AUCTION CONDITIONS The property is offered for sale at Auction and is subject to the following further reservations, conditions and stipulations: (a) (b) The property is offered for sale subject to a reserve price. Subject to the other provisions of these conditions of sale, the highest bidder whose bid is accepted by the Auctioneer shall be the Purchaser. The Vendor reserves the right to bid in person or by agent. The Vendor reserves the right to withdraw the subject property from sale at any time before actual sale without declaring the reserve price. The Auctioneer m ay, at their discretion, refuse to accept any bid from any person and no bid if accepted shall be retracted without the consent of the Auctioneer. No Bidder shall advance a lesser sum or percentage of any bidding that the Auctioneer is willing to accept. A bid shall be deemed to be accepted unless the Auctioneer forthwith after it has been m ade, declares their non acceptance or dissent. If any dispute or difference shall arise out of or in connection with the bidding (and the Auctioneer shall be the sole and final judge of the existence of any dispute), the Auctioneer m ay re-open the bidding and resubmit the property commencing with some former bidding or the Auctioneer may decide such dispute or difference in such other m anner as they in their absolute discretion shall deem fit, and their decision shall be final and binding on all parties. The Auctioneer reserves the right when conducting the said auction to request any bidder or bidders to advance to the rostrum and establish their bona fides and in such event such bidder or bidders provide to the Auctioneer any authority or authorities in writing and any fact or facts as the Auctioneers shall deem necessary. Paym ent or tender of any moneys payable hereunder by the Purchaser to the Auctioneer or to the Vendor m ay be made either in legal tender or by cheque issued by any bank carrying on business under the laws of the Commonwealth of Australia. Upon the fall of the hammer, the Purchaser shall pay to the Auctioneer a deposit of TEN PER CENTUM of the purchase price and shall sign the Contract of Sale tendered by the Auctioneer. The conditions of that Contract, together with these Special Conditions, shall comprise of the Contract of Sale by auction.

SPECIAL CONDITIONS 1. The Purchaser hereby acknowledges that the within Conditions 6, 8, 11.2, 11.3, 11.4, 23 and 24 do not apply to this transaction and are deleted. The Purchaser also acknowledges that he enters into this agreem ent only after a full inspection of the property and at his own risk as to the compliance or otherwise of improvem ents with any present or future building code or any statutory requirem ents whatsoever in relation to the siting, designing, building reinstatement or maintenance of the said improvements and in all respects purchases the property as is and that the Vendor has given no warranty in relation to the property or the improvements thereon.
