What is Cyber law?


Cyber law is the law governing cyber space. Cyber space is a very wide term and includes , computer,
networks, software, data storage devices(hard disks, USB disks), the internet, websites, emails. This law encompasses laws relating to : Cyber crimes Electronic and Digital Signatures Intellectual Property Data protection and Privacy

What is Cyber crime?


"It is a criminal activity committed on the internet. This is a broad term that describes everything from electronic cracking to denial of service attacks that cause electronic commerce sites to lose money". Cyber crimes are unlawful acts where computer is used as a weapon-using a computer to commit real world crimes; Cyber Terrorism, Credit card Frauds and used as a target-using computer to attack other computers. Hacking, Virus, worms, Dos attacks

Cyber Crime Can be basically divided into three major categories:


Cybercrimes against Persons Cybercrimes against Property Cybercrimes against Government

Electronic Signature
Electronic Signatures are used to authenticate electronic records. Digital Signature are one type of Electronic Signatures.
Digital Signatures satisfy three major legal requirements: Signer Authentication; Message Authentication;and Message Integrity

Intellectual Property
Intellectual Property refers to creations of the human mind. The facets of Intellectual Property that relate to cyber space are covered by Cyber law and they are: Copyright law Licensing Trademark law Semiconductor law Patent law

Data Protection & Privacy


Data Protection and privacy laws aim to achieve a fair balance between the privacy rights of the individual and the interests of data controllers such as banks, hospitals, email service providers etc. These laws seek to address the challenges to privacy caused by collecting, storing and transmitting data using new technologies.

Advantages of Cyber law


Companies shall now be able to carry out electronic commerce using the legal infrastructure provided by the Act. Digital signatures have been given legal validity and sanction in the Act. The Act throws open the doors for the entry of corporate companies in the business of being Certifying Authorities for issuing Digital Signatures Certificates. The Act enables the companies to file any form, application or any other document with any office, authority, body or agency owned or controlled by the appropriate Government in electronic form by means of such electronic form as may be prescribed by the appropriate Government. The IT Act also addresses the important issues of security, which are so critical to the success of electronic transactions. Under the IT Act, 2000, it shall now be possible for corporates to have a statutory remedy in case if anyone breaks into their computer systems or network and cause loss.

The primary source of cyber law in India is the Information Technology of India, 2000(IT Act). An Act to provide legal recognition for transactions carried out by means of electronic data interchange and other means of electronic communication, commonly referred to as "electronic commerce", which involve the use of alternatives to paper-based methods of communication and storage of information, to facilitate electronic filing of documents with the Government agencies

IT ACT OF INDIA, 2008


IT Act, 2008 , as the new version of IT Act, 2000 is often referred, has provided additional focus on Information security. It has added several new sections on offences including Cyber Terrorism and Data Protection.
