What is Sexual Harassment?

-demands, request or otherwise requires


any sexual favor from the other, regardless
of whether the demand, request or
requirement for the submission is accepted
by the object of the said act.

What is Sexual Harassment?

-the administrative offense of sexual harassment is an act,


or a series of acts, involving any unwelcome sexual
advance, request or demand for a sexual favor, or other
verbal or physical behavior of a sexual nature, committed
by a government employee or official in a work-related,
training or education related environment of the person
complained of.

Section 53. Sexual harassment is classified as grave, less grave and light
offenses.
A. Grave Offenses shall include, but are not limited to:
1. unwanted touching of private parts of the body (genitalia, buttocks and
breast);
2. sexual assault;
3. malicious touching;
4. requesting for sexual favor in exchange for
employment, promotion, local or foreign travels,
favorable working conditions or assignments,
a passing grade, the granting of honors or
scholarship, or the grant of benefits or payment

B. Less Grave Offenses shall include, but are not limited:

3. derogatory or degrading remarks directed toward the members of
one sex, or ones sexual orientation or used to describe a person;
4. verbal abuse with sexual overtones; and
5. other

Section 53. Sexual harassment is classified as grave, less grave and light
offenses.

The following shall be considered Light Offenses;


1. surreptitiously looking or staring a look of a persons private part or
worn undergarments;
2. telling sexist/smutty jokes or sending these through text, electronic mail
or other similar means, causing embarrassment or offense and carried out after
the offender has been advised that they are offensive or embarrassing or, even
without such advise, when they are by their nature clearly embarrassing, offensive
or vulgar;
3. malicious leering or ogling;

The following shall be considered Light Offenses;


4. the display of sexually offensive pictures, materials or
graffiti;
5. unwelcome inquiries or comments about a persons sex life;
6. unwelcome sexual flirtation, advances, propositions;
7. making offensive hand or body gestures;

Section 53. Sexual harassment is classified as grave, less grave

The following shall be considered Light Offenses;


8. persistent unwanted attention with sexual overtones;
9. unwelcome phone calls with sexual overtones causing
discomfort, embarrassment, offense or insult to the receiver;
10. other analogous cases.

HOSTILE ENVIRONMENT

When unwanted touching, comments or gestures are so bad or occur so often


that it:
interferes with your schoolwork,
makes you feel uncomfortable or unsafe
prevents you from participating in or benefiting from a school program or activity

This type of harassment could include:


ongoing catcalls or sexual comments
frequent or severe teasing toward a student related to sexuality, gender identity, physical
appearance, etc.
physical harassment targeted at someone because of their gender identity or expression

Sexual Harassment Defined

Education, or training related sexual harassment is


committed by the teacher, instructor, professor,
coach, trainor, or any other person who, having
authority, influence or moral ascendancy over
another who demands, request or otherwise requires
any sexual favor from the other regardless whether
the demand, request or requirement for submission is
accepted by the object of said Act.

Sexual harassment in school happens when

(1) submission to or rejection of the act or series of


acts as a basis for any decision affecting the
complainant, including, but not limited to, the giving
of a grade, the granting of honors or a scholarship,
the payment of a stipend or allowance, or the giving
of any benefit, privilege or consideration.

Part 1: Make it Clear
1. Tell them to stop
Begin by telling the person that what they
are doing is inappropriate and that you
want them to stop. Try saying something
like, "What you are saying or doing makes
me uncomfortable. Please stop right now."
If that does not work, use the word
harassment in your statement to them:
"Stop harassing me. I am going to report
you to the Dean/President/Pulis right
now."

2.Dont blame yourself.
People who sexually harass or bully others
can sometimes be extremely manipulative.
They may try to make you feel as though you
are the one in the wrong for rejecting their
advances or telling them to stop. Dont be
fooled; they have no right to make you
uncomfortable in such a manner. No one has
the right to sexually harass another person,
regardless of their age, position, or level of
authority.
There is no such thing as asking for it.

3. Keep a record of what happens.
If your harasser does not stop after
you've clearly told them to, you
should begin writing down what
happens each time you interact with
him or her. This record can help you
while reporting the harassment. Save
any offensive notes, messages, texts
or e-mails that you receive from the
harasser as evidence of their
inappropriate behavior.

4. Tell your parents.


Before you decide to file a
complaint with your school, let
your parents know what is going
on. Listen to your parents
guidance about the situation. Ask
them if they will help you speak to
your teacher or other authority
figure if youre uncomfortable
doing it alone.

3. File a complaint.

It is very likely that your teachers


and the schools administration
will be able to resolve your sexual
harassment issue for you, but in
the event the school fails to take
your claims seriously, you may
need to escalate your complaint.
What if the employer of head
of office did not undertake any action despite
his/her knowledge of SH?

The employer of head of office, educational or training institution will be


held liable for the damages arising from acts of sexual harassment if they
are informed by the offended party of the occurrence of such acts, yet no
action has been undertaken.

R.A 7787 Penalty

Sec. 7. Penalties. Any person who violates the provisions of this Act
shall, upon conviction, be penalized by imprisonment of not less than
one (1) month nor more than six (6) months, or a fine of not less than
Ten thousand pesos (P10,000) nor more than Twenty thousand pesos
(P20,000), or both such fine and imprisonment at the discretion of the
court.
