Flag State jurisdiction
Principle of maritime international law is that
the State whose flag a vessel flies has
jurisdiction over that vessel.
This is called Flag State jurisdiction, even over
ships on the high seas, where there is no
jurisdiction under freedom of the seas
principle.
Achieved by legal provisions.
United Nations Convention on the Law of
the Sea (UNCLOS) 1982, in force from
November 1994

Obalne drave u odnosu na sigurnost plovidbe,
zatitu ljudskih ivota na moru i zatitu morskog
okolia
Drave luke u odnosu na strane brodove koji
pristaju u luke drave

Ispunjavanje obveza od strane drave po
UNCLOS-u ali i po ostalim konvencijama je
provedba FSI
Drava, kao lanica konvencija, obvezna je
provoditi FSI i odgovorna za stanje na
brodovima koji viju njenu zastavu, ali i za:
Certifikaciju pomoraca - STCW
Stanje u lukama
Zatitu ivota na moru, SAR, itd.
Npr.:
Article 92 of UNCLOS states:
Ships shall sail under the flag of one State and,
save in exceptional cases expressly provided in
international treaties or in this Convention, shall be
subject to its exclusive jurisdiction on the high
seas.
Article 94, paragraph 1, provides:
Every State shall effectively exercise its
jurisdiction and control in administrative, technical
and social matters over ships flying its flag.

Article 94, 2 :
2. In particular every State shall:
(a) maintain a register of ships containing the names and
particulars of ships flying its flag, except those which
are excluded from generally accepted international
regulations on account of their small size; and
(b) assume jurisdiction under its internal law over each
ship flying its flag and its master, officers and crew in
respect of administrative, technical and social matters
concerning the ship.

Article 94, 3:
3. Every state shall take such measures for ships flying its
flag as are necessary to ensure safety at sea with regard,
inter alia, to:
(a) the construction, equipment and seaworthiness of ships;
(b) the manning of ships, labour conditions and the training
of crews, taking into account the applicable international
instruments;
(c) the use of signals, the maintenance of communications
and the prevention of collisions.
IMO conventions (and ILO)
embody these principles of Flag State
jurisdiction by specifying the rights and duties
of Flag States in respect of ships flying their
flag.
States ratifying or acceding to these
conventions will have to embody the
principles of the conventions into national
legislation, and provide means for their
effective enforcement.
EU directives
Europske direktive i regulations jo detaljnije
razrauju neke od obveza drava u skladu sa
konvencijama (Npr. ERICA III paket)
Nai propisi, ali i praksa, moraju osigurati
ispunjavanje obveza od strane Republike Hrvatske
Kao pomorska administracija Republike Hrvatske,
nae je ministarstvo (obje uprave) odgovorno za
ipunjavanje obveza RH po pomorskim konvencijama,
tj FSI.
Dosadanji rad
Republika Hrvatska, nae ministarstvo, i do
sada je ispunjavala svoje obveze, ali
Hrvatski Registar Brodova je po zakonu
obavljao jedan dio poslova pomorske
administracije RH u odnosu na tehnike
standarde hrvatskih brodova
Zadatak FSI-odjela (u osnivanju) je da
preuzme dio poslova koje je do sada obavljao
HRB, kako je propisano EU i IMO propisima
FSI propisi
UNCLOS states at Article 91, paragraph 1,
that:
Every State shall fix the conditions for the grant
of nationality to ships, for the registration of ships
in its territory, and for the right to fly its flag. Ships
have the nationality of the State whose flag they
are entitled to fly. There must exist a genuine link
between the State and the ship.

United Nations Convention on Conditions for the Registration
of Ships, 1986, nije jo na snazi,
applies to all ships of 500 gross tons and above that are used in
international trade.
It requires some minimum participation of Flag State nationals or
permanent residents (individuals or corporations) in the ownership,
manning and management of ships, so that the Flag State might
exercise effective jurisdiction and control over shipping. Any economic
link, such as ownership, must be transparent and identify the persons
involved and their accountability.
Flag State must have a national maritime administration that is
competent and adequate to ensure that its ships comply with its laws
and with all applicable international rules and regulations, such as
standards of safety on board and of protection of the marine
environment.

