- End-User Software License Agreement for Lumion Non Commercial PLEASE READ THIS AGREEMENT CAREFULLY BEFORE COMPLETING THE INSTALLATION PROCESS AND USING Lumion. IT PROVIDES A LICENSE TO USE Lumion AND CONTAINS WARRANTY INFORMATION AND LIABILITY DISCLAIMERS. BY INSTALLING AND USING Lumion, YOU ARE CONFIRMING ACCEPTANCE OF Lumion AND AGREEING TO BECOME BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT WISH TO DO SO, DO NOT COMPLETE THE INSTALLATION PROCESS. PROMPTLY RETURN THE ENTIRE PACKAGE TO THE PLACE WHERE YOU OBTAINED IT, FOR A FULL REFUND. Definitions 1. "Lumion" is the non-commercial program supplied by Act-3D B.V. herewith, and any and all updates thereto. 2. "Lumion Project" means an output file generated by you using Lumion. Examples of Lumion Projects include animations, presentations, demonstration files, interactive multimedia material, interactive entertainment products and the like. License This license allows you to: 1. Install and use Lumion on a single computer and make one copy of Lumion in machine-readable form solely for backup purposes. You must reproduce on any such copy all copyright notices and any other proprietary legends on the original copy of Lumion. 2. Install Lumion on a storage device, such as a network server, and run Lumion on an internal network, provided the number of concurrent users does not exceed the number of copies of Lumion purchased. A copy of Lumion must be purchased for each such user. 3. Make copies of a "Lumion Project" for non-commercial purposes, and distribute those copies for use by yourself or personnel employed by you, or any other non-commercial party. License Restrictions Other than as set forth under "License", you may not make or distribute copies of Lumion, or electronically transfer Lumion from one computer to another or over a network. You may not decompile, reverse engineer, disassemble, or otherwise reduce Lumion to a human-perceivable form. You may not rent, lease or sublicense Lumion. You may not modify Lumion or create derivative works based upon Lumion. You may not sell any "Lumion Project" to any party nor may it be used for commercial purposes. Upgrades If this copy of Lumion is an upgrade from an earlier version of Lumion, it is provided to you on a license exchange basis. You agree by your installation and use of this copy of Lumion to voluntarily terminate your earlier end-user license and that you will not continue to use the earlier version of Lumion nor transfer it to another. Ownership The foregoing license gives you limited rights to use Lumion. Although you own the media on which Lumion is recorded, you

do not become the owner of, and Act-3D retains title to, Lumion, the Lumion Viewer, and all copies thereof. All rights not specifically granted in this Agreement and International Copyrights, are reserved by Act-3D B.V. Hardware Dongle Lumion uses a hardware key license system. Note that the hardware key contains the license key. This key is the only method to make use of your software license. There is no copy of this license key. In case of damage, Act-3D can provide a replacement hardware key on the condition that the original hardware key is sent to Act-3D B.V. In case of loss, Act-3D will not replace a hardware key. Limited Warranties Act-3D B.V. warrants that, for a period of ninety (90) days from the date of delivery (as evidenced by a copy of your receipt): (i) when used with a recommended hardware configuration, Lumion will perform in substantial conformance with the documentation supplied with Lumion; and (ii) that the media on which Lumion is furnished will be free from defects in materials and workmanship under normal use. Except as set forth in the foregoing limited warranty, Act-3D B.V. disclaims all other warranties or conditions, either express or implied, including the warranties or conditions of merchantability, fitness for a particular purpose and noninfringement. If applicable law implies any warranties with respect to Lumion, all such warranties are limited in duration to ninety (90) days from the date of delivery. No oral or written information or advice given by Act-3D B.V., its dealers, distributors, agents or employees shall create a warranty or in any way increase the scope of this warranty. Exclusive Remedy Your exclusive remedy under "Limited Warranties" is to return Lumion to the place you acquired it, with a copy of your receipt and a description of the problem. Act-3D B.V. will use reasonable commercial efforts to supply you with a replacement copy of Lumion that substantially conforms to the documentation, provide a replacement for defective media, or refund to you your purchase price for Lumion, at its option. Act-3D B.V. shall have no responsibility if Lumion has been altered in any way, if the media has been damaged by accident, abuse or misapplication, or if the failure arises out of use of Lumion with other than a recommended hardware configuration. Limitations of Damages 1. Act-3D B.V. shall not be liable for any indirect, special, incidental or consequential damages (including damages for loss of business, loss of profits, or the like), whether based on breach of contract, tort (including negligence), product liability or otherwise, even if Act-3D B.V. or its representatives have been advised of the possibility of such damages and even if a remedy set forth herein is found to have failed of its essential purpose. 2. Act-3D B.V.'s total liability to you for actual damages for any cause whatsoever will be limited to the greater of

90 U.S. dollars or the amount paid by you for Lumion that caused such damage. To the extent provided by applicable law, the foregoing limitations of damages do not apply to damages for personal injury to you, if any.

Basis of Bargain The limited warranty, exclusive remedies and limited liability set forth above are fundamental elements of the basis of the agreement between Act-3D B.V. and you. Act-3D B.V. would not be able to provide Lumion on an economic basis without such limitations. General This Agreement shall be governed by the internal laws of the Netherlands. This Agreement contains the complete agreement between the parties with respect to the subject matter hereof, and supersedes all prior or contemporaneous agreements or understandings, whether oral or written.
