STATEMENT OF PROBABLE CAUSE 1.

On Sunday, June 24, 2012, approximately 12:00 pm, the Hampshire Detective Unit responded to Huntington, Massachusetts to assist with what, at that time, was believed to be a missing person investigation. The individual, identified as Jessica Dana (DOB 05/17/82), 8 Rocky Brook Drive, Huntington was initially reported missing on Saturday, June 23, 2012, by her longtime boy friend, identified as Jeb Daly (DOB 12/06/75). Ms. Dana shared the residence at Rocky Brook Drive with Mr. Daly, and the couples three (3) children ranging in age from approximately ten (10) years to one (1) year of age. 2. Initial investigation, conducted by Massachusetts State Police Russell Barracks, revealed that Ms. Dana and Mr. Daly hosted a party at their residence, on the evening of, Friday, June 22, 2012. According to witnesses present at the party, the couple had been drinking and bickering. However, the behavior observed, and the amount of alcohol consumed, was not out of the ordinary. What was unusual, according to her family and friends, was that Ms. Dana had apparently left the home, after the party had dispersed, without her children, her cell phone, purse and the shoes she was known to wear on a regular basis. Witnesses reported that Mr. Daly was the last person with Ms. Dana before she reportedly went missing. 3. In addition to being the last person seen with Ms. Dana before she went missing Friday night, Mr. Daly was the only adult present at 8 Rocky Brook Drive the following morning when Ms. Danas oldest child awoke. Witnesses who arrived at the residence later that morning reported that Mr. Daly was the only adult present, at the residence, at that time. Despite Ms. Dana allegedly having gone missing sometime Friday evening, Mr. Daly did not report her as missing until approximately 5:00 p.m. on Saturday, June 23, 2012. At that time, he called the Massachusetts State Police and reported that Ms. Danas whereabouts were unknown and that he had last seen her, at their residence, on Friday evening, June 22, 2012. At no time, when speaking with police, did Mr. Daly report having seen or heard anyone come or go from the residence between the time Ms. Daly allegedly left the residence, and the following morning when he awoke. 4. When investigators from the Hampshire State Police Detective Unit (SPDU), attached to the Northwestern District Attorneys Office, arrived at the residence, on Sunday afternoon, to speak with Mr. Daly further, there were several relatives/friends already outside the residence discussing where Ms. Dana could be. Investigators reported that while attempting to speak with Mr. Daly inside the residence, they noted that Mr. Daly appeared extremely nervous and inordinately focused on what the individuals outside the house were doing and where they were going. At one point, it appeared as though Mr. Daly had actually urinated through his pants while in the investigators presence. At the same time investigators were attempting to speak with Mr. Daly inside the residence, the relatives/friends began searching the property behind the house. Approximately twenty five (25) yards, behind the house, and down an embankment, two (2) friends located a long box that contained a black, or darkgreen, plastic bag. (It was later determined the box formerly contained the inflatable swimming pool that investigators observed in the backyard of 8 Rocky Brook Drive). Visible from the box appeared to be a human hand. Believing they had discovered Ms. 1

