DECISION OF MINISTER OF MANPOWER NUMBER: KEP-186/MEN/1999 REGARDING FIRE PREVENTION UNITS AT WORKPLACES MINISTER OF MANPOWER OF THE REPUBLIC INDONESIA

Considering:

a.

that, fire at workplaces inflicts great financial loss not only to companies and workers but also to national development objectives; therefore it needs to be prevented, that, in order to prevent fire at workplaces, the presence of sufficient fire protection equipment, and officials specifically appointed for the purpose as well as the execution of preventive procedure in emergency situations are necessary, that, in order that fire prevention officials at workplaces can carry out their duties effectively, it is necessary to produce stipulation regarding fire prevention units at workplaces with a Ministerial Decision. Law No. 14 of 1969 regarding Basic Provisions Manpower (State Gazette No. 55, 1969, Supplement to State Gazette No. 2912); Law No. 1 of 1970 regarding Work Safety (Sate Gazette No.1, Supplement to State Gazette No. 2918); Decree of the President of the Republic of Indonesia No. 122/M/988 regarding the Formation of Reformed Development Cabinet; Regulation of Minister of Manpower No. PER-02/Men/1992 regarding the Appointment Procedures, Obligation, and Authority of Work Safety and Health Experts; Regulation of Minister of Manpower No. PER-04/Men/1995 regarding Service Companies for Work Safety and Health; Decision of the Minister of Manpower No. 28/1994 regarding the tenting Organizes structure and Work Procedure at the Department t of Manpower;

DECIDED To Stipulate: DECISION OF THE MINISTER OF MANPOWER OF THE REPUBLIC OF INDONESIA CONCERNING FIRE PROTECTION UNIT AT WORKPLACES

CHAPTER I GENERAL STIPULATON Article 1 In this regulation: a. Workplaces are every room or field, close or open, in motion or settled, where manpower works, that is frequently entered by manpower for the requirements of business and where dangerous source or sources can be found. A manpower is every individual capable of conducting work either inside or outside a work relationship to produce services or goods to fulfil society needs. Fire prevention are all efforts to prevent the appearance of fire consisting of various efforts on the control of every energy form, provisions of fire protection tools and means of rescuing as well as the formation of organization for perceived emergency to combat fire. Fire prevention units are work units formed and assigned to handle fire prevention problems at workplaces, consisting of administration activity identification of hazardous source, inspections, maintenance and repair of fire protection system. Fire prevention officials are officials appointed and given extra duties to identify hazardous source and carry out fire prevention efforts at their working units. Fire prevention groups are working units possessing special functional duties in fire prevention areas. Work safety experts are technical manpower with special skills and from outside the Department of Manpower. A supervisor is a technical employee with special skills from the Department of Manpower, appointed by the Minister of Manpower. An organizer is a person with duties to directly lead a workplace or its selfsupporting part. Entrepreneurs are: 1). 2). Individual, partnership, or cooperation that runs its own company; Individual, partnership, or cooperation that runs a company that is not its own;

Individual, partnership, or cooperation in Indonesia representing companies as stated in number 1and number 2, located outside Indonesian territory.

Minister is the Minister who is the expert in manpower sector. Article 2

(1) (2)

The organizer or entrepreneur must prevent, reduce, and extinguish fire, and carry out fire prevention training at workplaces. The duties to prevent, reduce, and extinguish fire are workplaces as stated in point (1) constitute a. b. c. d. e. f. the control of every energy form; the provisions of detection devices, alarm, fire extinguishers, and means of evacuation; the control of smoke, heat, and gas at workplaces; the formation of fire protection units at workplaces; the performance of training and rehearsals on fire prevention periodically the possession of plan book concerning fire prevention for emergency situation for a workplace with more than 50 workers and/or workplaces with medium and high fire risk potencies.

The control of every energy form, provisions of detection devices, alarms, fire extinguishers, and means of evacuation as well as the control of smoke, head and gas spreads as stated in point (2) letter a, b, and c is carried out in accordance with the prevailing regulations. Planning book for controlling emergency situation as stated in point (2) letter f, contains among other: a. b. c. d. information concerning the source of fire hazard potency and method for its prevention; types, methods of maintenance and use of fire protection tools at workplaces; procedure for work implementation related to fire prevention; procedure in facing fire hazard in emergency situations.

CHAPTER II FORMATION OF FIRE PREVENTION UNITS Article 3 The formation of fire prevention units as stated in Article 2 point (1) takes into consideration the number of manpower and/or classification level for fire hazard potency.

Article 4 (1) Classification on fire hazard potency level as stated in Article 3 consists of: a. b. c. d. e. (2) (3) classification for light fire hazard potency level; classification for light medium I fire hazard potency level; classification for light medium II fire hazard potency level; classification for light medium III fire hazard potency level; classification for heavy fire hazard potency level.

