Case About dr. Ira Simatupang

In another case reminiscent of Pritas, criminal defamation charges were filed in January against dr . Ira Simatupang , SpOG , a doctor from a hospital in Tangerang, over a series of private emails to colleagues and friends. According to some news reports, the messages contained accusations of sexual harassment against a colleague, while others asserted the content was legitimately offensive and defamatory

Slamet Yuwono, a lawyer for the woman, identified only as I.S., a doctor, said on Thursday that prosecutors were seeking to charge his client with defamation under the Information and Electronic Transactions (ITE) Law.
I.S. is alleged to have sent an e-mail to friends in 2010 in which she claimed she had been sexually harassed and almost raped by a colleague at Tangerang General Hospital. The charge being brought against I.S. is the same that was leveled against Prita, who was accused of defaming Omni International Hospital in Tangerang after e-mailing to friends about the poor service she had received there.

 A prosecutor demanded a six month jail term for a doctor who sent offensive emails about her boss to fellow doctors on Tuesday. We declare that [she is] guilty of violating article 27 of the Electronic Information and Transaction Law by sending emails 867 times containing defamatory statements, prosecutor Riyadi said. Ira Simatupang, the doctor, was reported by her former boss Bambang Gunawan from Tangerang public hospital. It is not clear what she wrote in the emails, but Bambang claimed it was defamation. The emails were sent to several doctors working at the same hospital.

 Ira refused to comment further about the prosecutors demand. Just wait for my defense [in the next court session], she said. Iras lawyer, Slamet Yuwono, said his clients emails were sent to fellow doctors not to the public. He rejected the prosecutors demand. Let alone six months, we wont even accept a day [in jail] as a sanction, Slamet said. Therefore we will file the defense.

The Punishment
On July 17, 2012, the Tangerang District Court punish Dr. Ira during 5 months in prison with 10 months probation. This was confirmed by Banten High Court on 29 November 2012. The High Judges increase the punishment to 8 months in prison with 2 years probation.

Do you think the punishment fit the crime? Why? Why not?
According to our lack of a sense of justice and concern from the police and the hospitals to dr.ira have proved Having dealt by the police in 2009, the investigation was stopped by the police case. At the same time Tangerang District Hospital disconnecting and unplugging working with Ira education recommendations in the Faculty of Medicine, University of Indonesia. Ira was disappointed then write a letter to a number of side including Tangerang Regent, the National Human Rights Commission, and the Ministry of Health. Back complaint was not addressed. Looking at the case according to our law enforcement should handle this case by considering the state of the two side and not just one side responded. Supposedly the more precious law enforcement in dealing with cases of dr. Ira Simatupang.

What should do people prevent themselves from being the victims of such crime?
-Understanding internet etiquette. -Knowing the things that are prohibited when using email include: a. Treat email personally
b. Do not talk about other people c. Do not use the CC (carbon copy)

d. Answer reasonable - Law should be enforced as fair as possible. - Dont share your private thought by email.
