping its new series, One True Love, will redeem it from the repetitive themes it had been offering lately. The show premiered on June 11, and features hot matinee idol Alden Richards and young star Louise delos Reyes, Agot Isidro, who recently bolted out of the Kapamilya lot, debuts as Kapuso in this series. Together Forever, which popped on screen June 17, features popular tanden Elmo Magalona and Julie Ann San Jose. Under the direction of Dick Lindayag it tells the story of how a fateful accident will bridge two people and change the lives of three siblings. Premiering Aug. 5 is the new edition of Protg now called The Battle for the big artista break. Amid these new shows that the network is barking about, members of the media couldnt help but ask the most important question in their mind. Is GMA Network up for sale? Or, is Manny V. Pangilinan, who also owns TV5, buying GMA Network? Atty. Felipe L. Gozon, who joined the group for lunch, said, That rumor is persistent. I will not say the network is not for sale. Why not, if the price is right? But as of now, the ownersapart from my family, there are two other families (Duavit and Jimenez) have not reached an agreement on the price that we should be compelled to sell. The members of the media were disappointed. But until now, the rumors continue to drift in the air, with MVP thats Manny Pangilinanbeing quoted by business reporters that a deal with GMA Network could be had by the end of the year. We will wait, Manny, FLG, for it to happen. In the meantime, do your jobs rst. And that is to keep GMA Networks ratings up for FLG, and consolidate TV5 and make it a protable venture for MVP.

Among the new shows that will be seen onscreen this year is a talk show that will be hosted by Many Pacquiaos better half, Jinkee Pacquiao. The show will be called Love. Life. Jinkee steps into the spotlight as host of a talk show. Many of course, after hearing this news, couldnt control their eyebrows that had risen uncontrollably. I couldnt help but burst into a loud laughter just trying to bring those eyebrows, plucked or tattooed, down by saying, gels, gels, calm downyou are not the shows market! Their reaction was even louder giggles. Anyway, Jinkee aside, host or just wife of Pacquiao, GMA Network is upbeat about their new programs and hopes the network could wrestle back its lost ground in the primetime block now dominated by the Kapamilya network, thanks to Walang Hanggan. Luna Blanca premiered on May 21 with the rst four weeks featuring child stars Jillian Ward as Luna and Mona Louise Rey as Blanca. Soon, these characters will be played by Barbie Forteza and Bea Binene and later Heart Evangelista Bianca King. Oh, the network has name for the series dont laugh now, please! multigenerational serieswhatever that means. Now, can any series from competing networks work against Kapamilyas Walang Hanggan? Without a doubt, the Kapuso channel has a tight grip on the afternoon block with drama series that have been consistently topping the ratings. Kasalanan Bang Ibigin Ka? piloted on June 4 with Geoff Eigenmann, Jennica Garcia, Jackie Rice and Michael de Mesa. Faithfully started its run on June 18, with Maxene Magalona, Isabel Oli, Vaness del Moral, Michelle Madrigal, Isabelle Daza, Marc Abaya and Mike Tan. On July 9, Hindi Ka Na Mag-iisa joins the fray. It stars Jennylyn Mercado and Sid Lucero.

IF LOUD cheers and applause were the only gauge of someones popularity, then it is safe to say that Dulce and Piolo Pascual were the most popular Original Pinoy Music singers that performed on June 16 at the Mall of Asia Arena. Introduced as one of the great divas of the country, alongside Rachel Alejandro and Vernie Varga, the Cebuana singer and theater actress received thundering cheers as soon as she stepped on stage and hit the rst note of Louie Ocampos original, Ikaw Lang Ang Mamahalin. Then there was also the Kapamilya actor Piolo that received loud applause (and giggles from the female members of the crowd) when the dashing star sang his rendition of Kailangan Kita, an Ogie Alcasid original. Called Icons at the Mall of Asia Arena, the concert was the showpiece of the newly built concert and sporting venues ofcial launch. Attended by almost 20,000 OPM acionados, the concert was, well, a festival of local music performed by the most celebrated and world-class Filipino singers. The show, including speeches and ribboncutting, was scheduled to start at 8 p.m. and it was loyal generation like Jed Madela, Juris, Richard Poon endeared the crowd with their power vocals in songs Huwag Ka Lang Mawawala, Sino Ako, and Ikaw ang Pangarap. Then, Freddie Aguilar, representing the 70s icons, went solo onstage with his iconic song Anak. Though most of the performers that night were ABS-CBN stars, Ogie Alcasid and Regine Velasquez made their presence felt. The power couple sang Hanggan Ngayon, Kailan Koy Ikaw, and Pangarap Ko ay Ibigin Ka, songs which inspired by Ogies love and admiration to his then girlfriend and now wife, Regine. The show didnt fail to showcase world-class talents. And when we talk about world-class talents, Lea Salonga is probably rst on everybodys list. The Tony Awardwinning singer graced the stage with her charming performance of I think Im In Love and Till I Met You. She was later joined by Journeys Arnel Pineda, who awkwardly sang the ballads Dont Know What To Do, Dont Know What To Say and Hold On. Nonetheless, Arnel was able to pull it though going off key and off beat at times. In speaking of being off key, 80s balladeer Basil Valdez was the apparent letdown of the entire Main attraction OPM is the main theme of the concert. In his number Erik Santos two-hour musical extravaganza. (who effortlessly sang Nais Ko) Singers more popular to the young and Martin Nievera (who belted to its timetable. The concert proper commenced at exactly 8:30. The ABS-CBN Philharmonic Orchestra that made its public debut that night opened the show, and Ryan Cayabyab was the conductor. Like in any live performances, the show was not awless. There was a technical glitch when the white drape covering the entire stage that was supposed to fall automatically was suspended in the middle of the stage for a couple of minutes. It distracted the audience. That slight technical glitch, however, didnt ruin the entire show. First batch of performers, which denitely set the mood of concert, were the vocal group The Company, Christian Bautista, and Jose Mari Chan singing the latters original songs and compositions like Can We Just Stop And Talk Awhile, Tell Me Your Name and Beautiful Girl. Hosts Pops Fernandez and Jim Paredes also brought life to the show. Matter of fact, they played a big part. Their spiels guided the audience on what to expect in the next group of performers. They dished out trivia on local music perking up the audience with their commentary and their usual pitch of the concert venue.

The penultimate part of the show was Gary Vs music video featuring his original composition which gives tribute to Henry Sy, the patriarch of SM Prime Holdings Inc. The concert was then capped off with all the performers including the hosts, but excluding Regine and Ogie, returning on the stage singing a song, which is denitely not an OPM, Impossible Dream.
