The Magna Carta of Women is a comprehensive womens human rights law that seeks to eliminate discrimination against women by recognizing , protecting, fulfilling and promoting the rights of Filipino women, especially those in the marginalized sectors. It was signed by President Gloria Macapagal-Arroyo on August 14, 2009. It took effect on September 15, 2009. Marginalized refers to the basic, disadvantaged, or vulnerable persons or groups who are mostly living in poverty and have little or no access to land and other resources, basic social and economic services such as health care, education, water and sanitation, employment and livelihood opportunities, housing, social security, physical infrastructure, and the justice system. These include, but are not limited to women in the following sectors or groups: Small farmers and rural workers, Fisherfolk, Urban poor, Workers in the formal economy, Workers in the informal economy, Migrant workers, Indigenous Peoples, Moro, Children, Senior citizens, Persons with disabilities, and Solo parents. Implementation of these Rules and Regulations includes all concerned NGAs, bodies, instrumentalities, including GOCCs, private entities, LGUs, private and state universities and colleges, and private and public schools. The equivalent units in autonomous regions shall

likewise be accountable to implement these Rules and Regulations. In section 41 it stated that, within 180 days from the adoption of IRR, agencies and LGUs should submit a report on the implementation of the Act. Regular reports shall be submitted every January of every year (NGAs to submit to PCW, LGUs to DILG). DILG should consolidate reports of LGUs and submit to PCW every March . All agencies and LGUs shall monitor the effectiveness of their own programs. PCW and CHR will consolidate all reports and submit an assessment report to Committee on Oversight of the Congress every 3 years. The commission on human rights shall recommend (to the CSC, DILG, Sandiganbayan, Office of the Ombudsman) either administrative or disciplinary sanctions to individuals who fail to comply with the said Act, including non-compliance to the GAD Budget policy within 60 days from the date of receipt the CSC shall act on CHRs recommendations. In the case of LGUs, DILG shall conduct appropriate response to CHRs recommendations. CSC and DILG is required to furnish CHR with the actions taken. The CHR shall establish the guidelines for processing and handling of violations committed by private entities or individuals. They shall also forward its recommendation to the appropriate agency of the government and assist the victim or complaint in the filing of cases and develop guidelines and mechanisms for such purpose. This act will ensure the equal status between men and women in the titling the land and the issuance of contracts and patents, and in the filing, acceptance, processing, and approval of

public land applications particularly for emancipation patent and certificate of land ownership award. The Department of Labor and employment shall advance the right of women to decent work, facilitate adequate consultative mechanism with workers and employers. They shall ensure the provision of support services and gears to protect women from occupational and health hazards taking into consideration womens maternal functions. They have to work closely with both employers and unions or worker representatives, in the private sector in promoting a safe and healthy workplace. Different agencies of the state shall promote the right of women to livelihood, credit, capital and technology. They are tasked by the government to make different strategies as to give women access to credit so that they can put up business enterprises. Agencies responsible for the training needed by women shall ensure the availability of such facility. One of the most important goal of this act is to give women health insurance. This will help alleviate suffering because of relentless violation of the rights of women and they will be secured that even if they dont have money they can just go to a hospital and be given medical treatments without having to think of how they are going to pay it. This act wants to establish violence against women desk in every barangay so that women will no longer from injustice. The VAW desk shall develop and assist the barangay in achieving a more long-term plan that will ensure that women are given equal opportunities as men and that they heard if ever they want to air out grievances.

When it comes to legal rights, the magna carta of women is focusing on the repeal or amendment of discriminatory provisions of existing laws such article 14, 96, 124, 211, 225 of the family code. It also prohibits the expulsion and non-readmission of women faculty and students due to pregnancy outside marriage. In theory, this act wants to level out the playing field as to the right of women and men. We know that our society has long been patriarchal and such has resulted to discrimination against women. To avoid further exhibition of such unjust manners, the government opted to establish this law which will not only elevate the status of women in society but it will also protect women from injustice.
