The authority to file formal

administrative complaint shall be vested in


the prosecutor assigned for that purpose, or
in his absence, the Chief, RIPD in the regions
or Director, DIP in the BJMPNHQ.

All administrative actions shall be


prosecuted under the direction and control of
the prosecutor.
In cases where a complaining
witness so desires and upon request, the
Director, Investigation and Prosecution
may authorize in writing a private
prosecutor who is a lawyer to prosecute
the case. Once authorized, the private
prosecutor shall prosecute the case up to
the end of the trial even in the absence of
Bureau Prosecutor, unless the authority
is revoked or otherwise withdrawn.
Upon recommendation of the
Director for Investigation and
Prosecution, the Chief, BJMP shall
designate such numbers of Prosecutors
of the BJMP-NHQ and of every region.
Relief and transfers of designated
Prosecutors shall not become effective unless
concurred by the Director, DIP. In the
absence of qualified Prosecutors, the Chief,
RIPD or his qualified and designated
Investigators shall act as Prosecutors.
