Anti-Hospital Deposit Law


Republic Act No. 10932

On August 3, 2017, President Rodrigo R. Duterte signed into law the


Republic Act No. 10932 or also known as the Anti-Hospital Deposit Law.
This is an act to strengthen the anti-hospital deposit law by incresing the penalties
for the refusal of hospitals and medical clinics to administer appropriate initial
medical treatment and support in emergency or serious cases.

Inadequacy of medical capabilities

a. transfer the patient to another facility by the patient or


next of his kind
b. transfer the patient to another facility if they unconscious,
incapable of giving consent
c. transfer entails less risk than further confinement

Administered medical treatment and support

a. transfer to patient to an appropriate hospital consistent with


the needs of the patients

Presumption of Liability

Practice of demanding deposits or advance payments for


confinement or treatment, a presumption of liability shall arise
against the hospital, medical clinic, and the official, medical
practitioner, or employee involved.

Health Facilities Oversight Board

All complaints for violations of this act against health facilities shall
be filed initially with the health facilities oversight board under
the health facilities and services regulatory bureau (HFSRB) of the
DOH.

PhilHealth Reimbursement of Basic Emergency Care

PhilHealth shall reimburse the cost of basic emergency care and


transportation services incurred by hospital or medical clinic for
the emergency medical services given to poor and indigent
patients.

WHAT IS Republic Act 10932?


On August 3, 2017, President Rodrigo R. Duterte signed into law the
Republic Act No. 10932 or also known as the Anti-Hospital Deposit Law.
This is an act to strengthen the anti-hospital deposit law by incresing the penalties
for the refusal of hospitals and medical clinics to administer appropriate initial
medical treatment and support in emergency or serious cases.

The law prohibits any hospital or medical clinic personnel, as defined or mentioned in the act,
to request, solicit, demand or accept any deposit or any other form of advance payment as
a prerequisite for administering initial or basic medical care to patients. This also applies to all
who refused to administer such treatment and support to prevent death, permanent injury or
loss of child in case of pregnant woman.

Emergency - the condition of a patient that entails immediate danger and such delay in initial support
and treatment may cause loss of life, permanent disability, or loss of child or noninstitutional delivery
in case of a pregnant woman.
Serious case - the condition of a patient characterized by gravity or danger.
Basic emergency care - urgent response like diagnosis and use of medical equipment and/or supplies.
Noninstitutional delivery - the delivery of a newborn while in transit, outside of a health facility, after
an initial consultation was done with a health facility.

In case there is no ambulance available for use by the hospital or medical clinic to render
the transfer, the local government unit (LGU) where the hospital or medical clinic is located
must allow the FREE use of its emergency vehicle and must be accompanied by a staff nurse
with Advanced Cardiovascular Support (ACLS) Certification or its equivalent.

Any official medical practitioner or employee of the hospital or


mdecial clinic who violates the provisions of this act shall, upon
conviction by final judgement, be punished by imprisonment .

Presumption of Liability- In the event of death, permanent disability, serious impairment of the health
condition of the patient –complainant, or in the case of pregnant woman, permanent injury or loss of her
unborn child, proceeding from the denial of his on her admission to a health facility pursuant to or policy or
practice of demanding deposits or advance payments for confinement or treatment, a presumption of liability
shall arise against the hospital, medical clinic, and the official, medical practitioner, or employee involved.

Health Facilities Oversight Board- All complaints for violations of this act against health
facilities shall be filed initially with the health facilities oversight board under the health
facilities and services regulatory bereau (HFSRB) of the DOH.

PhilHealth Reimburesement of Basic Emergency Care.- PhilHealth shall reimburse the cost
of basic emergency care and transportation services incurred by hospital or medical clinic
for the emergency medical services given to poor and indigent patients.

Tax Deductions – Other expenses incurred by the hospital or medical clinic in


providing basics emergency care to poor and indigent patients not reimbursed
by PhilHealth shall be tax deductible.

Implementing Rules and Regulations.- The DOH , in coordination with Philhealth and the
Bereau of International Revenue (BIR), and in consultation with NGOs advocating for
patients rights and public health, shall promulgate the necessary rules and regulations to
carry out the provisions of this Act within ninety days from the effectivity there of.
