PRIVACY RISKS AND PRINCIPLES

One of the key aspects of privacy is control of information about


oneself.
In filling an online form, we should be aware of the privacy risks
by taking precautions in revealing our information.
As a party who create the forms, we also should be responsible in
handling the information by providing a privacy policy with an
opt in/opt out options.
PRIVACY RISKS
Collection of data before clicking SUBMIT button
NaviStone, a company that advertises its ability to unmask anonymous website
visitors and figure out their home addresses by providing Javascript coding
that can invisibly grabs each piece of information as you fill it out in a web
form before clicking the SUBMIT button.
Allen Abbott, NaviStones chief operating officer, wrote that NaviStone
doesnt use email addresses in any way to link with postal addresses or any
other form of PII. He said the companys primary business is helping their
clients send personalized direct mail.
After Gazmodo site revealed and report the situation, NaviStone says it will no
longer collect email addresses from people this way.
While we believe our technology has been appropriately used, we have
decided to change the system operation such that email addresses are not
captured until the visitor hits the submit button, Abbott wrote.

THE FOURTH AMENDMENT, EXPECTATION OF
PRIVACY & SURVEILLANCE TECHNOLOGIES

The right of the people to be secure in their person, houses,


papers, and effects, against unreasonable searches and seizures,
shall not be violated, and no Warrants shall issue, but upon
probable cause, supported by Oath or affirmation, and
particularly describing the place to be searched, and the persons
or things to be seized.

EXPECTATION OF PRIVACY

Expectation of privacy is a legal test which is crucial in defining


the scope of the applicability of the privacy protections of the
Fourth Amendment to the United States Constitution.
The expectation of privacy refers to those places where the U.S.
Constitution requires law enforcement to obtain a warrant in
order to search for evidence of a crime, such as a person's home
or car.
In Florida vs. Jardines, the U.S. Supreme Court ruled on March 26,
2013, that police violated the Fourth Amendment rights of a
homeowner when they led a drug-sniffing dog to the front door
of a house suspected of being used to grow marijuana.
