Race Discrimination
Is discriminating someone who has a different skin
color, eye color, hair color, or facial features
Is prohibited by Civil Rights Law Title VII
Companies have a no tolerance policy when it comes
to discrimination.
Penalties for discrimination can be as minimal as a
suspension without pay up to termination and can
include fines if the case is taken to court.

Everyone group into pairs
One person will have tan colored
skin and the manager
One person will have light brown
colored skin and applying for a
promotion
The exercise is manager will be
evaluating individuals for a
promotion. Even though the
applicant is more qualified for the
position he/she is denied the
promotion. The underlying reason is
skin color, but the stated reason is
not being qualified.

The manager has made off handed comments in past about


one race being more capable to perform in supervisory
positions.

How can the applicant prove he/she is more qualified than


the person chosen for the position?

What steps can the applicant take against the manager


and/or the company?

How can the manager/company avoid a lawsuit?

Discuss and determine how the manager and the applicant


can or should handle the situation?

Age Discrimination
Is prohibited by the Age Discrimination Act of 1967
Does not allow companies to discriminate against
individuals 40 years old or older from any process of
employment:

Hiring
Promotion
Compensation
Benefits entitlements

One person is the hiring
manager
One person is an applicant
who is 47 years old.
All the job qualifications are
met or exceeded by the
applicant. However a younger
applicant has applied for the
same position, who does not
have the experience
qualification.

Discuss and Determine how the situation should be handled


by the hiring manager?

How can the applicant prove he/she was not hired because

What options does the applicant have?

Discuss and determine all avenues available for the John and the
company/manager in the following scenario:
John, Amanda, and Jared are competing for the same promotion.
John has been with the company for 15 years. His performance reviews have
always been excellent. John is confined to wheelchair and although he is
slower than every he completes all assignments on time and with efficiency.
Amanda has been with the company for 14 years. She has always
performed her job effectively and efficiently.
Jared has been with the company for 15 years. He performs his assignments
on time, but he does not put much effort in enhancing his effectiveness or
efficiency.
What would be the consequences if Jared or Amanda were given the
promotion over John?

Jane is 24 yrs old and been with
the company for 5 yrs. She
applied for a promotion to
supervisor of her department.
She has the knowledge,
training, and experience the
company wants for the
supervisor position.
The promotion is given to John
who has only been with the
company for 2 years and does
not have the training needed for
the promotion

When Jane asked why she was passed over for the position,
the manager said he believed the employees would take
direction from John better than they would from her.

The company she works for has many employees and


managers who still have the boys club mentality.

What steps can Jane do to rectify the situation?
