Applicability
of rules

The new rules are now applicable beyond municipal areas:


urban agglomerations,
census towns,
notified industrial townships,
areas under the control of Indian Railways, airports,
special economic zones,
places of pilgrimage, religious and historical importance, and
State and Central Government organisations in their ambit.

Categories
of waste

Waste to be segregated in following three categories


1. Biodegradables,
2. Dry (Plastic, Paper, metal, Wood, etc.) and
3. Domestic Hazardous waste (diapers, napkins, mosquito repellants,
cleaning agents etc.) before handing it over to the collector.

Segregation
and
recycling of
waste

Segregation of solid waste at source is the main focus of SWM Rules


2016. As per the new rules waste generators are responsible for
segregation of waste in above three separate streams
Households
Institutions
market associations
Big housing complexes
event organisers and
hotels and restaurants
made responsible for segregation and sorting the waste and manage
in partnership with local bodies.

Collection of ULB is responsible for collection of segregated waste from


waste
generators. Responsibilities for each stakeholder are described in
detail and waste generators made responsible for storage and
segregation of waste at source and handing over only segregated
waste to ULB or authority

Collect Back
scheme for
packaging
waste

The manufacturers or Brand owners of disposable products such


as tin, glass, plastics packaging etc. or brand owners who
introduce such products in the market and sale or market their
products in such packaging material shall provide necessary
financial assistance to local authorities for establishment of waste
management system.

User fee and


Spot fine

As per the rules, the generator will have to pay User Fee to
the waste collector and a Spot Fine for littering and nonsegregation, the quantum of which will be decided by the local
bodies.
The new rules have given power to the local bodies across
India to decide the user fees
Municipal authorities will levy user fees for collection, disposal
and processing from bulk generators.

Rag pickers

Formalization of rag pickers is proposed in rule through preparing


State Policy and strategies to acknowledge the primary role played
by the informal sector of waste pickers, waste collectors and
recycling industry in reducing waste and provide broad guidelines
regarding integration of rag picker or informal waste collectors in the
waste management system

Land
allocation for
SWM facilities

State Urban Development department is made responsible for


making allocation of land for solid waste management in Master
Plans of Township, Cities, industrial SEZ or any institutional use of
land.

Treatment Bio-degradable waste should be processed, treated and disposed of through


composting or bio-methanation within the premises as far as possible
Compost

The Ministry of Fertilisers Policy for promotion of comarketing of city


compost with chemical fertilizers in the ratio of 3 to 4 bags: 6 to 7 bags by the
fertilizer companies to the extent compost is made available for marketing to
the companies.

Waste to
Energy
and RDF

All industrial units using fuel and located within 100 km from a solid waste
based RDF plant shall make arrangements within six months from the date of
notification of these rules to replace at least 5 % of their fuel requirement by
RDF so produced.
Ministry of Power shall fix tariff or charges for the power generated from the
Waste to Energy plants based on solid waste and ensure compulsory purchase
of power generated
Non-recyclable waste having calorific value of 1500 K/cal/kg or more shall not
be disposed of on landfills and shall only be utilized for generating energy

The rules have mandated bioremediation or capping of old and


abandoned dump sites within five years.
The landfill site shall be:
100 meter away from river,
200 meter from a pond,
200 meter-Highways, Habitations, Public Parks and water supply wells
20 km away from Airports or Airbase

Standards
for Waste
treatment

pollution
Control

The SWM Rules 2016 provide for detailed criteria for settingup solid
waste processing and treatment facility, solid waste management in
hilly areas etc.

Compost
standards

Compost Standards have been amended to align with Fertiliser Control


Order.

Emission Standards are completely amended and includes parameters


for dioxins, furans, reduced limits for particulate matters FROM 150 TO
100 AND NOW 50.