Danas body, and that Mr. Daly was responsible for her death, these friends became irate and started yelling threats toward Mr. Daly, who was still inside the residence. At this point, Mr. Daly fled the residence on foot. MSP K-9 and Air Wing were dispatched to assist with negative results. 5. After Mr. Daly fled, Trooper Alex Berry of SP Russell was dispatched to the Huntington residence of Mr. Dalys father. At approximately 7:15 pm, Mr. Dalys brother Shaun Morrissey, who had by this time arrived at the house, handed Trooper Berry his phone, advising him that Mr. Daly had just texted him asking him to come pick him up so that he could "turn himself in". 6. At approximately 8:25 pm, Shaun received a phone call from Mr. Daly asking him to come get him by Lowell Lane in Huntington. Shaun stated that he asked Mr. Daly why Lowell Lane to which Mr. Daly replied "Why the fuck did you say that out loud?" and seemed angry others might have overheard. At approximately 8:59 pm, State Police responded to Lowell Lane and Kennedy Drive. Troopers observed Mr. Daly exit a wooded area at which time he was placed in custody. When he was placed in custody Mr. Daly had on his person one (1) silver and black AT&T/Blackberry Torch cell phone that was seized by State Police. 7. Jeb Daly (DOB 12/06/75), 8 Rocky Brook Drive, Huntington was charged with Disinterring/Improper Disposal of a Body, in violation of Improper Disposal of a Body, G.L. c. 272, 71, and Misleading Police, G.L. c. 268, 13B. 8. An affidavit, in support of a search warrant, was submitted to the court to remove the box, containing the body, from the property at 8 Rocky Brook Drive, Huntington for identification, further examination and further documentation. The Office of the Chief Medical Examiner (OCME)/Boston was contacted and accepted jurisdiction in the case. The box was transported directly to the OCME/Boston where further processing/documentation took place. 9. During the collection and subsequent analysis of the body discovered behind 8 Rocky Brook Drive, it was noted that the body was wrapped in a checkered sheet, a camouflage sheet and other layers of bedding/linens; and further, that the lower legs and upper body were wrapped in trash bags that appear black, or dark-green, depending upon the lighting under which they are viewed. 10. The OCME later identified the body, inside the box, recovered from the area behind 8 Rocky Brook Drive, Huntington, as that of Jessica Dana (DOB 05/17/82). The OCME ruled the manner of death homicide. 11. On Monday, June 25, 2012, I applied for, and obtained, a search warrant for 8 Rocky Brook Drive. The warrant was executed that same evening and into the early-morning hours of June 26, 2012. During the execution of the search warrant, SPDU investigators noticed a trash receptacle inside the gray, metal shed located to the right-hand (north) side of the residence, inside of which was a black, or dark-green trash bag, holding miscellaneous items of trash. This trash bag appeared similar in size, shape and color to the trash bags used to 2

wrap the upper and lower portions of Ms. Danas body. This trash bag was not collected at that time. 12. During the execution of the search warrant, a box of black, or dark-green trash bags, was recovered inside the kitchen area of 8 Rocky Brook Drive, which appear similar in size, shape and color to the trash bags used to wrap the upper and lower portions of Ms. Danas body. 13. During the execution of the search warrant, investigators recovered a checkered sheet and pillow case, and a camouflage sheet, consistent in color schemes and patterns as the bedding/linens wrapped around the body of Jessica Dana inside the residence at 8 Rocky Brook Drive. 14. On Wednesday, June 27, 2012, the Massachusetts State Police Crime Scene Services Section (CSSS) examined the trash bag used to wrap the lower portion of Ms. Danas body. There were several friction ridge impressions detected on this bag, one (1) of which was then compared to the known fingerprints of Jeb Daly. This impression was individualized to the #4 right ring finger of Jeb Daly. 15. On Thursday, June 28, 2012, I applied for and obtained a search warrant for the gray, metal shed located on the right-hand (north) side of the property that was previously observed to contain a black, or dark-green, trash bag containing miscellaneous items. The black, or dark-green, trash bag was secured during the execution of the warrant. 16. On Friday, June 29, 2012, the Massachusetts State Police Crime Scene Services Section (CSSS) provided the opinion that the black, or dark-green, trash bags used to wrap the upper and lower portions of Ms. Danas body, the single trash bag secured from the gray, metal shed located on the property of 8 Rocky Brook Drive and the box of black, or dark-green, trash bags recovered from the cabinet under the kitchen, inside the residence at 8 Rocky Brook Drive appear to be consistent in size, shape, color and design. 17. Based on the aforementioned facts and circumstances, I believe that there is probable cause to believe that Jeb Daly (DOB 12/07/65), 8 Rocky Brook Drive, Huntington, Massachusetts committed the crime of Murder, in violation of G.L. c. 265, 1, on or about June 22, 2012.