Types of workplaces according to the classification of fire hazard level as stated in point (1) as attached in Appendix 1 of this Ministerial Decision. Types of workplaces that have not been included in the classification for fire hazard level as stated in point (2), is stipulated separately by the Minister or other appointed officials. Article 5

The fire prevention units as stated in Article 3 consist of: a. b. c. d. Fire role officials; Fire prevention groups; Coordinator of fire prevention units; Work safety and health experts as the technical underwriter. Article 6 (1) (2) The fire role officials as stated in Article 5, letter a, should be at least two people for every 25 manpower (workers). The fire prevention group and work safety and health experts for fire prevention as stated in Article 5 letter b, and d, are determined for workplaces with light and medium I level of fire risk that employ 300 workers or more or every workplace with medium II, medium III and heavy fire hazard risk level. The coordinator of fire prevention as stated in Article 5 letter e is determined in the following: a. b. For a workplace with light and medium I fire hazard level is at least one person for 100 workers, For a workplace with medium II, medium III and heavy fire hazard level is at least one person for every working unit.

CHAPTER III DUTY AND THE REQUIREMENT FOR FIRE PREVENTION UNIT Article 7 (1) The fire role official as stated in Article 5 letter a has the duties to: a. b. c. d. e. (2) identify and report about the presence of factors that can cause fire hazards; extinguish fire at its initial stage; direct evacuation of people and goods; carry out coordination with related institutions; render/safe fire location.

In order to be appointed as a fire role official, the following requirements must be met: a. b. c. physically and mentally healthy; at least a Junior High School graduates; has attended technical course for fire prevention at basic I level. Article 8

Fire prevention groups as stated in Article 5 letter b have the duties to: a. b. c. d. e. f. g. h. i. j. identify and report about the presence of factors that can cause fire hazards; carry out the maintenance of fire protection devices; give extensions regarding fire prevention at its initial stage; help compiling planning book on fire prevention for perceive emergency; extinguish fire; direct the evacuation of people and goods; conduct coordination with concerned institutions; give first aids; safe the entire workplace location; conduct coordination with all fire prevention role officials.

In order to be appointed as a member of fire prevention group, the following requirements must be met: a. b. physically and mentally healthy; minimum 25 and maximum 45 years old;

A Senior High School graduate; has attended technical course for fire prevention at basic basic II levels and I. Article 9

The coordinator of fire prevention unit as stated in Article 5 letter c has the duties to: a. b. c. lead fire prevention prior to gating help from authorized institutions; compile work programs and activities concerning methods for fire prevention; propose budget, facilities and means of fire prevention to the organizer.

To be appointed as the coordinator of fire prevention unit, one must fulfil the following requirements: a. b. c. d. Physically and mentally healthy; A Senior High School graduate; Work at the concerned company for at least 5 years; Has attended technical course in fire prevention for levels basic I, II, and Work Safety and Health Expert. Article 10

The work safety and health expert as stated in Article 6 point (3) has duties to: a. b. c. d. e. f. g. help inspecting the implementation of prevailing regulations in fire prevention area; submit reports to the Minister or appointed officials in accordance with the prevailing regulations; keep confidential information regarding the company or institutions that in connection with his position; lead fire prevention prior to getting help from authorized institutions; compile work programs or activities for fire prevention; propose budget, facilities and means of fire prevention to the organizer; carry out coordination with concerned institutions physically and mentally healthy; A Diploma III graduates; work at the concerned company for at least 5 years; has attended technical course in fire prevention for levels basic I, II, and Work Safety and Health Expert I and II.

posses the appointments letter from the Minister or other appointed officials.

In conducting his duties, the work safety and health specialist in fire protection has the authority to: a. b. Give order to stop and refuse the implementation of work that can cause fire or explosion; ask for explanation or information regarding the implementation of the requirements for work safety and health in fire prevention area. Article 11

Procedure to appoint work safety and health expert as stated in Article 10 point (2) letter e is in accordance with the prevailing regulations. Article 12 Technical courses for fire prevention as stated in Article 7 point (2), Article 8 point (2), Article 9 point (2), and Article 10 point (2) must be in accordance with the curriculum and syllabi as attached in Appendix II of this Ministerial Decision. Article 13 (1) Manpower that have followed the technical course in fire prevention as stated in Article 12 have the right to receive a certificate. (2) The certificate as stated in point (1) is signed by the Minister or appointed official. Article 14 (1) The technical course for fire prevention as stated in Article 12 is conducted by Service Company in Work Safety and Health Building, appointed by the Minister ore appointed officials. The appointment of Service Company in work safety and health building as stated in point (3) is based on the qualification of its experts, instructors and supporting facilities possessed.

CHAPTER IV SUPERVISION Article 15 A Manpower supervisor carries out supervisions on the adherence to this Ministerial Decree.

CHAPTER V TRANSTITIONAL STIPULATION Article 16 Organizer or entrepreneur that have formed fire prevention units before this decision is stipulated, at the latest in a year must comply with the stipulations in this Ministerial Decree.

CHAPTER VI CLOSING STIPULATION Article 17 This decree shall take effect as of the date of promulgation.