Osnivanje novog FSI-odjela
Naredbom ministra 27. prosinac 2010 imenovan za
voditeljem tima za uspostavu sustava za provedbu
propisa u pogledu tehnikih standarda za brodove
hrvatske zastave
Praktino osnivanje FSI-odjela u sastavu:
Naelnik i
4 kontrolora (inspektora) nautiki, brodograevni,
brodostrojarski, elektroniki
Rad uz pomo Samostalnog odjela HRB za FSI
Neposredni zadaci po naredbi
Utvrditi plan prioritetnih aktivnosti koje je potrebno
napraviti od strane Uprave za sigurnost plovidbe,
zatitu mora i unutarnjih voda, Uprave pomorskog
prometa, pomorskog dobra i luka i Samostalnog
odjele Hrvatskog registra brodova radi otklanjanja
uoenih nedostataka u dijelu FSI-a tijekom vanjskog
audita hrvatske pomorske administracije obavljenog
od strane Europske komisije (EK) i Europske
agencije za sigurnost plovidbe (EMSA);

Uspostaviti sustav prikupljanja i obrade podataka o statusu
hrvatskih brodova koji e sadravati informacije o svim
inspekcijskim pregledima, statusu svjedodbi, obavljenim
pregledima od strane priznatih organizacija kao i druge
informacije bitne za prikaz cjelovite slike stanja hrvatske
flote i svakog pojedinog broda;
Organizirati sustav osposobljavanja djelatnika lukih
kapetanija vezano za nadzor hrvatskih brodova u dijelu FSI-
a;
Organizirati i koordinirati izradu dokumentacije sustava
upravljanja kvalitetom koja e se odnositi na FSI;
Osposobljenosti djelatnika FSI

HRB je osnovao posebni odjel sa ciljem da
pomogne osnivanje i rad FSI-odjela:
Suradnja sa FSI-odjelom u poslovima koje je do
sada obavljao sam HRB
Prijenos znanja i iskustva potrebnog za provedbu
FSI na FSI-odjel i uprave
Suradnja u izobrazbi djelatnika uprava
Suradnja u izgradnji sustava upravljanja
kvalitetom

Article 4 - Conditions for allowing a ship to operate upon granting
the right to fly the flag of a Member State
1. Prior to allowing a ship to operate, which has been granted
the right to fly its flag, the Member State concerned shall take
the measures it deems appropriate to ensure that the ship in
question complies with the applicable international rules and
regulations. In particular, it shall verify the safety records of
the ship by all reasonable means. It shall, if necessary, consult
with the losing flag State in order to establish whether any
outstanding deficiencies or safety issues identified by the latter
remain unresolved.

Article 5
Detention of a ship flying the flag of a Member State
When the administration is informed that a
ship flying the flag of the Member State
concerned has been detained by a port State, it
shall, according to the procedures it has
established to this effect, oversee the ship
being brought into compliance with the
relevant IMO Conventions.

Article 6 - Accompanying measures
Member States shall ensure that at least the following information
concerning ships flying their flag is kept and remains readily accessible
for the purposes of this Directive: (a) particulars of the ship (name,
IMO number, etc.);
(b) dates of surveys, including additional and supplementary surveys, if
any, and audits;
(c) identification of the recognised organisations involved in the
certification and classification of the ship;
(d) identification of the competent authority which has inspected the
ship under port State control provisions and the dates of the
inspections;
(e) outcome of the port State control inspections (deficiencies: yes or
no; detentions: yes or no);
(f) information on marine casualties;
(g) identification of ships which have ceased to fly the flag of the
Member State concerned during the previous 12 months.

Article 7 - Flag State auditing process
Member States shall take the necessary
measures for an IMO audit of their
administration at least once every seven years,
subject to a positive reply of the IMO to a
timely request of the Member State concerned,
and shall publish the outcome of the audit in
accordance with relevant national legislation
on confidentiality.

Article 8
Quality management system and internal evaluation
1. By 17 June 2012 each Member State shall
develop, implement and maintain a quality
management system for the operational parts
of the flag State-related activities of its
administration. Such quality management
system shall be certified in accordance with
the applicable international quality standards.

Na FSI-19 donesen prijedlog izmjena Code i
svih konvencija
Prije svega nuno definirati i izraditi

IMO Code obveze
Po IMO Code obveze podijeljene na:
LEGAL za izradu propisa kojima se implementiraju
meunarodni propisi
FLAG STATE za standarde brodova i priznatih
organizacija, te njihovog nadzora
COASTAL STATE za obveze koje imamo kao obalna
drava
PORT STATE za obveze i prava koje imamo kao drava
luke u odnosu na strane brodove
STCW za standarde certifikacije pomoraca
Obuhvaaju praktino sve djelatnosti Uprava, ali i
kapetanija
I na kraju
Sve ovo zajedniki je posao i odgovornost svih
nas koji radimo u pomorstvu Republike
Hrvatske
Moramo osigurati ispunjavanje postavljenih
meunarodnih standarda i zahtjeva
Nije pitanje hoemo li uspjeti, jer po ovom
pitanju jednostavno nemamo izbora, mora se,
kad-tad, to prije - to bolje
