The right of private defense
Sections 96 to 106 of the penal code state the law relating to the right of private
defense of person and property. The provisions contained in these sections give
authority to a man to use necessary force against an assailant or wrong-doer for the
purpose of protecting ones own body and property as also anothers body and
property when immediate aid from the state machinery is not readily available; and
in so doing he is not answerable in law for his deeds.
Self-help is the first rule of criminal law. The right of private defense is absolutely
necessary for the protection of ones life, liberty and property. It is a right inherent
in a man.
The right of privet defense is made for protecting
tow things

The privet defense is made for protect human body an property.thay are protected
by two types of right. The right are:
Right of private defense of body
His own body, and the body of any other person against any offence affecting the
human body
Right of Private defense of property
The property, whether moveable or immovable, himself of any other person,
against any act which is an offence falling under the definition of theft, robbery,
mischief or criminal trespass, or which is an attempt to commit theft, robbery,
mischief, or criminal trespass
Act against which there is no right of privet
defense
Already we have known that any person can commit any act to save himself and his
property its called privet defense but there are some exceptional case where the right
of privet defense shall not be applicable. If any one want to apply the right of privet
defense at first he have to know that where the right of privet defense shall not be
applicable. According to the section 99 of penal code, 1960. the case are:
Against the acts of a public servant; and
Against the acts of those acting under their authority or direction;
When there is sufficient time for recourse to public authorities; and
The quantum of harm that may be caused shall in no case be in excess of harm
that may be necessary for the purpose of defense.
