2003 Consultation
More than 1000 residents took part in consultation on the regeneration of the Kingsmead area.

Top priority identified was retention and enhancement of public open space.

A Development Brief was put together by external consultants.

The Development Brief


Need to retain public open space referred to on pages 7, 8, 9, 13, 14, 17, 19, 20, 22, 34, 36, 41, 42, 43, 44 & 50.

Depicts a rejuvenated open space framework, made up of traditional open parkland, a linear parkway with the existing playing fields at the heart of the development.

The Development Brief

Consultation was a key principle in the development of this brief. It is therefore accepted that as a guiding principle there will be a need to seek community participation during the implementation.

Appropriation by the Council


The developer wanted to change the status of the land from public open space to development land. Appropriation was necessary to overrule any residents rights to continued access to the land, particularly through a Village Green application. Legally to justify this, must prove no longer required for Open Space.

How was this done?


The agenda for the Executive Meeting in March 2012 at which the appropriation first agreed refers to the item on Kingsmead as: extra item of Urgent Confidential Business.

Why?
Not to use this power [of appropriation] may endanger the project to redevelop the land, as it may allow claims to be made which might have the effect of preventing the sale of the land and thereby halting the development.

But..
Appropriation had to be advertised in a local paper two weeks running. Kent on Sunday only advertised it once. Appropriation was INVALID Re-advertised in April. Public were alerted.

Paper petition: 700 signatures in 5 days!

Presented to the Full Council in April and triggered debate in CAMP.

CAMP Recommendations
The land at Kingsmead should not be sold for housing but that it should be protected as public open space.

There should be fresh and thorough consultation about the development of the land.

An application can be made for a Village Green if local residents have used a piece of land for over 20 years without force, secrecy or permission.

Success would provide the opportunity for the field to be protected for the benefit of the local community.

Final decision to appropriate taken by Council Executive on 12 November, DESPITE: Opinions of both CAMP and Overview Committee Opinion from our Barrister that serious flaws in way Council had proceeded. Agreement of Scrutiny Committee that the action was against Council policy

Overwhelming opposition of the people of Canterbury.
